I think the case here is that, those ICO is closing their projects without even paying for the bounty hunters. In my point of view, a scam means: there is a work or money involved but not compensated properly. That might be the case.

On the other hand, they can't also be forced to pay those hunters because they failed. Most projects that conduct marketing like bounties, doesn't really have a budget for it that's why they will pay you with their tokens if they become successful.

They have allocated budget for some other types of marketing such as in social media's or sponsoring some youtube videos. They will not be advertised if they will not pay upfront. That's the other side of bounties, you won't get paid if the project failed.
