Cointerra why are you not honoring your hashrate guarantee for Early January customers?

I emailed support and received this response:

Quote
Our legal team has determined that the 30 day late delivery agreement does not kick in until March 2nd. Sorry, I know that this is such a hassle.

I think everyone accepts that there were delays and you might be late delivering, but I'd imagine this guarantee caused a lot of people who would not have ordered in the first place to order your equipment.  Please explain how March 2nd can possibly work as a guarantee date for "Early January" orders.

I tried to ask the same question in your forums but my post was not "approved".

If you read the sales agreement I believe it specifies the remedy in the case of late delivery beyond 30-days (plus time for excusable delays):

You may cancel your order for a refund (USD) - given that cointerrra are already allowing that ... what is your beef?

So, the hashrate guarantee was what, then?  Just a smokescreen?   There are laws against false advertising.

I'll gladly take back the bitcoins I paid for the miner (back when BTC was $150)

If orders were marked as January batch then I could see March as a month late, but since orders where marked "Early January" then once its past February 15 its a month late which it is now. You would think Cointerra would do whatever they could to make customers happy so they would purchase again, not make them mad and have them go elsewhere.

I don't understand how these companies get away with it. It is like they are above the law or something.

They can get away with it because people keep preordering with money upfront. If people stop preordering then we wouldn't have to worry about it.

I just received my Early Jan miner yesterday. 7 1/2 weeks late as Jan 15th is the cut off for Early January. After a day of running I'm averaging about 1.6 TH/s.

I contacted customer support and asked when they would be sending more equipment to complete my "a minimum of 2 TH/s" order. Will post the response.
