 They are violating Amazon's terms of service when they do so, and CAN be shut down without notice or refund over that practice.

Dunno if that is exactly in the ToS...but even if it wasn't....to mine Monero right now is worthless with a GPU PROPER 480/580 AMD rig....what could Amazon possibly offer that would provide that sort of hash power?...and even you could mix and match the specs, you would need to be waaaaaay above what a rig like that can offer for it to be worth your while...

If you have any stats, or a bit more info on how they are running this on amazon, and more importantly, are they making any profit?

 Amazon specifically prohibits the use of AWS for cryptocoin mining.
 I'm not sure if Azure or Google's cloud service does so specifically.

If they do that then at a loss. There's no way in hell to mine anything on AWS and stay profitable. This includes the GPU instances. I've tested all of them. Same goes for Azure.

As for your pool choice why not go with one of the smaller pools? Decentralization is important!
