Does Bittrex.com has Legally & Morally Rights to Plunder my Airdropped $IGNIS?

   - Before this article I was hesitated of whether to post it publicly and just let it go, but recalling what I suffered for over 60 days from Bittrex.com with my Requested Issue, I believe I have every Rights and Obligations to tell out my Story, not only to dispute the final Judgements that Bittrex.com had done, but also to demonstrate a valuable Experiences other newbees could learn from that I learned by using my hard-earned money in real world.


    I was new to Cryptocurrency world since the end of August, 2017. Suffered from the banning policies of China, I was requested to move all my Tokens out from Chinese Exchange Sites to those Exchanges abroad. After comparing with Poloniex (never reply to my KYC request), Kraken (always hard to access on-time), Bitfinex (too complicated interface) and Bittrex, I finally decided to stick to Bittrex as the main trading depot I would stay - and this is how this story begins.

    The latest Chinese Exchange Site that I stayed is BTC38.com , it was kept opening until the last day of October 31, 2017.  I thought it might be very difficult for me to deposit Cash any more after these Chinese Sites were shut down at that time, so I grasped the last moment to buy some valuable Tokens that I wish to hold for a long time : among them I bought 236,660 NXT tokens. And this story is also related to my NXT tokens since that time.

    Due to a newbee's mistakenly understandings : I wrongly believed that Transferring from BTC38.com to Bittrex.com of my NXT tokens would be as easily as what I did with BTC and ETH - simply filled the Wallet Address and then withdraw them completely. I was also misguided at that time by BTC38.com when I tried to fill NXT wallet address of Bittrex : that they had this "Remarks" which I thought it was NXT's MEMO/MESSAGE address, while later that is proved it was only a remark to distinguish different wallet addresses instead of the righteous NXT's MEMO/MESSAGE.

    So in the afternoon of October 31, 2017 - I tried directly withdrawn 236,653 NXT tokens from BTC38.com to Bittrex.com : it was carried into NXT blocks at Height 1551615, with Transaction #: 5254309822673373234


    Soon I realized BTC38.com withdrawn NXT tokens With NO MEMO/MESSAGE to be filled automaticly : then after hundreds of confirmations then I was panicly thought it might have been lost - it was not a small amounts of money to me, with that panic feelings I impulsely rushed to Chinese Chatting Groups to seek helps : then most people told me to write Support ticket to Bittrex.com , just before I was about to write Ticket - there was a Guy suddenly said "if you don't want these NXT tokens in this case, I will claim for them!"

    It was like a Thunder shot to me and then I realized with the TxID that everybody can see that by NXT block-browser, then everyone can Claim these NXT tokens to be his/her. This would be a tremendous threat and risks to me for losing these NXT tokens to a Thief/Scammer permanently, then I rushed myself to delete everything that I left and tring an emergency ticket to Bittrex.com support platform at that time.

    Here is the Processes that I encountered with Bittrex.com supports:

    (1) October 31, 2017 16:57 : Claiming the problem "Request #374135  Please help for my NXT coin deposit urgently!"
    (2) October 31, 2017 16:58 : Bittrex auto-reply telling me to confirm by replying ticket again.
    (3) October 31, 2017 17:00 : Reply again to confirm.
    (4) October 31, 2017 18:31 : Me providing more information
    (5) October 31, 2017 18:35 : Me providing more information
    (6) October 31, 2017 21:58 : Reply from Awais "Thanks for providing the requested information. This ticket has been escalated for a manual credit and will be processed soon. There is no need to reply at this time."

