Bitcoin is money but not a legal money so that is not illegal, I hope you know guys what are the difference of not right and illegal. Maybe it is not right to steal but you cannot say that it is illegal because bitcoin is an independent currency and the government does not recognize it.

Correct base on the statement of OP there is no stealing happen since OP only generate bitcoin wallet and without knowing that address has already have bitcoin amount then i think OP is a lucky person.

All ways of stealing is illegal, bitcoin can steal if you will broadcast you pin to your friends who are also users of bitcoin. But if you are the only one who know about your account i think your money in your wallet is safe.

Off course stealing things are alwasys illegal but you have to know what to steal and what you want to steal with becayse when you steal bitcoins you are untraceable for sure!
You are traceable as the network is their but if you know how to hide your real IP that would link you to the crime then you are safe and free to launder the amount your steal. That is my suggestion but don't do that if I were you if you do not want to face the consequences.

I think stealing bitcoin is illegal. It is illegal because even if you are anonymous, there's no law that says you can steal bitcoin from other bitcoin users. Those who do steal bitcoin are brave to steal other's bitcoin. Stealing money is illegal so I think stealing bitcoin is illegal too since since it is also a currency it is just digital.

f you wanted to make a bet on 50% win chance and mistakenly made a bet at 50x multiplier, then will you return the money to your gambling owner ? NO then why would you return the money which your goodwill or good luck has brought to you but unexpectedly ? Have no obvious reasons to return unless and until a claim is made !!

I'm also thinking the same, the fact is that its still not a official currency so this means its not really illegal, of course you should not do this because it would be disgusting..

If the authorities indeed does not recognize bitcoin and cryptocurrencies in general as you say, those dealing with them would not have been walking the streets free. Fact is the authorities are still fine tuning their position on this new technology and that doesn't make it illegal like you would say for things like hard drugs. At any rate, taking whatsoever that does not belong to you, even if it be garbage, without the permission of the owner is stealing no matter what color you chose to paint it. Bottomline is to do to others, what you want others to do to you.

Obviously stealing bitcoin or any digital asset is a crime and even a single bit of 1 and 0 is crime if you take that without owners consent. But the situation you had mentioned is not crime because it is the bitcoin that you got by luck in randomly generated address and that's not stealing. It's your fortune that you got the money for free but it's 100% unrealistic and will never happen ![Grin](https://bitcointalk.org/Smileys/default/grin.gif)

Well, the "right" thing to do here is surrender the money to the authorities or to a tv or radio station and have them look for the rightful owner. But as you say, for some (or most) it would be too much of a hassle to do such things when the easier thing to do is just put it in your pocket.

You should just not do it because its something that is against the rules and I think if you are doing this its very wrong and you should be punished on some way. It cannot be illegal at this time because its not an official currency..

It is true that it is something that is illegal. but I am sure that all of these could also be prosecuted because they feel aggrieved over all the things they are going through. Never seen something only one side of the problem, because it would be dangerous in decision-making or sometimes the decisions taken have no effect is certain and clear. So that will pose a larger problem again

I think stealing anything from anyone is a criminal offense and the law including the illegal act when you steal bitcoin has included illegal actions even though it will be hard caught because is hard to track transaction are made in bitcoin,And there are no such things good in illegal.

Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.
You say you dont want to be lectures when you ask the most stupid questions. How the hell is your new address going to magically become someone else's ? Dude for Gods sake use your head. You need a slap dude.

I think more this question is more about ethical than legal aspect. If you get coins by mistake in your wallet.the chances are the person who send it mistakenly will not try to find you in the first place for it wouldn't be that easy.Second even if he found you somehow.he could not prove if it was sent by mistake so it is up to you ( the receiver0 to return it on ethical grounds

You say you dont want to be lectures when you ask the most stupid questions. How the hell is your new address going to magically become someone else's ? Dude for Gods sake use your head. You need a slap dude. No need to be rude. That's entirely possible, although it has a VERY small chance to happen. I have heard your new address (for example cold wallet) can coincide with someone else's. Because of the many characters an account has, it's a number close to 0 but it still can happen. Of course it would not be legal, and the easiest way to find that out is replacing 'somebody else' with 'me'. Would it be illegal for someone else to take the money he found in a wallet that coincided with mine? It is not.

I agree with that. I looked at the posts so far, it seems most people think the bitcoin is a proerty and stealing is illegal.
