Okay so google is not being nice to me. What does everyone think about cheaper in bitcoins selling passion party stuff and/or Adult DVD stuff? The issue is that I can't find anything in the legal system(penal code) (using google) about selling 18+ stuff.. can someone point me in the correct direction? Normally a credit card proves that you are 18+ but how should we go about this with bitcoins? (Lets keep it within USA legality terms, unless you specifically state that you are talking about out of USA legal issues)

It's impossible to prove for sure that anyone is 18+ using Bitcoins... so if it's illegal to sell adult items to minors, I don't think your site would be legal. :\

Agreement of T&C stating and acknoledging your over 18 is generally enough. Unless you have reason to believe they are not it may be different? (lol) No site asks for proof of age beyond that unless its financial.

Have you ever proved your age to watch porn, post-1996 that is? The way I see it, it's btc. If some parent finds some porn under their 14-year-old's mattress and yells at him till he spills the beans and says he got it from you...well, that's difficult to prosecute and prove, isn't it? What about a simple gateway screen for those items? It seems to cover all those *tube sites' asses.

Put a entry page asking if the visitor is over 18, if he answers yes and is lying he's the liable one. Like the above poster said that covers all the adult sites and it works for them. BTW, the credit card to prove that you are over 18 is an e-whore scheme to take clueless horny dudes to signup in to sites using their affiliate links and adult websites use the same scheme, ofcourse, saying it's only for age verification and it's an unpaid trial, altho they will charge them the same way most of the time.

I actually don't think there are regulations about accessing such material on the internet by minors in the US. There have been attempts at such regulation, but they were struck down on constitutional free speech grounds. There are restrictions in various places on selling it to minors in a physical store, but as far as I know, not on the internet. But, IANAL. Maybe you should consider using a .xxx domain. That would at least make it trivial for parents to block (although, I think when I checked they were charging higher prices for those domain names…go figure).

Because of banking regulations the only way to get the transactions processed was to mislabel them. None of that means gambling is illegal, it means it's impossible to legally do it using dollars. This is suddenly a relevant distinction. Or maybe it is illegal and someone can point me to the relevant writings.

I agree with that. Its simple. If you have 18+ rated content on the shop. or at website. You just have to make "Terms and Condition" "Legal Notice" Where you put that users declare that they are 18 of age, every purchase etc viewing the site bla bla bla, and if somone buys from you , "hey ... i had terms and condition I cannot be every child on earth parents, its their job, I cant be responsible for their actions. And stick with it, everything should be fine.And just befoure purchase once again "accept terms and condition" most every e-commerce application has something like that.

Well sure it's easier, but it's a big difference for people who care about the law, which I get the impression is still a lot of people. It is illegal for me to run a poker game in my bar. Why would it be legal on my website? There are state laws, most ambiguous. But there are many things that are illegal in your bar that I can do at home or in another place. Few states have a complete ban on betting, and even then it's usually running not participating and the running happens in a different state.
