You may run into trademark issues using such an obvious derivative of e-bay.
Have you checked out the existing BTC auction sites/classifieds?

I just setup an ebay like site(BitOffer.com). Solving the problems of, low to no fee trading, and making a profit, well, that is where it gets difficult. (1.) The BTC currency needs to stabilize before a fully BTC driven marketplace can take shape. (2.) People will not buy unless they feel safe, and it takes time to build up a good reputation. Maybe a BBB for Bitcoin needs to be built. An escrow service is needed for larger ticket items. I have seen an id verification process on stores work to limit fraud.

It would be a non-profit so no you would not shares and because of that fact I highly doubt I am going to get a cease and assist from ebay or for that matter any other company that has the word bay in it (The Bay, The Pirate Bay). Is anyone on board with this idea? Would you guys actually use it?

You would have better luck developing something and having a donation link on your site, than asking for donations for a hypothetical project as a newbie...

I can theoretically see myself using this hypothetical site. Make it professional and put in legit effort and people will respond. You do have to be careful with URLs. For example, pretty much any site with the word "face" in it can expect a cease and desist from Facebook™ . You can win in court, but courts don't take bitcoins.

I would suggest checking out what your "competition" is, for example, http://www.biddingpond.com/. Try signing up on the sites (there are a few) and see what things people are using. Seems like the best idea I've seen for an auction site was something really different, they only offered one item per day or something like that. Focus on usability and design. Most of the auction sites I've seen really look crappy and they aren't fantastic to use. Something that looks and acts legit could be pretty awesome. Keeping with the idea of non-profit is great (at least in my opinion.) I'm assuming this means no listing fees and such? One very important thing, I think, is an easy-to-use listing editor. Perhaps allowing people to open their own "stores" and putting all their items into one storefront might make it seem unique and fun. People can customize their storefronts and try and make a profit from it. Perhaps some type of API where people could run/show their auctions on their own page would be pretty great as well. Not sure any of these suggestions help, but hopefully!
