In practical terms it seems hard for him/them/her to do.
He could sell on Polo, but then he might only be able to withdraw as little as $2000 per day.
People will see the movement of the ETC and , who knows what might then happen?

That would be safer and wouldn't shock the price unless the buyer buys a significant amount and dumps.

The pump crew involved must know the owner of all those mETC; the private key might even have changed hands already.

Lets say some of the "stolen" coins get moved to Poloniex. Poloniex is registered in the US isn't it?
I could see some kind of legal action arising.

Lets say some of the "stolen" coins get moved to Poloniex. Poloniex is registered in the US isn't it?
I could see some kind of legal action arising.

He could tumble it (mix it with "legit" ETC coins so much that it's hard to track which coins are from the hack).

Or use other exchanges.

Or there's the argument (however silly it might be) that the hacker not being a criminal because het used what the code allowed.

I also don't think Polo would do anything or would be forced to do anything with the tainted funds.

This is the point I was trying to make. What legal action is there to charge the attacker with? Is Vitalik going to come after him? I think not because he knows he has nothing against the attacker. In fact Vitalik can be charged for the DAO's negligence of security. Yes that is arguable but it is possible.

I also don't think Polo would do anything or would be forced to do anything with the tainted funds.
It's probably uncharted territory legally, but there might be some risk for Polo if they turned a blind eye

Yes. Until there is a case filed against the attacker then he is free to do what he wants. How can you charge someone when Vitalik himself has not filed a formal case? No one is even after him. Mircea Popescu even said he was involved yet no one is also after him. Vitalik could be scared because he can be counter charged with another case for his involvement in the DAO.
