DIBCOIN was hacked for over 300 million DIBCOIN on November 29, 2017.  Its seems that the incident was isolated towards certain targets of the DIBCOIN executive team like Honson Luma, the former Vice President of Sunshine Capital (SCNP) and DIB Funding and the creator of the cryptocurrency, DIBCOIN. Honson states that he got a phone call on the same day from the hacker who demanded a ransom in which he hung up the phone after he recognized he was talking to an external attacker.  Honson indicated that the hacker was able to steal 238,618,847 DIBC from the company Legacy Wallet – 1FsEA38e3XqGDLvcZ1iaYMFU8tHUQ1xnKM.

BALTIMORE MD, April. 24, 2020 — DIBCOIN (DIBC): The DIBCOIN team would like to share a short update, but a very critical one concerning the mark, DIBCOIN. According to Trademark Trial and Appeal Board, the case was submitted for final decision on April 20, 2020.

It is our understanding the parties’ final briefs and a review of the evidence of record will be used to determine ownership of the DIBCOIN Mark. The case is expected to be decided by a panel of three judges.  Normally, a single judge will review the entire record and then discuss it with the other judges. Then the three judges will render a decision.

Let me take this opportunity to express our appreciation to the holders of Dibcoin for showing so much patience throughout this entire process.  As you already know, we have continued to fight for you from the start and continue to fight for you, even as we now fight at this present time.  We assure you that on your behalf, we will continue to fight for your interests until the end.  We are hopeful.  We are prayerful.

We are confident that we presented a business proposal (offer of services) detailing the specifics of providing  specific amounts of dibcoin etc. and a means of transfer for many months before entering into a general services contract with Sunshine Capital.  As such, being the first to offer services using the Mark is equal to prior use in commerce.  Under the law, the first to use a Mark in commerce owns the Mark.  These offers of service were both written and verbal and were made repeatedly prior to entering into the general services contract.  The evidence of record confirms the same.

Based on these things, we look forward to a favorable opinion from the Tribunal.

Its okay to be pessimistic while we on the other hand are hopeful and confident about the future of DIBCOIN! You think we fought and stood out this long to give up and fail.?.. BALTIMORE MD, July 4, 2020 — DIBCOIN (DIBC): We have waited over three years to hear the decision of the United States Patent and Trademark Office Trial Board and on July 2, 2020 the court made their ruling. The ruling in our opinion was not truly investigated and the DIBCOIN mark was granted to the Petitioner, Dib Funding, Inc.

According to Trademark Trial and Appeal Board,  they indicated that Honson Luma, as an individual, did not explain how he first began to use DIBCOIN in connection with cryptocurrency prior to being “hired” by Sunshine Capital, Inc. Further, the court went on to declare that much of the materials on record where not given further consideration in the proceeding. Therefore, the decision on this proceeding was not truthfully examined and gave precedence over a flawed contract that was breached for non-payment of the services rendered to Sunshine Capital, Inc., and Dib Funding.

The offer of service rendered by Honson Luma to Sunshine Capital, Inc and Dib Funding, Inc. were both written and verbally made repeatedly prior to entering the general services contract.  The evidence of record confirms the same. Somehow, the trial boards miss this evidence that was presented very early in the proceeding.

The holders of Dibcoin has shown so much patience throughout this entire process. But the fight must still continue. Under the law, the first to use a Mark in commerce owns the Mark.  Honson Luma provided a presell document advertising his services to Sunshine Capital well before a contract was signed.  With these evidence on record, we will consider appealing the USPTO Trial and Appeal Board and present the case to a higher court.

Defendant has obtained cancellation of Plaintiff’s “Dibcoin Mark (Reg. No. 5396033)" with weak documentation and testimony alleging that Plaintiff was not first to use the mark in commerce. Defendant alleged that Plaintiff created the Dibcoin mark under contract with Defendant and that Plaintiff failed to explain how he used the mark in commerce prior to Defendant’s alleged use of the mark (TTAB agreed).  Additional evidence was later obtained and submitted into the record, but it was deemed late and not considered.  That evidence makes it now abundantly apparent that Plaintiff was the first to use the Dibcoin Mark in commerce and is therefore the owner of the Dibcoin Mark.

With coronavirus hitting us – economically, physically, mentally, socially, politically and in other ways we don’t even yet know. The DIBCOIN team had to demonstrate a high degree of flexibility, despite many setbacks. Like all companies in the crypto industry, the constantly changing of information, exchange hacks, regulations, opportunities and financial limits continue to pose challenges to DIBCOIN. However, in tough times, we rise to the challenges and find new paths forward.

As you might not be aware that livecoin.net was hacked and this took place over the night of Dec. 23-24. The exchange posted on its site Christmas Eve that the service was subject to a “carefully planned attack” that it suggested may have been planned “over the last few months.”

We believe to be over 500 million dibcoins held/halted on livecoin exchange prior to their hack.  

All DIBCOINS held on Omni Wallet were swapped for the new DIBCOINv2 in 2017. So, there is nothing to worry about for coins held on omniwallet. However, for those who held DIBCOINS on Livecoin Exchange, unfortunately there is no current remedy. Because livecoin as it appears, will not be in business again. We are exploring ideas to make all investors whole again.  

We want to continue our relationship with our investors and the DIBCOIN Community even in times of uncertainty. The focus was primarily, but not exclusively, on providing shareholders value from the beginning.
