I want to share my experience with Stake.com to bring attention to their actions and the significant legal and public consequences they could face if they fail to address this matter. My goal is not only to highlight their negligence but also to ensure this message reaches as many people as possible in Switzerland and beyond—and potentially initiate a civil lawsuit, supported by the Swiss Federal Gambling Commission (ESBK), and take further criminal action based on unjustified enrichment.
1. How I Discovered Stake.com and Signed Up I came across Stake.com through a TikTok advertisement, which many users in Switzerland (or elsewhere) may have also seen. It appeared to be a legitimate platform, so I registered with good intentions. As part of the registration process, I completed the KYC Level 1 (Know Your Customer) requirements, providing all necessary personal information, including my name, address, and email, which I also verified.
Once my account was set up, I was allowed to deposit funds and start gambling. Over the course of two years, I played regularly, achieving Platinum 3 status—a level that reflects significant gambling activity.
2. The Bonus Offer and Sudden Account Suspension After losing a substantial amount of money, I received an email offering a $250 bonus if I completed additional KYC verification (Level 2/3). Trusting the process, I immediately submitted the required documents (including my Swiss ID). However, right after completing this, my account was abruptly suspended, with Stake.com citing that I was accessing the platform from a "restricted territory."
This explanation is baffling because Stake.com knew my location from the moment I registered. They accepted my Swiss address, allowed me to deposit funds, and facilitated my gambling activity. Now, after I’ve lost a significant amount of money, they claim I was in a restricted territory—a justification that is not only unacceptable but also potentially illegal.
Why would they let me play in the first place? If I had won, let’s say $100,000, they would never have paid it out. So how is it acceptable for them to knowingly take deposits from restricted players while turning a blind eye?
I have had small wins and withdrawals to recover some losses. For example, I might deposit $500 and lose it, then deposit $1,000 and lose that as well. Occasionally, I withdrew smaller amounts, such as $600 or $1,000. However, these withdrawals did not even cover my losses, which were substantial. Over time, my losses escalated as my bets increased. My average bet sizes ranged from $2 to $4 in slots and higher amounts in table games.
If I had hit a significant win—such as a 40,000x payout on a slot—they would have flagged the account immediately and refused to pay. Yet, they continued to allow me to deposit and gamble without issue, only stepping in to suspend the account once I had lost a large amount of money.
Even now, I can create a new account with a Swiss address, verify my email, deposit money, and lose it. This shows that Stake.com’s compliance measures are either nonexistent or deliberately lax. Moreover, they have sent me regular promotional emails, effectively indirectly marketing to Swiss players—a clear violation of Swiss law, as outlined in the ESBK lawsuit (see below).
3. Violation of Swiss Gambling Laws I later discovered that Stake.com is on Switzerland’s blacklist of unlicensed online gambling platforms (ESBK blacklist). Swiss law prohibits unlicensed casinos from operating in the country, and platforms like Stake.com are explicitly barred from offering their services to Swiss residents.
By allowing me to register, deposit money, and gamble—and obviously lose it—Stake.com clearly violated Swiss gambling regulations. Under Swiss law, contracts formed under illegal circumstances are deemed null and void, which means I am entitled to the return of all funds lost on their platform.
