Just wondering, ang cryptocurrencies ba ay may tax? Ayon sa Taxation Law ng Pinas, kapag kasi ang isang freelancer ay lumagpas ang kinita sa PHP250,000 sa loob ng isang taon ay may kaukulan na itong tax.

This case might be sensitive pero matanong ko lang, wala pa bang kumatok sa mga bahay sa inyo ayon sa usaping ito? I mean tax evasion.

First of all, hindi pa naman lumalagpas ang kinita ko dito sa 200K. In fact, nasa 150K lang ang kinita ko last year (whole year na yan). Another thing, there is no valid law or bill stated yet na mayroong direct tax ang freelancers (as I remember when I had read about taxes). Actually, we can say that we are all paying tax eh, indirect tax nga lang. Ito yung pagbabayad natin ng tax through withdrawal in any remittances. But direct tax only applies for those who have monthly salary atleast 20K. Imagine, hindi naman tayo kumikita talaga ng 20K every month.
Those are income tax from salary, and what we earn in the forum is not considered as salary, therefore it's not covered by the rules and regulation under the salary income tax.

With regards to taxes when withdrawing our money through remittance, I don't think we are paying taxes on that, it's just a charge that we are paying.
IMO, if we are unemployed and we don't have business on our own, and we just rely on what we are making online, the tax that we are only paying are the VAT which is already included every time we purchase a product or pay for services.
I agree, just like what I am saying there is no yet a law discussing about the tax of freelancer. Maybe soon, but regarding with our payment sir in the remittances we can consider it also as a tax since it is a burden to us. We can call it as indirect tax or VAT because we pay for their services. Therefore, we are paying tax pa din. Indirect nga lang po.

In every business that is profit oriented, they always charge us since that is the lifeblood of their business, if they won't charge us, they will just operate for free and who will take care of their operating expenses. We should not be mislead between charges and tax because they are different, and I believe there is no such thing as indirect tax because it is specified every time we pay for something, if that is not specified, we called that hidden charges, not taxes or whatsoever.

Karamihan sa mga transaction na ginagawa natin sa cryptocurrency ay talagang may tax and yes hindi natin siya nararamdaman dahil binabawasan nila tayo kada transaction na siya namang pinapambayad nila bilang tax kaya walang dahilan para magpatax pa sila dahil sa milyon milyong user ng bitcoin sa Pilipinas super laki na nakukuha nila sa atin.

Karamihan sa mga transaction na ginagawa natin sa cryptocurrency ay talagang may tax and yes hindi natin siya nararamdaman dahil binabawasan nila tayo kada transaction na siya namang pinapambayad nila bilang tax kaya walang dahilan para magpatax pa sila dahil sa milyon milyong user ng bitcoin sa Pilipinas super laki na nakukuha nila sa atin.
The same as you, I also considered transaction fee as tax din sa cryptocurrency. Pero, just an argument to throw on your walang dahilan para magtax, just so you know napakarami din ang merong trabaho sa Pilipinas. Yun ngang mga may trabaho, natataxan eh. Saka yung foods na nabibili sa market may tax. Ano pa kaya yang millions of users ni bitcoin.

Pakiusap, kahit papaano pag-aralan muna yung pagkakaiba ng withholding tax, value added tax, at income tax. Marami pang iba pero kahit yang tatlo lang muna. Magkakaiba kasi ang saklaw ng mga yan pero marami dito sa thread ay pinag-isa o kaya naman ay pinagbali-baliktad na.
For typical person who don't have enough knowledge about different taxes, that's understandable that they only know the world tax and its meaning.
In crypto, we don't know what the type of tax will be impose here because there is no proper guidance yet.

Everyone would love to know if there is but until now, no members yet have shared about the proper tax treatment on our income online.
Until then, maybe we have no choice now but just to enjoy fully what we earn without worrying of tax violation since we are not aware if there's any.

Magkaiba ang tax sa transaction fee na kung saan ay napupunta ang tax sa gobyerno, habang ang transaction fee ay napupunta naman sa mga miners ng Bitcoin. Technically, hindi nila pwedeng taxan ang Bitcoin but rather yung pag-withdraw ng fiat currency na galing sa Bitcoin through local exchange which is sa tingin ko ay malapit na mangyare. If ever ganun man ang mangyayare, may benepisyo at negatibong epekto sa magiging resulta nito.

