They are "fixed" to EU servers???

Characters yes, but you can also play in NA but you need to make new character and can't transfer anything there.

If I bought this account isn't there a chance it might get banned? I'm unaware how it works with diablo.

No, you can't be banned for this. Just don't go tell them that you bought acc

you could get banned but if you do you just have to send in personal information and say you were hacked or key logged, they usually notice the sudden change in IP's when playing and then flag the account for further investigation!
