Look like Binance doesn't follow its own Terms of Service.

After getting a problem and not interested to resolve it since I don't use Binance and never used it, I contacted them via the dedicated page to use the 8.3 Right to Erasure (Right to be Forgotten)

After a few minutes, I got a reply to tell me it's not possible (lol what?), and instead, I can disable email notifications or something like that. I don't know if it's again one of the tier 3 people hired for $2/hour working on cybercafé but I reminded them that it is a right related to the General Data Protection Regulation (EU) 2016/679 Article 17 adopted by the European Parliament and it has to be done within 30 days.

Raise it with a financial services ombudsman or equivalent in your country if necessary. Inform Binance beforehand though that you will be pursuing this once the 30 days have elapsed.

A lot of these exchanges put up a facade of compliance in their ToS. But since there's nearly no one that is actively seeking recourse they seem to ignore the very regulators they are governed by.

It's a matter of principle and enforcing your rights. What's the point of the GDPR is it's not adopted in practice?

Did you open another ticket regarding your problem or only that one time?, before going any further it's better to contact support again since some of them can be clueless about their rules and in this case their TOS and privacy policy.

I believe that's a very important line in their privacy policy and going against their own rules and policies would not be a great look for them and hopefully they will solve your case soon.

Just wondering what does "certain circumstances" exactly mean in their view, and why they didn't provide any more details as to what will constitute as a certain circumstance.

You're talking about Binance.com and not Binance.je or something, right?

It might just be incompetence. If you keep pushing, you might get somewhere. That's been my experience with most exchanges actually. The first reply or two are usually just boilerplate, or a bottom level CS rep who knows nothing.

I'm not the type of guy sending multiple support tickets the same day or even every day. As I said I sent another one just today

Under 'certain circumstances' it usually implies if there is a judicial investigation about you and authority (police/taxes office) has requested access to certain information. But I'm a good boy.

Yeah, it's about Binance.com (I thought .je closed some time ago).
It's truly incompetence. Telling me I can disable email notification/account in the settings while I can't even log in to the dashboard lol.

I hate to ask for something several times when I am totally within my rights. It makes me feel like a beggar.
I contacted them again today, I will do it for 3 max. if nothing is done I will go further, I have no time to waste like that.

Yeah, it's about Binance.com (I thought .je closed some time ago).

binance.je is utterly dead but not actually closed. on a good day their BTC/GBP market does a whopping 1-2 BTC worth of volume. Tongue

There must be another group that will receive your request when you disable your account through that email.
I don't see the difference between the two.

If there is another department in charge of account deletion then the CS can just forward your email to them instead of having you go through the longer procedure.

Just my thoughts after reading the contents of the reply email.

It's a kind of policy emphasis to make sure customers don't have to worry about the identity being sent to Binance. Binance will use 8.3 policy as verified customer rights. It's not that Binance will delete accounts that have done trade semi-anonymously on their platform, as there is nothing they can track except trade history and related addresses to solve a case.

No matter how good the erasure right does not mean the data is completely deleted, because the computer by default always leaves traces.

Sounds like, just change your password to random characters or forget your account, period. lol

Even if they somewhat "delete" your account, I don't think that they will remove their copy of your/anyone's personal details. There will be a chance that they will keep their users' details for future use, submission of tax-related issues to authorities, or anything related to money-making.

This is about accounting for the company, not really my problem, and the General Data Protection Regulation is in favor of the customer. Everything else I'm not concerned about, they have to abide by the laws no matter if the accountant isn't happy.

In Europe, we are very picky about our personal data, with agencies to complain, etc.

By the way, the issue has been escalated to level 2

Update:

3 weeks later I got an answer after I needed to say a second time that I want to delete my account.

If I wanted to use the site I was forced to verify my identity. Now they tell me that I can delete my account but I need to provide a selfie holding a  handwritten note. "Today is date/month/year, delete my Binance account".

Why should I show my face? Considering I never showed it (because I'm too cute) why should they need it? That's so bothering, I'm thinking about using the dog of my neighbor taking a pic with a note

it almost seems like tweeting @CZ and hoping the tweet goes viral has a better shot at success.

i was checking out https://www.enforcementtracker.com/ which details GDPR fines. it seems like there are lots of cases against small companies and even individuals, not just mega corporations like i thought.

maybe you could get binance slapped with a noncompliance fine. Tongue
