yes you are just making a transaction, smart contracts will be created at the end of the ico, it's because the number of tokens one gets will be determined after ico concludes.

Yeah, additionally, each user has their own unique wallet addresses where they are depositing so everyone is depositing to different addresses. You can see your addresses by logging into your ICO account.
