Sa totoo lang wala naman talagang tax yung cryptocurrencies kaso hindi rin natin ito magagamit kung hindi ito mapalitan ng fiat. Pero hindi rin totoong hindi tayo nakakapagbayad ng tax kasi kapag nagwiwithdraw tayo sa coinsph may tax na kasi yan kasi ang laki ng bawas every convert tapos cashout pa natin tax na naman.

Kung dito satin sa Pinas walang direct tax sa cryptocurrency pero hindi natin magagamit ang ating cryptocurrency sa pagbili ng ating mga kinakailangan. Pero sa pamamagitan ng coins.ph o iba pang kagaya nito ay parang nakakabayad narin tayo ng tax, kasi hindi yan sila papayagan na gumawa ng ganyan kung di sila magbigay ng tax.

They can only do that if they are authorized by the BIR, but there's a rules and regulations that will be followed, it would be called as a withholding tax where they are the withholding agent that are authorize to deduct and will just remit the tax collected to the BIR, that's different from the income tax that they are required to remit as well.

To make it simple, it's just like you are an employee in a company and the HR or the payroll manager deducts tax from you and they will be the one to remit to the BIR.

That's correct, but that general rules would be best applied if we also know how to properly compute our tax earning.
Personally I am not paying tax because there's no one telling me to pay, kung baga para di compulsory ang nangyayari.

Maybe the best thing to do now just wait for the letter from BIR like what IRS did in the US so we can file a proper tax payment on our income.
For sure all of us here has a coins.ph account, but once they'll start sending, I believe we will also start to use a platform where we can hide real income.

@Bttzed03 ano sa palagay mo itong scenario na ito ay mangyayari asa atin na padadalhan tayo ng sulat galing BIR, retroactive ba ito? I mean yong past income mo sa crypto ay papatawan na nila ng buwis or it is the future income starting from receiving the notice. Kung retroactive ay maraming magkakaroon ng problema dahil may iilan sa atin dito ang nakakatanggap na ng more than a million at wala ng pera sa kasalukuyan kaya malabo na makapagbayad pa ng tax.

I don't think it's gonna be retroactive, just like me, I earn a lot in 2017 but I don't have that money right now, how will the BIR will collect from me?
When there is a rules regarding tax on crypto, the counting would start when the law is publish, what he was referring is the general rule only, our income from bounty IMO would not be classified as income but rather gifts, depending on how you declare it, but it's hard for the BIR to verify the source as that time most of the projects are not registered, so they will just reply on our information and it's up to us on how we will declare it.

Technically, undeclared income ang kalalabasan nyan. Nasa batas na lahat ng klase ng income na natanggap mo ay kailangan ilagay sa iyong income tax declaration. Kapag nasilip ng BIR yan, maari kang patawan ng income tax (kung lumampas ka sa 250K for example) plus penalty.

The absence of a specific provision does not excuse us from declaring our income kahit galing pa yan sa crypto.

Kagaya ng nabanggit ko na dati na hanggat walang batas na nagsasabing tax-exempt ang income sa crypto, ibig sabihin subject to tax pa din ito base sa NIRC.

Nobody should be telling us or compel us to file because the law itself tells us to do so.

Yes, we can wait for the specific provision kung meron man ilalabas but we also run the risk of paying for huge penalties for those undeclared incomes.

Just wondering, ang cryptocurrencies ba ay may tax? Ayon sa Taxation Law ng Pinas, kapag kasi ang isang freelancer ay lumagpas ang kinita sa PHP250,000 sa loob ng isang taon ay may kaukulan na itong tax.

This case might be sensitive pero matanong ko lang, wala pa bang kumatok sa mga bahay sa inyo ayon sa usaping ito? I mean tax evasion.

Pero kapag nakakuha ka ng bitcoin via campaign signatures, payment services, or any services rendered, hindi po siya mabibigyan ng kahit anong tax.