    With the first Human-Reply from Bittrex at the same time, I was very comforted due to the fast response I thought it was to be. Just never to imagine this could finally turning to be a Long Nightmare for me. Here is the continuous responses:

    (7) October 31, 2017 23:36 : Me to submit screencopies, Transaction Copies, Processes Explanations etc. for avoding Scammers mentioned above.
    (Cool November 01, 2017 19:17 : More evidences that I tried a whole night to collect.
    (9) November 09, 2017 16:50 : Reminder.
    (10) November 11, 2017 22:24 : the 2nd. Reply from Anne (after then Anne deleted herself then turned into Wilson), saying "I am having difficulty verifying you are the owner of this deposit.  Please submit the following.
- please provide a current selfie holding your id and a piece of paper with the date
- provide a screen shot of each of the deposits clearly showing the time/date/txid/ and amount"

    I believe this is necessary and trust Bittrex.com honesty to verify the Ownership of these Tokens of mine - even though I already done the KYC into Advanced Account long before this issue. I submitted again the requested data of myself to them.

     (11) November 11, 2017 23:33 : Reply to submit the Data they requested.
     (12) November 15, 2017 22:21 : Reminder.
     (13) November 19, 2017 23:54 : Reminder.
     (14) November 20, 2017 23:00 : Reminder.
     (15) November 22, 2017 22:23 : Reminder.
     (16) November 27, 2017 22:16 : Reminder.
     (17) November 27, 2017 22:54 : Reminder.
     (18) November 30, 2017 16:19 : Reminder.

     From Nov. 11 until December 07, there are whole 26 days I reminded them by updating the tickets (Reminds by explaining every time and asking them to fast the procedure up). I refrain myself totally to stick to this Ticket only as I read by Twitter.com that they threat people if we open more tickets they will push the old ones behind, but I dare not to stay without Reminder as I saw someone stayed with over "the last updates 2 months ago" but never solved. All I can do is only to write Reminders, sending Twitters to Bittrex / Richiela / Rami / Jyap - except they never replied. I sent like hundreds of Twitters and they were just like a sand into the ocean, never being noticed and replied. Until when this Richiela replied one time to me:

     "Stop posting your ticket online, you are the one causing problems to other people".

     You must know how offensive and how depressed when I saw this reply after waited over 30 days then, but you also know at that time you are feeling someone is clutching your neck so what you can do is only to hold yourself back and keep playing nice / patience and begging to them, overall these NXT tokens costed a big amounts of mine by hard workings. So I was threatened to stop tweeting and only have to update the Tickets.

      (28) December 08, 2017 00:27 : at the day of 39th., I finally got another reply from Wilson (at this time Anne turned into Wilson completely), still not a solution, but again a request to verify

     "For further confirmation of transaction please make a deposit again using a message.
      You must deposit from NXT-ATYR-E5GH-D3PJ-988PG sending address."

      (29) December 08, 2017 23:43 : OK whatever you need, at least it pushed forward and it has still 20 days left for me to get NXT tokens back before the $IGNIS airdrop. So I urgently go back to BTC38.com for asking them to help me deposit again another batch of NXT of using their NXT wallet.

      (30) December 11, 2017 22:38 : Due to the weekend, at this Monday BTC38.com helped to remit again 2 times of NXT tokens :

            I hope to have a resolution solution for your issue today.

      I almost jumped from my chair and danced with myself, this was to be a great news for me already. After 52 days waiting Bittrex finally told me they will solve this issue, and it was BEFORE the $IGNIS airdrop.

       I was getting worried that Bittrex may intentionally delay the manually credit Before the $IGNIS airdrop, then just before Christmas even. They replied:

        (42) December 23, 2017 01:27 : "Thank you for contacting us regarding the claimed missing deposit.  We understand that you claim ownership of funds sent in NXT transaction 5254309822673373234.  These funds have also been claimed by another user."

       Even until now I was not sure this dispute is a True or a False one - as after my NXT tokens were sent back to me later, that "another user" have yet received NO punishment or any response from Bittrex.com  But at least at that moment, I knew I was not able to catch up the NXT airdrop just by what they gave me false hopes and then lethal attacks by words.

