transactions with outputs under 5430 satoshis are banned for this exact reason.

It is pitch black. You are likely to be eaten by a grue.

By banned you mean, even if a miner decided to include it in a block it wouldn't go through?
By "banned", he means most miners outright refuse to include these transactions in a block, and most nodes won't even relay them. Key word here being "most". There is absolutely nothing prohibiting a miner from including these transactions in a valid block if they choose to do so.
