What are the legal means to make a lawsuit to assert my right to claim because I have not sent my document in time and it will surely refuse when I am the victim of mtgox ....
It has been hard since 2014 and it refuses people for 10 days of delays knowing that I never knew any information by phone and that I discovered the email address of contact 6 days ago ....
In short I am lost, I lost a lot of money in mtgox because I was a victim of the security breach of their site and today I am still victim of a great lack of communication mtgox ... what to do please?

You just missed the last day for filing your claim and I don't think you can do anything legally about that as they have given you appropriate amount of time (which I believe it started in August) in order for you to respond and comply for your own rehabilitation claim. The only fight you can have legally is when they have not communicated or notify you in any way about filing your claim which is highly unlikely as you yourself is an internet user and maybe even once you have seen an announcement about it. Also the only chance you have is if Mt. Gox personally extended their deadline for members who have forgotten to submit their claim.

As Theb says, you actually missed the deadline for filing proof of claims (yesterday), but it appears the form itself is still online.

But I'm pretty sure if you can prove you were never informed (though you really should have kept updated via the website), you'd still be considered. Just contact the trustee's office.

Get yourself on the update list... bookmark the site and check back. You won't find more help here, I'm afraid.

Far as I know, the trustee has responded to certain/some press comments, so definitely seems to be available for contact. I don't have any dealings with Mt Gox myself, but from communications made public by other claimants, it appears there are ways to get in touch. Have you tried looking at the recent documents posted publicly on the website? So it looks like the trustee has extended the deadline for rehabilitation claims. Guess OP wasn't the only one too late to file documentations. Wonder if he got any responses back.

New date is Boxing Day 26th Dec 2018. Wouldn't wait til Christmas though. Also, new date isn't a guarantee, but a date that trustee will "will make efforts to request the court to accept".

I don't think that OP is one of the ones who can be considered in the extentsion:

However, if filings are delayed for reasons not attributable to creditors, proofs of
rehabilitation claims filed after the deadline (i.e., October 22, 2018) may be acceptable.

Since OP didn't even try to submit his claim to Mt. Gox and he is considered to be the delay of his own claim he is not counted to the extension. But I don't think there is no harm in trying since there is still a lot of chaos going with this claims being delayed, he might even go unnoticed with this one.

I'm not sure I agree. The original document actually does say that the trustee will argue a case to the judge forany claims filed after the original deadline... especially considering the global distribution of potential claimants. OP himself said two things that already mean he received the message far too late: there was no phone contact to him/her, neither was informed of anything, and only discovered on his own less than a week before the original deadline.

Also says English is poor, so all this adds up. If Mt Gox can show proof they sent contact, maybe. I wouldn't say OP has no cause.