       Bittrex told me they do not "resolve disputes regarding ownership of funds.  Instead, Bittrex offers to put the parties to the dispute in contact with one another so that they can resolve the dispute themselves"   How ridiculous it is - when someone told you to be Reasonable with a Thief/Scammer who intentionally to steal your money? And Bittrex said only the other user to sign an agreement with me, saying he does not want these Tokens any more then I could be released. Isn't that funny of what they told you to ask for Mercy from a Thief/Scammer?

       I did not sleep for a whole night at that day just before Christmas Eve : then I wrote a long article on Chinese Twitter (Weibo.com), trying to record my sufferings and encounted problems with Bittrex.com - then I attracted the attentions of the Owner of BTC38.com : then he told me he will try to communicate with Bittrex.com, asking them to refund fully the NXT tokens to BTC38.com - then he will give back these tokens to where it was originally sent out.

       Then I suddenly realized: I should be doing so a lot of earlier, but I put too much Trustfulness to Bittrex.com - waited almost 60 days and then received nothing meaningful, at last it was only the other People who can help me in Real sense, but not trying to Intentionally/Passively delayed me 60 days and then solve nothing.

        (46) December 23, 2017 05:02 : I wrote a whole night not only by Ticket, but also Twitter, Bitcointalk.org and Reddit - I was prepared for losing these NXT tokens when Bittrex told me to beg mercy from Thief/Scammer. Then this "Julian Yap " replied to my ticket and claimed
     "Please refrain from emailing, tweeting your ticket details in public. Posting your details publicly has prolonged the process. Please stick to the ticket process."

        (47) December 23, 2017 05:26 : I still is doing nice to talk patiently and politely to them, trying to reason and argue with their intentions to tell me for "asking mercy from Thief/Scammer".

        (50) December 23, 2017 23:38 : Trying to reason and remind again.

       Even though after the $IGNIS airdrop, I still writting updates to them, as at that time I was reminded and inspired by BTC38.com - that I should ask them to refund my NXT tokens fully. So I still keep trying to remind them, even though they still playing silence like what they did over the 2 months.

        (54) December 31, 2017 00:34 : Finally, Wilson replied "The sending exchange has reached out to us with the proper account the coins belong to and that account information indeed matches your account.
              Your NXT coins have been credited."

       I finally got the NXT tokens back - but not Refund, still Manually credit into my Bittrex account. Which they should done this manually credit long before 60 days ago.


        (55) January 01, 2018 12:37 : I did not give up on asking my $IGNIS - the reason is, when the Airdrop happens, my NXT tokens were laying on Bittrex NXT wallet without anyone can move them; so $IGNIS correspondingly had been airdropped to their wallet by these NXT tokens of mine. So logically and legally, these IGNIS should also belonging to me.

        (56) January 04, 2018 20:08 : Wilson replied
            "We apologize that your deposit was not credited and part of the snapshot.  
             The deposit instructions are clear that a message must be included.  
             If you deposited without the required message, we cannot provide airdropped funds to your account."

        (57) January 04, 2018 23:21 : Trying the last time to reason with them, as these IGNIS should be mine.

        (58) January 05, 2018 03:08 : last Reply from Wilson - and after this they closed the Ticket permanently:
         "I have to reiterate our position on your case.  I was able to credit your coins but however our deposit instructions are clear that a message must be included.  
          Because you have deposited without the required message, we cannot provide airdropped funds to your account.  I apologize this is not possible.
          There is nothing further to resolve and this ticket will remain solved."


So at last, they refused to give these IGNIS tokens to me - but Keeping them to Bittrex.com themselves : their reason is I can not get Airdrop because I did not fill the MEMO/MESSAGE for my NXT deposit - but they never care it is them who made me waited 60 days without timely resolution. If I did not fill the MEMO/MESSAGE to cause the delay for deposit, then who caused the delay for manually deposit even it was 60 days ago?

I understand the problem was initially started by me, but can't say when I can not get the Airdropped IGNIS, there is no blaming to others. Now I still have questions even it is turning into Feburary, 2018 already:

(A) Why Bittrex.com never punish, criticize the one who fake to be the owner of these NXT tokens? If he/she is a real person?
(B) And if Bittrex.com will NOT give $IGNIS tokens by these NXT of mine back to me - then who will keep them? Richiela / Julian Yap / Rami Kawach or Bill Shihara?