Tingin ko depende sayo kung ifi-file mo pero if under ka ng isang crypto company or may employer matic may tax sa payroll pero since karamihan dito is independent i dont think matetrace nila  isa isa pero habang wala pang confirmed tax law sa crypto  hayaan na lang natin at ienjoy mga earnings without deduction of tax diba and by the time na may violation na tyo without knowing, madami naman tayo besides wala nmn tlga declared law in the first place.

so far wala pa naman kumakatok samin or wala pa naman akong narereceive na letter ukol dito.
pero kung malaki naman ang kinikita mo mas mabuti siguro kung mag file ka nalang ng voluntary para maka siguro.
di din naman nila alam kung magkano talaga ang kinikita natin.

Siguro paps matitrace nila yan, sariling opinyon ko lang to. Alam kasi ng coinsph or iba pang local exchanges na kagaya nito kung sino talaga tayo kasi kailangan natin magverify bago makawithdraw so kung ang batas ay makiki-connect sa kanila upang mahanap tayo ay talagang mangyayari yun. Pero I think nung una pa lang alam na yan ng batas kasi pinayagan nila yan, so I think kumuha sila ng tax gamit ang coinsph pwede rin silang magconnect sa coinsph na kukunan agad ng tax kung may pera yung coins natin. Yun lang po masasabi ko.

Para sa akin, makokonsider ko na ang transaction fee na tax sa cryptocurrency, pero sa ngayon wala pa naman akong nakukuhang impormasyon na may tax ang cryptocurrency at sana hindi ito mangyari kasi halos lahat ng bagay may tax, at dadagdag na naman ito kung mangyayari maraming tao ang magkakapos sa pera.

Unang -una ang sagot ko ay wala pang tax dito, dahil kung titignan mo hindi naman tayo empleyado dito sa forum na ito. Halos lahat tayo dito ay mga freelancer, siguro yan ang kagandahan ng sistema ng blockchain technology.  At saka tama wala pa sa kasalukuyan na batas ang ating bansa para sa bagay na ito. Saka wag kang mag-alala hindi naman ito ilegal, dahil kung totoo man na ilegal ito sigurado akong hindi ito aaprobahan ng BSP sa aking pananaw at pagkakaintindi.

Para sa akin, makokonsider ko na ang transaction fee na tax sa cryptocurrency, pero sa ngayon wala pa naman akong nakukuhang impormasyon na may tax ang cryptocurrency at sana hindi ito mangyari kasi halos lahat ng bagay may tax, at dadagdag na naman ito kung mangyayari maraming tao ang magkakapos sa pera.
Hindi naman tayo ang mag didictate kung anong gusto nating tawaging tax, kung tax yan, there is a specific rules on that and there is a guidelines on how to remit your taxes, transaction fee is not a tax, it's considered income on the side of the exchanges which is subject to tax, AFAIK, we are not paying any taxes when using the exchange because they are not authorized as withholding agent.

Para sa akin, makokonsider ko na ang transaction fee na tax sa cryptocurrency, pero sa ngayon wala pa naman akong nakukuhang impormasyon na may tax ang cryptocurrency at sana hindi ito mangyari kasi halos lahat ng bagay may tax, at dadagdag na naman ito kung mangyayari maraming tao ang magkakapos sa pera.

Ako rin before ang iniisip ko na tax ay possible na transaction fee at ngayon alam ko na rin pero ang dahil hindi pa talaga nag aanounce kung ano ba talaga ang tax.

Pero sana huwag sana magkatax ang cryptocurrency alam mo na ang ahensya natin ay sakim ang karamihan diyan ay panigurado lalakihan nila yan pero dapat depende sa kitaan ang magiging tax kung magkakaroon man o hindi.

You are right, the government can only impose tax on businesses that are registered to them like our local exchanges which is coins.ph.
They are earning millions of pesos from fees, and the exchange rates which is mababa talaga sa kanila if you are selling, so that will contribute as part of their income, they are paying taxes but we aren't, and until there is no proper guidelines it will be hard for the government to collect taxes from us.

As far as i know walang tax ang crypto dito sa atin. Siguro pag nalegalize pwede na nila patawan ng taxes like kunwari bibili ka s mga merchants using crypto or bibili ka ng bitcoin sa isang store na registered under SEC. Alam ko pinag uusapan na yan sa Senado eh

Us who earn online might not be getting tax as we have no legit company that we are working for, if we put this scenario to like receiving a salary, the company that we are working should deduct tax from our salary as they are the authorize withholding agent.