4. Breach of Stake.com’s Own Terms of Service Stake.com’s Terms of Service state that users from restricted jurisdictions (including Switzerland) are prohibited from accessing their platform. It is their responsibility to enforce these restrictions by blocking registrations from such regions and verifying users’ locations during account creation.
Despite these obligations, Stake.com failed to block my account, verify my location adequately, or prevent me from gambling. This constitutes a blatant breach of their own terms and highlights their negligence in upholding compliance measures.
If Switzerland is a restricted country, why does Stake.com allow Swiss users to select it as their country during registration? Is this a deliberate oversight, or are their developers genuinely unaware of this glaring issue? Either way, it points to gross negligence or intentional misconduct.
5. The Financial and Legal Stakes Due to Stake.com’s actions, I have lost approximately $40,000 USD—a devastating amount, especially as I was unemployed at the time. Most of this money came from my unemployment insurance, making the situation even more troubling. On average, I deposited 75% of my monthly income, amounting to $1,000 to $3,000 per paycheck, and lost it within a week.
I am seeking compensation amounting to at least 75% of my losses ($30,000 USD) if an agreement is reached—or 100% through legal channels. I also demand the following actions from Stake.com:
Block all current Swiss users: Prevent further illegal gambling by Swiss residents and provide the ESBK with a detailed report of Swiss user activity (registrations, wagers, losses, etc.). Cease accepting new Swiss registrations: Ensure no new Swiss users can access the platform. Enhance compliance measures: Implement robust systems to comply with international and Swiss laws to prevent such violations in the future. 6. Escalation and Broader Implications The ESBK had previously filed a lawsuit against Stake.com due to allegations of illegal marketing targeting Swiss users, such as the sponsorship of the Sauber F1 Team. However, this lawsuit was withdrawn due to insufficient evidence of direct or indirect marketing activities by Stake.com in Switzerland.
Nevertheless, my case demonstrates how Stake.com profits from Swiss users in violation of gambling laws. Based on unjust enrichment, my lawyer has advised me to pursue criminal charges against the responsible team managing Stake.com.
While identifying the individuals behind Stake.com may be challenging, a criminal charge would proceed based on their actions and illegal profits. If Stake.com fails to address this matter adequately, I will escalate it to the ESBK and other authorities and raise public awareness about their unlawful practices.
7. Conclusion: Stake.com Must Take Responsibility This is my final attempt to resolve this issue amicably before pursuing legal action. To Stake.com: You have the choice to either address this matter now or face the consequences of legal and public scrutiny.
I demand the compensation I am owed and expect you to take immediate action to address the broader legal violations your platform has committed. Ignoring this will only worsen the situation for your company—both legally and reputationally.
Thank you for taking the time to read this. Whether you agree with me or not, I believe it is important to speak out against such practices. Stake.com has demonstrated a blatant disregard for the law, and I will not remain silent about it.
I already got 2 settlements with other Casinos although the net losses owed by them are not near the amount Stake legally owes me (under 500$) and all it took was some E-Mails between me and the casino and a kind reminder by my lawyer of consequences incase of ignoring the matter.