And at last, I just want to say : by LEGALLY, MORALLY and LOGICALLY, these $IGNIS should NOT belong to the Exchange Site - but only belonging to the Community Members, who originally has their NXT tokens righteously.

I still don't understand how these tokens are being claimed, because the process is usually to sign a message, It doesn't make much sense to make it with TXID as everyone could claim it. With that being sad, this issue is known within the community whenever an airdrop/hardfork occurs. I can't tell you for sure but logically, It's from their right to take these tokens as they control the private keys are theirs and not yours (another reason on why you should control PK at all times). If they ever decide to support an airdrop, It becomes your right to receive tokens otherwise, It's theirs. As for the second questions, as a business, these tokens are not taken by a single individual, It belongs to the exchange site and then It's up to them on how they deal with these things.

Well I agree partial of the points, but the key problem is : when this problem happened I still have a long time to wait until the airdrop happens (almost 60 days), it is how Bittrex handled the issue and delayed so many days until the last moment to tell me there is a dispute - if they said it so much earlier, I could take other responses to ask the original sender-exchange to prove for me, but without believing and waiting them too much in the last moment.

So when they said they will not give me these IGNIS even though they could..... I felt really unfair if this problem eventually goes only to blame me for took so long even to solve just AFTER the airdrop - is that only a coincidence?

And for the 2nd. question: If taken IGNIS as the son of NXT, then these IGNIS were borned by the NXT tokens that now already proved to be mine - so these "sons" should also belonging to the original owner of these NXT tokens. It is now Bittrex refused to give back by judging its originations, but only keeping by themselves.

If Bittrex does not give back to me, I would rather these IGNIS to be contributed to the NXT community for R&D works, but not keeping to themselves - it's just like giving themselves free money. In which I felt at least I won't wish to do that since they caused the sufferings to me for over 2 months by always keeping silence to make you wait all-the-time.

UPDATES:

I submitted another new ticket after 30 days of waiting to see my IGNIS on Bittrex - as yesterday finally Bittrex had released the IGNIS wallet, so I saw there was NO balance of my IGNIS on it.

So I asked them with the similar contents as the topic, here that I got a positive reply as following

"We are evaluating your request to be credited ignis based on the coins being disputed.  No users have been credited at this time but we expect to credit them shortly.  Should we determine that you are eligible the ignis will appear in your account at that time."


Looks like they are considering to change their ideas of how to deal with my IGNIS, sounds like a promising and a good one. I will keep on updates and notice to see in near future and look forward of them to keep the promise. Finger crossed!

Damn, you've went through a lot. 200k+ NXT is no small amount of money to lose, and if you did lose it just because another person claimed that it was theirs than it would have been brutal. I don't know why they even allow someone to claim that a tx is theirs just by providing the txid. That is completely ridiculous. And for 2 people to sort out in private is obviously not a good idea as well, because one party has nothing to lose.

I really do hope that you get your ignis and since they held your nxt at the time ofd the airdrop, they technically do have the Ignis.

I doubt they have the legal requirement to do so but morally, they are obliged. I'm no lawyer, but you deposited NXT and they can claim that they never promised anything to do with ignis.

On the bright side, you've recovered around $60k worth of NXT tokens that you could have otherwise have lost. Don't take it too harshly on yourself even if bittrex doesn't follow up with you, but keep trying.

I checked CoinMarketCap yesterday and IGNIS was not there for Bittrex but now it is so at this point, I believe they have no choice but credit what is yours. Read this to make sure you're eligible to receive them.

Thanks a lot for understanding man, I already got my NXT tokens back by the help from the original sender-exchange-site, at least by this point Bittrex does not break his promise to make his own user suffered.

