I think someone needs to post their terms of service and then have an attorney review it to see what type of action is possible. I don't know how you would even go about trying to recover btc in court since it is not yet recognized as currency. At best i think you would be trying to recover USD or another fiat, but then you face trying to establish the correct dollar amount per BTC (given the value is always fluctuating).  This is all under the assumption that they even have money to go after.
