Simple fact of the matter is that this is the most divergent chain from Bitcoin to date, at best some structure and core code and the fundamental idea lives on in solid coin.  There are lots of changes to this chain that would require decent amounts of rework so at what point do you still call it "copying"

At what point? Never. He copied Bitcoin to start SolidCoin. Until he throws out 100% of the Bitcoin source code and starts from scratch, he copied Bitcoin.
