Whoever mines the block which ends up containing your transaction will get its fee.

I'd say it's still relevant so long as they haven't satisfied all orders. BFL shouldn't have continued to sell pre-orders if they knew delivery would be extremely delayed.

Definitely still relevant. Look at the community delivery list http://bfl.ptz.ro/

The latest received order, as submitted by the community, was ordered on 2012/09/18
Comparing with the current date being 2013/07/02, That's 287 days difference.

So, while BFL aren't a scam.. they are blatantly false advertising.
With their website claiming that an asic will be delivered within 2 months of ordering. When in-fact it will take 9 Months (based on the historical data available)
