The International Criminal Court condemns Israeli leaders.

Two days ago, Arab and some international countries, organizations and movements welcomed the issuance of two arrest warrants by the International Criminal Court against Israeli Prime Minister Benjamin Netanyahu and dismissed Defense Minister Yoav Galant on charges related to committing war crimes and crimes against humanity during the ongoing war of extermination on the Gaza Strip.

The decision was faced by a European discrepancy between commitment to the decisions of the International Court and geopolitical sensitivity, especially those that provide unconditional support to Israel. While many countries expressed their commitment to the court’s decision, some other countries expressed their rejection of the decision and their readiness to receive the accused on their lands and not to comply with the conviction decision. Some analysts said that this is a bold decision that will restore hope in the role of the International Court of Justice and provide opportunities to hold war criminals accountable, while others said that the decisions of the International Court are not neutral and are mixed with politics. It is true that the International Court of Justice is very slow in making diagnoses and issuing decisions, but it has succeeded throughout its history in directing official international condemnations against war criminals and some of them have been arrested.

Although I am convinced of the futility of the International Court and all international bodies that claim to defend human rights, I cannot deny my support for the trials that succeeded in convicting war criminals such as Milosevic, Hassan al-Bashir, Loriega and others. The court has been working very heavy since its establishment, but it cannot be said that it is not working at all. If it is permissible today to accuse it of working according to certain political agendas just because it convicted senior Israeli officials, it should be condemned by the same logic because it did not investigate many crimes of genocide committed by major countries such as the Vietnam War, the Korean War, the Iraq War and many other wars that occurred after the establishment of the court following the Rome Statute. It is not surprising that countries that support Israel will criticize the court’s decision and may refuse to implement it in violation of the court’s laws.

However, it is truly impudent to question the entire system of the court because it is a semi-decentralized system, with 123 member states. These countries provide funding for the court and elect the judges and the prosecutor. Since the court has no police force, it relies on member states to arrest suspects. The court also has 18 judges elected for nine-year terms. I don’t know how any state or government body in any country can sanction an international body, as the United States has promised. It is not an ordinary international body, but the most important legal body in the world today. The most I can think of is for the countries that reject the court’s decisions to withdraw from the Rome Statute and they can call on their allies to do the same.

in spite of all this it seems to be the logical thing to do by the International Criminal Court, I am afraid it is going to continue to be rather a symbolic act by the international organism. People from Palestine and in the middle East who are suffering in a disproportional way because of the actions of Israel may believe there is some hope behind this decision, but in reality Netanyahu is not stupid enough to show up in a country which has the minimal commitment to arrest him.
He is going to continue with the war effort in the middle east now than ever since Israel is aware of the unconditional support they are going to have from Donald Trump and the Republican party, I would not even be surprised the government of Netanyahu feels secure enough to start annexing land from the gaza strip and also consider to do the same with the southern territories of Lebanon.

He does not need to step out Israel for him to continue to push his agenda, that is for sure, He wont see a single day in prison.

The United States, as an influential member of international organizations and the one that has the upper hand in determining major trends, the effectiveness of its efforts cannot be acknowledged if it actually intends to obstruct the decisions of the International Criminal Court. The organization is composed of many countries and the implementation decisions are issued by a panel of judges recognized by all member states. That means that any questioning of the decisions of those judges necessarily questions the eligibility of the organization as a whole.

There will remain partial authority since the United States is one of the strongest parties funding the organization, meaning that it can decide to withdraw from it and thus stop funding, but it cannot find a suitable formula to appeal the rulings. The issue is important and can be considered dangerous to some extent since any decision against the organization’s rulings will have consequences and effects on multiple levels, especially since member states of the organization, which are friendly countries to Israel, have supported the court’s decision and declared their commitment to it.

It cannot be said that the International Court is the one that will implement the law and care about applying justice. But what is happening now is indicative of support for the position of the parties opposing the Zionist project in the region, and therefore political interpretations will be inevitable.

In fact, I remained interested in what would happen after the bold decision of the International Criminal Court. I remained interested in following the positions of countries and even international organizations. Of course, as I expected, there would be an Israeli reaction that would push towards refuting the accusations or reviewing the court’s decisions.

The office of Israeli Prime Minister Benjamin Netanyahu announced today (Wednesday) Israel’s intention to appeal the decision of the International Criminal Court against him and former Israeli Defense Minister Yoav Galant.

The office said in a statement that Netanyahu met in Jerusalem today with US Senator Lindsey Graham, who informed him of “the steps taken by the US Congress against the International Criminal Court and against the countries that will support the decision.”

The statement added that “the State of Israel rejects the decision of the International Criminal Court and the legitimacy of its decision to issue arrest warrants against the former Prime Minister and Defense Minister.”

The statement said, "Israel today notified the International Criminal Court of its intention to file a petition with the court, along with a request to postpone the implementation of the decision issued."

The statement added that "the announcement of the Israeli appeal reveals in detail the legal and practical invalidity of the basis of the charges brought by the court."

The statement continued, "If the court rejects the appeal, this will show Israel's friends in the United States and the world the extent of the bias of the International Criminal Court against the State of Israel."

No one can predict the results of any pressure that may be exerted by any party on the International Criminal Court, especially American pressure, which will inevitably have an impact in one way or another. The problem is that this court has independent decision-making and all its decisions can be considered issued in a somewhat decentralized manner because the rulings are not issued by a single judge and are under the supervision of member states and international observers.

As for the impact on the countries supporting the court's ruling, I do not expect this to happen because all member states of the International Criminal Court are required to implement all rulings, otherwise there will be no point in establishing it in the first place. That is, even if all countries object, this cannot cancel an enforceable ruling. On the other hand, there are other stages of litigation that can be activated, such as appealing the ruling issued or challenging it through legal means according to what is stipulated in the litigation procedures in effect in almost all courts in the world. It seems that the United States is threatening due to pressure from the Zionist lobbies and is still studying its next steps, especially with the change of administration next January. No one knows what Trump's position will be.

The fact of the matter is that the decision of the international court is laughable in finding Israeli prime minister and defense minister I don't think is ruling will hold any water as this war is sensitive and has allot of sentiments because critical looking at this Israel and Palestine war it has two sides of the coin because if you listen to the Israeli part of the story it's about survival and extraditions from the surface of the earth while on the part of Palestine it's about disposition from their ancestral land and already the world is divided on this on going war  with almost all country holding it position by way of support each side but I don't see this judgement being unforced because this matter has been characterized by politics. But this judgement will go a long way to see how independent and strong the so called international criminal court as there are already talks about the international criminal court having power when it comes to selective countries especially African countries