Seems like you have a history of problems with casinos. Anyway, so you lost money and now it's the casino's fault because you weren't supposed to be allowed to play there? Nice try, take a ticket and get in line with all the other clowns trying to free roll a casino, kinda sad. What if you had won, would you be here crying as well now? Don't waste time crying in this forum, you are at the wrong place for that. And also, seek some help for your addiction. By the way, platinum 3 doesn't require significant gambling activity. You get get this after 1 million $ wagered already. Sure taking people's money from banned regions is questionable, but nobody forced you to play there. You did this on your free will. And by the way, when you register you agree to the TOS of the site, just saying. I already know the stake hater forum clown and his alt account will come and support this hilarious claim, good luck wasting your time with this out of his mind individual. Maybe you can make a class cation lawsuit with him. Also, you might have acted against the law as well. I doubt the money your government gave you ( by the way, get a job ) is supposed to be spent on gambling. Lastly, level 1 KYC on stake is not real KYC. You can enter an address on the moon if you like. Nobody checks this, the actual KYC starts from level 2, and that's when they correctly acted. PS: Losing 40k and only wagering 1 million says a lot about how bad you are at this.

PS: Losing 40k and only wagering 1 million says a lot about how bad you are at this. Thank you for your input, though much of it seems to misinterpret or ignore the key points I raised. Allow me to address some of your statements directly: “Seems like you have a history of problems with casinos.” Speculative and irrelevant. Whether or not I’ve had previous experiences with casinos does not diminish the responsibility of a platform to operate within the bounds of the law. “You lost money and now it’s the casino’s fault because you weren’t supposed to be allowed to play there?” Precisely. If a platform operates in a restricted jurisdiction, it is their responsibility to block registrations from such regions. Stake.com allowed me to register, verified my information (KYC Level 1), accepted my deposits, and let me gamble for years. They only cited the “restricted territory” excuse after I completed further verification and lost significant money. Their negligence in enforcing their own Terms of Service and compliance with Swiss gambling laws is a key issue here. “What if you had won, would you be here crying as well now?” This is a common deflection used to shift blame. The fact remains that Stake.com would likely have refused to pay out any significant winnings under the same “restricted territory” excuse they now use to justify suspending my account. This highlights a systematic flaw in their operations—they take deposits but hide behind their Terms when payouts become inconvenient. “Platinum 3 doesn’t require significant gambling activity. You can get this after $1 million wagered already.” It’s remarkable how casually you dismiss $1 million in wagers as “insignificant.” For context, that figure reflects extensive gambling activity and underscores how much money the platform allowed me to spend while knowing I was in a restricted country. “Nobody forced you to play there. You did this of your own free will.” This is not about personal choice; it’s about a platform knowingly operating in a jurisdiction where they are prohibited, profiting from Swiss players, and failing to comply with legal or ethical standards. The fact that they allowed me to register, deposit, and gamble is a violation of Swiss gambling laws, regardless of my intent. “By the way, when you register, you agree to the TOS.” Contracts formed under illegal circumstances are null and void under Swiss law. Since Stake.com is unlicensed and barred from operating in Switzerland, their TOS holds no legal weight in this context. “Level 1 KYC is not real KYC. You can enter an address on the moon if you like.” This argument is self-defeating. If Level 1 KYC is so meaningless, why is it part of the registration process? The fact remains that Stake.com accepted my Swiss address, verified it, and allowed me to gamble despite claiming now that Swiss users are restricted. If KYC Level 2 is the only “real” verification, why did they wait until after I had lost significant money to enforce it? “Maybe you acted against the law as well.” My actions are not the focus here. The Swiss government has explicitly banned platforms like Stake.com, placing the responsibility for compliance on the operators, not individual players. As for your suggestion about how I used unemployment insurance funds—irrelevant and unnecessarily personal. “Losing $40k and only wagering $1 million says a lot about how bad you are at this.” This is not a conversation about my gambling skills. It is about a platform violating laws, exploiting players, and profiting unjustly. It’s clear that many will view this post through a lens of skepticism or hostility, as you have. However, my intent is not to “free roll” or avoid responsibility but to hold Stake.com accountable for their actions. Their negligence has legal and ethical implications, and I’m exercising my right to address this publicly and through the proper channels. If you have nothing constructive to add beyond dismissing my case as “hilarious” or “sad,” then your input does little to further the conversation. Let’s focus on the issue at hand: Stake.com’s legal and ethical violations and their failure to operate transparently in restricted jurisdictions like Switzerland.