I just not sure why they do not wish to send a clear punishment to the other guy who wanted to steal those NXT - at least now it is fully proved that guy is behaving totally as a scammer.

Also I won't give up on trying to convince Bittrex of those IGNIS should also belong to mine - they have given positive potentials but still need time to prove that.

I really do hope that you get your ignis and since they held your nxt at the time ofd the airdrop, they technically do have the Ignis.

I doubt they have the legal requirement to do so but morally, they are obliged. I'm no lawyer, but you deposited NXT and they can claim that they never promised anything to do with ignis.

On the bright side, you've recovered around $60k worth of NXT tokens that you could have otherwise have lost. Don't take it too harshly on yourself even if bittrex doesn't follow up with you, but keep trying.
Thanks a lot for understanding man, I already got my NXT tokens back by the help from the original sender-exchange-site, at least by this point Bittrex does not break his promise to make his own user suffered.

I just not sure why they do not wish to send a clear punishment to the other guy who wanted to steal those NXT - at least now it is fully proved that guy is behaving totally as a scammer.

Also I won't give up on trying to convince Bittrex of those IGNIS should also belong to mine - they have given positive potentials but still need time to prove that.

Well to be fair, what would bittrex have punished the guy who was claiming the deposit was his with? It's not like the hacker is dumb and had registered with his personal details, he probably used fake details or just bought a throwaway account.

There isn't really anyone else that could help you recover your Ignis, other than bittrex itself.

And seeing from their level of competency of their support, the chances are slim at least imo. Hope for the best and expect the worst as they always say. Don't expect your Ignis back, anything back is an added bonus.

Yes at least there is hope again without totally rejections. In the beginning of January Bittrex only simply rejected totally to me as said "I could credit you but since you missed MEMO during deposit, I would not credit". So it is now totally their call to my issue already. Hope for the best..

I checked CoinMarketCap yesterday and IGNIS was not there for Bittrex but now it is so at this point, I believe they have no choice but credit what is yours. Read this to make sure you're eligible to receive them.
IGNIS was already being distributed in Bittrex and about to trade now. Today I received an reply from Bittrex's support, with a closed status to my ticket as well. Unfortunately Bittrex is again playing a similar game here:

This is purely a standard answer - to say that since my account has NO NXT tokens during the airdrop, then No IGNIS will be in my account.

Just ignored my request and my question at all, just a standard answer. Disappointed again as before, still keep posting and updating with the issue, funny thing is firstly this ticket was assigned to Richie Lai obviously, now it is just shifted to another personnel who does not seem to understand the issue pretty well.

I still don't understand how these tokens are being claimed, because the process is usually to sign a message, It doesn't make much sense to make it with TXID as everyone could claim it. With that being sad, this issue is known within the community whenever an airdrop/hardfork occurs. I can't tell you for sure but logically, It's from their right to take these tokens as they control the private keys are theirs and not yours (another reason on why you should control PK at all times). If they ever decide to support an airdrop, It becomes your right to receive tokens otherwise, It's theirs. As for the second questions, as a business, these tokens are not taken by a single individual, It belongs to the exchange site and then It's up to them on how they deal with these things.
And for the 2nd. question: If taken IGNIS as the son of NXT, then these IGNIS were borned by the NXT tokens that now already proved to be mine - so these "sons" should also belonging to the original owner of these NXT tokens. It is now Bittrex refused to give back by judging its originations, but only keeping by themselves.

If Bittrex does not give back to me, I would rather these IGNIS to be contributed to the NXT community for R&D works, but not keeping to themselves - it's just like giving themselves free money. In which I felt at least I won't wish to do that since they caused the sufferings to me for over 2 months by always keeping silence to make you wait all-the-time.

The only recourse for you to get your coins is to contact one of the American regulators (Bittrex is located in the USA). I think it's FINCEN (Financial Crimes Enforcement Network)you need. You should be able to find their details online.

But waited 1 month later, still no reply and no luck...... Have no idea why this would take so long to solve, the ticket remains open until now.
