巴比特联系到了万向区块链董事长肖风先生，他认为ICO绝对需要监管！监管对行业创新发展绝对是好事！目前的ICO就算是靠谱的ICO，也存在两个涉嫌违反法律的节点：1，公开募集；2，上市交易；

上市交易环节应该学习现在的IPO流程，有三年经营记录，说明你的商业模式是可行的，之后再上市交易。至于是否盈利，则可以不予考虑。毕竟，香港主板上市不需要盈利，现在甚至生物科技公司都不需要营业收入，也可以主板上市了。建议募集约束为私募；交易按照IPO模式，在主链上线三年后上市。这样就基本符合现在的私募规则。其实发股份私募融资与发token私募融资，都是一家创业公司在商业模式还没有推出前，靠“白皮书”融资，发给别人一个“凭证”而已。