As of today, I have formally submitted a complaint to the ESBK (Eidgenössische Spielbankenkommission) regarding the situation with Stake.com and its operations in restricted countries, territories, and for prohibited players. This follows an email exchange with Stake in which they referred to their Terms of Service. Depending on the ESBK’s response, I intend to pursue legal action and potentially file criminal charges against the owners/operators of Stake.com.
Reminder: Offshore casinos like Stake.com have little regard for the gambling regulations in your specific country. In many cases, they may still accept your registration and deposits, even verifying your account to create the illusion of legality. This tactic can mislead players into thinking the platform is operating lawfully while essentially robbing them of their money. These platforms are banned in many parts of the world for a reason—protect yourself and stay informed.
Attention: If you’ve had issues with Stake.com, particularly as a Swiss player or while playing from Switzerland or any other territory, please send me a message. I am gathering information from affected players to strengthen the civil lawsuit against Stake.com. Every bit of evidence helps in holding them accountable.
To the players defending the casinos: please respond with logical and straightforward answers to posts, rather than letting ego or personal bias cloud the discussion. Some users seem intent on muting those who criticize casinos for their shady practices instead of engaging in meaningful dialogue. If you want to participate, do so respectfully and appropriately—try, for a moment, to put yourself in the shoes of the victims. By taking this approach, I’m confident we could eliminate around 50% of the unnecessary comments and posts in these discussions.
Thank you to everyone reading and contributing to making this issue as public as possible.
To anyone responsible for marketing at Stake: I sincerely hope you are monitoring these forums, as this is the start of what could be the downfall of your casino. Maybe not for all players, but certainly for those in Switzerland. I also hope the regulatory bodies in Switzerland hold you fully accountable and impose significant penalties for the damage you’ve caused. This includes the harmful influence of your social media ads and partnerships with rappers and streamers actively promoting your shady platform. It’s time to understand the impact of what you’ve done to players harmed by your practices.
Furthermore, I hope that by speaking up and sharing my experience, I can encourage other players to come forward as well. Together, we can ensure that offshore casinos like Stake.com cannot run away from their obligations or hide under the loose and inadequate regulations of jurisdictions like Curaçao, Malta, or Gibraltar. The more voices we gather, the harder it becomes for these platforms to avoid accountability for their actions.

Stake, 1xbit, BC.game and all the other big crypto books are the same. You can lose money playing from a banned jurisdiction but you can't win. Money will never be returned.

Yes, its true, this rule applies to too many casinos & sportsbooks, but not all. Ultimately its on the player to read & abide by the casino's Terms of Service before making a deposit.

So you gambled away your unemployment money and now you want Stake to reimburse your losses because Switzerland blacklisted Stake? That doesn't make a whole lot of sense. Switzerland is not mentioned in Stake's list of prohibited jurisdictions. You're gonna have to indeed file a lawsuit and go the whole nine yards. You will not find much sympathy here.

So, Nutildah—if you have a counterargument about the actual scam accusations, let’s hear it. Otherwise, your AI rant is just noise to protect Stake’s shady business.
Amazing... You apparently didn't see my last post. Stake did nothing wrong in this instance. They are blacklisted by Switzerland -- not the other way around. If you read the OP (you didn't because your only purpose here is to shit on Stake), you'd know that the complainant gambled away unemployment insurance funds given to them by the government. After losing a sizable amount of money, they are now blaming Stake. OP should find a lawyer. That's their best bet. Nobody here can help them, certainly not you.

To reply to kingbj21, I believe you have some valid points, but your approach to this matter is not ideal. If you continue to make accusations or threats like these, Stake could and most probaby will sue you for defamation(especially for the amount you wagered/lost there) For instance, the GDPR request you mentioned is something that alone could form the basis for a lawsuit. If Stake has indeed breached Data Protection Laws, that would be grounds for a criminal lawsuit in Switzerland or in the EU. If you haven’t already contacted or retained an attorney, I highly advise doing so. However, in my experience, be cautious—many attorneys may take on multiple cases like this, only pursuing them if they believe the collective payout is worth it. Regarding GDPR data requests, I’ve submitted one myself. Let’s see if Stake provides the requested information within the timeframe outlined by GDPR. If they don’t, I will sue them as well for that breach, as it’s unrelated to my specific case. According to Swiss law, after 30 days, you’re gonna have to send a formal reminder and provide them with an additional deadline (e.g., five business days). If they still fail to comply, you’ll have a solid case that will go trough any court in miliseconds. This is based on both legal precedents in Switzerland and advice I’ve received from my lawyer. My mistake. Seems like it indeed is prohibited by Stake to use the site as a resident of Switzerland: I couldn't access the ToS earlier because I live in a prohibited country as well. So I guess my question to you would be, how did you manage to bypass Stake's restrictions?

