Mt. Gox is based out of Japan. Makes me wonder why so many people keep yaking on about FBI, CIA, "Felony charges"... It is very amusing to see.

It was more rhetorical than anything else. 

There is significant case law in the USA which permits law enforcement to go after people based on where the website is accessible, rather than where the server is located.
