Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.

Yes of course! stealing bitcoin is very illegal. but in your statement I cannot consider it stealing and I don't see any illegal in that matter. I can say its just an accident to sent it to your address. Meaning you had no fault in it.

yeah it's no one's fault and what you're doing now can't be consider illegal, and this is an one in a million coincident so you can't be consider as a stealer as well.

If you are stealing from people's wallets or accounts etc that is plain stealing as it isn't like fiat money, where you may find a few coppers on the street and pick them up. Bitcoin is stored so wherever it is stored and then stolen from, then it amounts to theft that's for sure! Cry

As OP said he generated  an address which is already been  own  by someone  because there is  a balance  on that said address. Hes askin if  he would intend to get those bitcoin is considered as stealing  then for sure its stealing  but  even if he  intend to  get back those coins  he wouldnt still know the true  owner of those coins.
lol of course it will never happen. the system will not produce bitcoin address is already in use. bitcoin address will never expire so someone bitcoin address will not disappear although never in use in the long term, so like get bitcoin from it is impossible

I think it is not included in steals bitcoin. unless you go into someone's wallet and took their bitcoin. but I've never heard of someone getting bitcoin in a new bitcoin address generated, are you ever heard it?

Off course stealing things is alwats illegal but you need to know that bitcoins are not traceable so you cant deal with that so in one way it is not illegal because it are bitcoins.

yeah it's no one's fault and what you're doing now can't be consider illegal, and this is an one in a million coincident so you can't be consider as a stealer as well.

Yes accident receiving bitcoins to your bitcoin wallet that has been accidentally sent by someone is not considered as stealing. But you must be responsible if someone sent that to you. I guess you are just going to return it to the sender but it is going to depend on your conscience but this type of incident is very hard to happen.

Vwry right. The probability for that to happen is too low. There are too much numbers and each one are spexial. I think it will prompt an error once tou deleted a certain number or letter.

Of coursing stealing Bitcoin is illegal because it still is stealing but the thing is that it is online and these people who steal Bitcoin know how to get away with it.
Nobody can find out who the person is and that is why it can happen.

Stealing is always illegal if you call it stealing already cause it means taking something which isnt yours without asking that's illegal in any place.
Stealing bitcoin won't really work anyways if you don't have the information of the other person it's near impossible to hack.
To be the oP is so pathetic and it really obious that stealing someones money or bitcoin is illegal acitivity then he gonna ask if is legal or illegal how people nowadays like media they always manipulating people to believe them on what they are going to do. hayst.
yeah me a bit not understand what is the answers sought by the OP, stealing is still stealing and that's illegal act how you do but I try to think positively maybe she's afraid to use bitcoin upon hearing that bitcoin can be easily hacked by a hacker.
It's very obvious that stealing some money are too illegal and as you said in your reply it is still illegal make some sense make money in legal things you can receive more than what you deserve if you work hard stealing is not a solution in money or a problem that what we are facing too everything can be learn and everyhing will be perfect..

Stealing anything is illegal so yes bitcoin aswell ofcourse there's no authorities which can really track you or do anything.
But if you'd go to the police and say you stole bitcoin then I am not sure if they would actually do something lol.

Even for the case of OP, if he gets chances to return those bitcoins, ignoring the and keeping must be considered as stealing bitcoins. We need to act based on our heart not by mind. When we get chances to return the bitcoins we got due to some mistakes, we should return, else it is kind of stealing only.

Stealing bitcoin is very illegal just like stealing money so you shouldn't steal bitcoin if you are not a criminal who doesn't want to get into problems.
Bitcoin is very anonymous though so I could imagine it's hard to catch a thief.

let us take this to the real world. if i steal someones door keys and use them at their home i am breaking in. but if i find the key and use them to enter the house, this would be still breaking in by the standards of most people. but if i take a piece of metal and make a random key, then go to a random house and the key fits the lock, then this would be not breaking in, but most would say it feels still wrong.
this is the same with a stolen wallet, a found wallet and you a random generated key that has some founds in it.

Well that is just OP's example and I thinking in my part that is extremely possible cause like you said a generated bitcoin address that already has an owner would definitely not gonna be get by anyone anymore right? but as OP has said this is just his example in his matter in what if only! and if he would get that Bitcoin is it illegal? that is just his question and an example for this matter.

To generate already used bitcoin address, the chances are very thin. But in the case of if that collision happens, we must try to conduct the original owner of that bitcoin address, by announcing in this forum. But, taking away that bitcoins must be a kind of stealing only.

Stealing bitcoins is not illegal but its of course also not good, I think that there is still no real rule for this in certain country's due to that I think its not illegal.
I think you are also than a sad person if you are doing this in my eyes.