Sa totoo lang, kapag naging taxable ang bitcoin, baka mas lalong mabawasan ang mga taong gumagamit nito dahil flexible ito at mahalaga ang kagagamitan nito sa market as an investment opportunity, compared sa fiat.
I second what @mirakal have said, please share the link or whatever sources of what you have said kasi napakalaking bagay ito para sa atin na nandito sa cryptosphere. Oo nga, kung meron mang batas na nagsasabing hindi taxable paki-site naman dito or kung anong article man yung pinagbasehan mo. Alam ko there was a bill before tungkol sa cryptocurrencies pero mukhang hindi din naipasa kaya I am curious as well kung anong batas yung tinutukoy mo.

Ang magpapataw siguro ng tax kalaunan eh ang mga kumpanyang tumatanggap ng crypto gaya ng coins.ph saka abra saka ibang kumpanya. Wala pa yata laws ang bansa about or how to handle cryptos. Kaya sa tingin ko wala pa dapat ikabahala. Kung meron man maliit rin siguro yun.
Sa ngayon maaaari wala tayong ikabahala dahil sa tax pero malay natin in the future mayroon na yan dahil ang BIR gagawa at gagawa yan ng paraan para makakuha ng tax mula sa atin pero dahil nagbabayad ang coins.ph ng mga permit nila at mga kung ano ano pa covered na rin siguro tayo nila dahil ginagamit natin ang service nila at kads transaction ay nakakakuha sila sa atin.

qwertyup23 hasn't replied on his statement here, so I will assume that he doesn't know what he is talking, tax issue is a serious matter, we should not say anything without a valid basis, so it will not mislead the readers. I'm one of the most excited when reading his post about bitcoin income not taxable in the Philippines, but until there's no proof on that, it's just a plain statement without truth.

Just think nlng na bawat binibili natin ay may kaukulang tax in that way nakakapag participate pa din naman tayo sa gobyerno, halos lahat ng kilos natin ngayon ay napapatawan tayo ng tax for example tubig, kuryente etc.
Halos lahat naman ay nakatax eh kaya sigurado ako kahit tayo sa coins.ph ay nakakapagbayad ng tax dahil user tayo nito na kung saan sila mismo ang nagbabayad ng tax mula sa kinikita nila mula sa atin. Hindi nakapagtataka if soon iimplement na talaga nila ang kada user ay magbabayad ng tax pero dapat kaunti lang at hinfi mabigat sa bulsa at depende sa income per month or per year ang bayaran pero ngayon hindi ko pa naaninag ang ganyang sitwasyon.

Just wondering, ang cryptocurrencies ba ay may tax? Ayon sa Taxation Law ng Pinas, kapag kasi ang isang freelancer ay lumagpas ang kinita sa PHP250,000 sa loob ng isang taon ay may kaukulan na itong tax.

This case might be sensitive pero matanong ko lang, wala pa bang kumatok sa mga bahay sa inyo ayon sa usaping ito? I mean tax evasion.

First of all, hindi pa naman lumalagpas ang kinita ko dito sa 200K. In fact, nasa 150K lang ang kinita ko last year (whole year na yan). Another thing, there is no valid law or bill stated yet na mayroong direct tax ang freelancers (as I remember when I had read about taxes). Actually, we can say that we are all paying tax eh, indirect tax nga lang. Ito yung pagbabayad natin ng tax through withdrawal in any remittances. But direct tax only applies for those who have monthly salary atleast 20K. Imagine, hindi naman tayo kumikita talaga ng 20K every month.

Those are income tax from salary, and what we earn in the forum is not considered as salary, therefore it's not covered by the rules and regulation under the salary income tax.

With regards to taxes when withdrawing our money through remittance, I don't think we are paying taxes on that, it's just a charge that we are paying.
IMO, if we are unemployed and we don't have business on our own, and we just rely on what we are making online, the tax that we are only paying are the VAT which is already included every time we purchase a product or pay for services.
