Stealing in general is illegal. Bitcoins? Ofcourse. It's a currency. It's stealing money basically.
it is illegal for sure, however a lot of people are doing that because bitcoin is not regulated by anyone so people usually dont get any punishments

Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.
As the title said is stealing bitcoin illegal? difinitely yes as in the bible said stealing is illegal and its bad in the g*d eye's if you are believing on him because if don't then you are freely to do anything you want if you don't afraid with him but i think if in the month of december then you gonna receive a bitcoin then its early christmas for you

Incase as of now there are no laws on it like stealing bitcoins on scam HYIPS .

This shouldn't even be a question of legal. Legal != right or moral. The fact that the OP even would need to ask this question says a lot about them. I can only hope they don't now or ever have kids. The world is already overflowing with this type of mentality.

Sad to know these things but it's reality, eve someone commit stealing those Bitcoins but still useless since there's no law or regulation of prohibiting this act since Bitcoin is not legalize. Tracing scammers would be hard since as we all know that Bitcoins one of its characteristics is its anonymity which is really hard to trace because of encrypted transactions.

Regarding to your question of course it does because the word stealing is illegal in any ways but what have you take an example is very rare to happen and I think its impossible to happen tho, you cant generate a new bitcoin address that has bitcoin in it, even there are already hundred of thousands of bitcoin address no one will be the same address and no one used it before and that's the reason why it has a coin in it. Okay. Let's assume he actually got into that kind of situation. Consider this. Stealing is illegal, yes. However, since he overlapped the address, the former owner of that address wouldn't be able to access those coins anymore and since there's no way to know who that former owner is, wouldn't it be a shame to not spend those coins and let them be in there? Think about it.

But if later we find the address of the owner or owners of such addresses to contact you to ask for the return of funds that there then you are obligated to replace

Steeling is steeling, no matter what way you look at it. If you take something that is not yours, you are stealing it. There is no reason to lecture, but if this was me and I would have accidentally done this, I would post on a public forum about this and this way the rightful owner could make claim. If not found with in a certain amount of time, I would consider it free game to claim.

If the country of hacker doesn't have law with bitcoin then he is going to be safe at all but if bitfinex is going to let this case go to fbi and they are going to file a case against him. Once he got traced by them for sure he is going to touch down the bars behind and going to be in jail. Because stealing is illegal regardless what thing is that.

Even those fbi would have a hard time to trace down those hackers on bitfinex incident since bitcoin transaction is completely anonymous, no hacker would be fool enough to leave trace and for sure he would withdraw all those hacked coins in different addresses. Back to Op's queries stealing is illegal in any way and in any matter no matter how big or small as long as you got those possession that does not belong to you even no one see you but stealing is illegal in any way.

What you were saying is not possible, I believe. It can't happen that the same address can be generated twice.

Stealing is without a doubt illegal but if you happen to generate an address which happens to have some bitcoins (miracle), then may be send some back to the address which had send it to you. Let make this an even more miracle by assuming that there is no address of the sender and you just got it instantly. Then keep it dude! Enjoy!

Yes, but the hack can use bitcoin mixer to hide the identity and sell on the exchanges, actually it is plausible and they usually use this way to laundry money.

That is not stealing if you will ask me and that is like a very low chance that it might happen. Are there any reports or someone claimed that this generated duplicate address did happen? I might want to read it if there is some.
