It was probably simpler to tell her a lie about the machine malfunctioning than to disclose the truth because I picture the casino going out of business after giving the woman her earnings. How do you keep the machine going when you know full well that it is broken makes this story cringe-worthy.

I believe that the regulators ought to establish a team that visits physical casinos on a regular basis to look for machine malfunctions and to penalize operators that continue to use problematic machines.

If you pay close attention to the article, you will see that the casino followed the laws so much and that the new york gaming commission confirmed that the machine had problems, so the casino was not giving excuses for not paying, they complied with the elections, about the invitation what they did to the lady, I think they were just being nice to the lady in an attempt to show the lady that even though she hasn't won millions the casino still treats her well and that she can keep playing at the casino, these things don't happen all days of someone making money and discovering that the machine was having problems and canceling the gains

Of course this is nothing but a cheap way for the casino to avoid paying the jackpot price. And since the casino must have developed deep ties with the gambling commission, and probably with some money involved as well, and they're also up against an ordinary gambler, they were able to just took the player for a fool. It's always the way to deceive customers, if the said woman lost 10k dollars as a result of the malfunctioned machine the casino won't say a thing about it. The market is quite managed by some dubious people who don't care about the feelings of others. Imagine quenching the happiness, the woman had in her after seeing such an amount, to a sad qualm. It'll be difficult for her to forget such an experience and the trauma may leave her to become fearful of going to casinos. Adding insult to her injury they offered her few dollars that's not humanly in any form. The managers of the Casino are ruthless for handling the dispute in such a disdained manner. They've got no respect for her and even the court shouldn't have kept the case pending till now. It was a fishy reason, and there is something behind the story. That is a huge amount, and no matter the slot malfunction, they should still have given her some sort of damage pay or a bigger amount on it as it is their duty to make sure the slot machine is working properly. That selfie could be proof of winning, so she should try to pursue it until she can get bigger than the amount that was given to her. If I were in her situation, for sure, I would ask the owner for a letter that was signed by both parties saying that you won it, but I need to go back the next day so that I can really hold them accountable.

this is pure fraud, the lady won for real and honesty but the casino owners don't want to pay a penny of the lady's winnings because they definitely don't have as much money as the lady won. supposedly for a country that legalizes gambling, this kind of thing can be reported to the police because all the evidence has been collected and there is no fraud that the woman is doing, the one who cheats is the owner of the casino.

I have been hearing about this all day today. The poor woman does not deserve such a roller coaster of emotion. Even if she did not win the money she should still sue and get money for having been put through that ordeal by a faulty machine, which the mentioned casino has a duty of responsibility for. Their machine, their responsibility.

By the same thought: Can the casinos claim that winnings are undeserved when a human shuffles the cards the wrong way at the blackjack table? just because he was distracted or intoxicated?

Maybe the slot machine is really malfunctioning that time but the casino staffs should have fixed it, otherwise players should be warned not to play on it. But i felt sorry for that woman because knowing that the NY Gaming Commission has sided with the casino, then I don’t think she will still receive her won amount. But at least she will still be given the maximum payout and not just settle with a simple dinner.

It was fixed after that $42 million+ appeared on the screen hehe. Giving her the maximum payout would have been a good compromise but they have a policy to void the result when the machine malfunctions.

This is like the most fraud thing I have ever observed since social media became so strong. I understand that than kind of money can be very disruptive for their casino business. Although if there are issues with their slot machines its their responsibility to fix it. Not very sure how law works but I think this customer should directly open case against that fraud. In proper countries she would definitely win a lot of money at least.

Reading the terms of service of most casino companies might be very challenging because it can be time consuming, but I think it is worth studying. At least gamblers would be able to know thier rights and privilege. The slot machine has a disclaimer that voids all wins if it malfunctions. But how would the firm prove that the machine has fault? Would they not hide behind slot machine problems to deny genuine winners thier funds? 

I think the woman should seek legal advice and look for various means to recover her win. She is not to blame for the machine malfunctioning. If she has lost a huge bet due to the machine's problems, would they have recognized that the machine caused her loss? They would have concealed it and go on with thier operations.

I feel like noone would ever read such terms because it's very time consuming. I once try to read such documents. Its probably better to get law assistance to pick very legit casino. Damn that feels bad. Her mistake was leaving without any sort of proof or documentation that she won and that the casino would give the winnings to her the next day as they stated. It's also absurd how the casinos stating it as a "malfunction" on their part is enough to pretty much deny the win. The lawyer is right she should be paid the maximum amount of $6500, its not her fault that the slot is malfunctioning at the time that she is playing no gambler wants to play in a malfunctioning machine we all want equal chances, not a chance that will favor gamblers or the casino operators.
The court should have a final ruling on this because an incident like this could happen again so they will have a reference on what action to take, both the operators and the players.

This is the case of pure fraud and scam on part of casino management,  they arranged this tactics to attract costumers for gambling and in return thru back off from their winning amount. Now in this case there are many proves right on spot .
1. Selfie taken by the lady.
2. The camera records of casino.
3. The people present there who are playing

This story is really strange if it's true actually and this casino should have been closed by now for such fraudulent activities.

I am so angry right now while reading this story, like you said, some casinos are plainly fraudulent, i am even finding it difficult to believe this happened for real, and as it is, the woman in question can not do anything other than accept whatever is given to her.

She can not file a lawsuit against this casino since it is said that a disclaimer was written on the body of the machine that malfunctions voids all pays and plays, and the casino have claimed the machine malfunctioned,  the question now is, why would the casino allow users play on a faulty machine?
This is an absolute fraud and one that shouldn't be condoned, i could suggest the woman get some higher authorities involved to investigate this matter, to be really sure that the machine in question really malfunctioned.
