I always try to work things out amicably but it appears that the only option left is legal action. After all, his identity is known and he continues to operate his exchange so there is a source of money that can be seized.

I am in Europe myself. Are there any members affected by this who live in Brazil? If so, I think we should come together and file a class action lawsuit so at least the amounts owed and to whom are recorded and then the lawyer can pursue recovery.

Anyone who is interested please respond here in the forum.

I sempre tentei resolver as coisas amigavelmente, mas parece que a única opção é uma ação legal/jurídica. Depois disso tudo, sua identidade é conhecida e ele continua a operar sua exchange que seria fonte de dinheiro que poderia ser apreendida.

Eu estou na Europa. Há qualquer membro afetado por isto que viva no Brasil? (Thiago é um deles até onde sei Tongue) Se houver, eu aho que devemos nos unir abrir uma ação legal para que ao menos as quantidades e para quem estarão guardadas e então o advogado poderá "correr atrás" para recuperar os BTC.

I have some more good news - have a look at Bitcoin Magazine's latest story:

Isn't it nice to see that our money has furthered the success of Mercado Bitcoin?! No mention of Leandro, the article refers to the CEO of Mercado Bitcoin Rodrigo Batista. I wonder if he knows how much money his business partner scammed?!

Leandro  is known to Brazilian authorities already, as can be seen by the links that Adriano provided.

Now Mercado Bitcoin's business is growing.

Based on these facts, I propose the following next steps:

1) If someone in Brazil simply visits a lawyer and shows him all the information we have compiled in this thread, I think there is a good chance the lawyer would be willing to take on the case without a retainer fee (instead they could receive a percentage of any recovered money). Why?

DO NOT UNDERESTIMATE THE SIZE OF THIS SCAM! Just Thiago alone is owed over half a million dollars! I am personally owed tens of thousands! The total amount could easily be over 10 million dollars!!

The lawsuit would certainly be all over the news in Brazil - Leandro would be called the Brazilian Pirateat40! The exposure for the lawyer would be enormous and far more profitable than a retainer fee in the long run!

Even if the lawyer wants an upfront fee, no problem - anyone in this thread who is interested in joining the class action lawsuit can simply contribute a portion. There are many of us here -  it will not be too much per person.

2) The lawyer can then file a class action complaint with the CVM (this will carry more weight than if we each submitted complaints separately).

3) The lawyer can then file a class action lawsuit against both Leandro AND Mercado Bitcoin as our funds were clearly used there without our knowledge or consent (in fact, we have direct quotes from Leandro saying that our coins were not being used at Mercado!!!)

4) After the trial which I have no doubt we would win, the lawyer could then seek to attach a lien to not only Leandro's personal assets but Mercado Bitcoin's assets as well!!

The time to sit in the dark worrying and waiting without any updates or payment from Leandro is over - it is time for us to take action!

Please, if someone  in Brazil can just start the ball rolling by having a consultation with a lawyer, I have no doubt we will have much better chances of recovering our money! For God's sake he is operating the biggest Bitcoin exchange in Brazil with impunity while he ripped people off millions of dollars!!

Ok pessoal, aqui está uma coisa que eu queria fazer a algum tempo, uma organização pública da galera que foi prejudicada no caso, estes são os usuários do fórum que eu tenho quase certeza que investiram no Bitcoinrain. Agora, seria interessante saber quantos investimentos cada um tem e fazemos uma comparação com o número de investimentos que estão sendo pagos todo mês. Porque? Assim nós temos mais informações e nos esforçamos um pouco mais para se unir e encontrar por nós mesmos a transparência que todos querem e Leandro não foi capaz de fornecer. Talvez voces conheçam outros usuários que também investiram no Rain e queiram contribuir informações.

Eu sou CONTRA ação judicial, acredito que uma comunidade pode tomar conta de si mesmo sem ajuda do governo. Conheço gente que deveu bastante dinheiro pra bastante gente por anos, e no final honraram as suas dívidas. Não importam as razões, ninguém pode julgar as razões. No meu círculo de amigos e família tem alguns casos de dívida. Não é uma ação judicial que vai trazer o seu dinheiro de volta, vai sim é atrair sanguessugas que vão sugar o dinheiro de todo mundo.

Espero que vocês entendam que o meu interesse aqui é incentivar a união dos prejudicados para buscar por mais transparência nesse caso. E incentivar mais a razão em vez de emoção. A união em vez da divisão. Eu também tenho dezenas de milhares de dólares para receber.

Ok Guys, here is something i wanted to do since a while ago, a public organization of the people harmed in this case. Here is one list of people that i m almost sure that they had investiments at Bitcoinrain. Now it would be interesting to know how many investiments each one of this guys has and we could compare with the number of investiments that are being paid every month. Why? Because like that we get more information about the case and we can evolve to campaign more to find ourselves the transparency that everyone wants and Leandro wasn´t able to give. Maybe you know some other forum (or not forum) users that also invested at Bitcoinrain and wanna share information to help.

I am AGAINST a lawsuit, i believe that the comunity can take care of themselves without government help. I know people which owed a lot of money to a lot of people for years, and at the end they repaid their debts. Nobody can jugde their reasons to be in debt. In my circle of family and friends there are some cases about debt. It is not a Lawsuit that will bring your money back, instead, it will atract bloodsuckers that will suck everybody´s money off.

I hope you understand that my interest here is to encourage the union of the harmed in order to find more transparency on this case. And encourage the reason instead of the emotion. I have also tens of thousands of dollars to receive.

É bom começar uma nova thread mesmo... esse já está muito poluído.

Talvez fosse bom criar no fórum principal (fora do subforum português) para tentar encontrar os outros participantes, que imagino sejam em sua maioria estrangeiros (visto que poucos brasileiros se identificaram até agora).

E sobre os valores, seria bom achar uma maneira de não expor os participantes, acredito que muitos não vão ficar confortáveis em expor este tipo de informação. Uma sugestão seria ter uma pessoa do grupo que coletasse a informação individualmente e depois apresentasse apenas o total do grupo.

I had everything in one large investment and I haven't received a single Satoshi yet.

It's great to see that people are starting to come forward - hopefully the new threads Mark started will draw even more people in.

I don't know what to think - I have never been one for lawsuits but I feel that Leandro is bringing this on himself. All it would take is a little more transparency, some communication as to the payment plan. Don't forget he himself said he would be releasing FAQs about the situation and then never bothered to do so.

So as of right now, if Leandro doesn't respond to this thread or via email and another lottery goes by without a single report of payment then basically he will have made my decision for me!

I just had an idea for an approach we could take before pursuing any legal action. If you look at the first page of this thread, Leandro states that he partnered with Rodrigo Batista, which is confirmed by this story in Bitcoin Magazine.

Maybe someone can send him an email in Portuguese reminding him that there are many outstanding Mercado Bitcoin debts that his company is liable for (it doesn't matter that they were from Bitcoin Rain - the funds were shared between the two). Victims of Bitcoin Rain have every legal right to go after the assets of Mercado Bitcoin! If Rodrigo or Leandro don't wish to communicate regarding this debt, then the only remaining choice is legal action.