My mistake. Seems like it indeed is prohibited by Stake to use the site as a resident of Switzerland: I couldn't access the ToS earlier because I live in a prohibited country as well. So I guess my question to you would be, how did you manage to bypass Stake's restrictions? He used a VPN, already confirmed it in a different thread. So basically he knew that he is not allowed to use stake, he did it anyway. Yet now he is blaming them for whatever reason. In other words, an "I didn't know I wasn't supposed to play at stake" excuse won't hold up since using the VPN proves he knew exactly what he was doing. It's not like they secredtly changed their TOS or whatever. Seeing the message you showed basically warns a player that he is not supposed to be/play there. He did it anyway and lost. Yet it's stake's fault now.

My mistake. Seems like it indeed is prohibited by Stake to use the site as a resident of Switzerland: https://talkimg.com/images/2025/01/30/WxWvb.pngI couldn't access the ToS earlier because I live in a prohibited country as well. So I guess my question to you would be, how did you manage to bypass Stake's restrictions? He used a VPN, already confirmed it in a different thread. So basically he knew that he is not allowed to use stake, he did it anyway. Yet now he is blaming them for whatever reason. It's not like they secredtly changed their TOS or whatever. Seeing the message you showed basically warns a player that he is not supposed to be/play there. He did it anyway and lost. Yet it's stake's fault now. It doesn’t change the fact that Stake knowingly allowed me to play while being fully aware that I am from Switzerland. Either you’re not reading my post carefully, or you’re misunderstanding the points I’m trying to make. VPN usage is common and has been for years, yet Stake explicitly assured a regulatory body (the ESBK) that even with the use of a VPN, it would be impossible for a Swiss resident to register, play, or access their platform.I understand that some might doubt my claim about being unaware of the site restrictions. However, that is beside the point. The facts are still overwhelmingly stacked against Stake on several levels. It’s frustrating to see that instead of addressing these facts, you are more focused on dismissing threads like this or discrediting anyone who raises valid claims against the casino. This effectively silences legitimate concerns and discourages further scrutiny. Just read the goddamn ESBK article dude. Use Google Translate, ChatGPT, or any translation tool to understand it clearly. Your arguments don’t address the actual rules set by the ESBK or the commitments Stake made to them. Stake explicitly guaranteed the ESBK that registration and gameplay from Switzerland would not be possible under any circumstances. And yet, here we are. On a related note, I’ve already received a response from the ESBK regarding my case. They’ve informed me that they will follow up soon, likely requiring additional evidence or information from me as they proceed with their investigation or case-building. Perhaps you should try addressing the accusations I’ve made against the casino instead of focusing on perceived problems from my perspective. I’d be more than happy to consider your points if you could provide solid evidence proving I’m strictly wrong, but you can’t. You’re not from Switzerland. You are from or live in Japan. Unless you’ve taken the time to thoroughly read through the entire GSG or OR that applies to this case and truly understand the regulations, your arguments hold little weight in this discussion. I encourage you to come back with concrete information that could debunk my case. However, that’s unlikely to happen because I have a valid case against Stake, one that will be proven in court. You’re just like the casino—citing the Terms of Service and nothing else. That might hold up in a forum discussion, but it won’t carry any weight in a civil lawsuit, my friend. Citing the ToS, like you or the casino do, has no impact on anything—it’s just empty words. Here’s the link to the relevant article that makes their ToS non-legally binding: https://www.fedlex.admin.ch/eli/cc/27/317_321_377/de#part_1/tit_1/chap_3. Art. 62 to be exact. As a result, any reference to their ToS is just pointless at this stage. There is no legal contract between me and Stake from the moment I registered to the moment my account was blocked. What’s truly surprising is that even Stake hasn’t managed to provide more than two sentences explaining their standpoint or justifying why they believe they’re in the right. Instead, they simply avoid the issue altogether. Just like your reliance on their ToS, this approach will have zero impact on the actual situation. If you have anything worth of mentioning, that isn't just a pointless accusations based on information you've just read, please do so. I can't wait for you to make a point that really shuts down my whole case Mr. wannabe Harvey Specter

Here's a concise summary of what happened based on the information OP has provided (OP feel free to correct any parts that are wrong): 1. OP used a VPN to bypass Stake's jurisdiction blocking, created an account & deposited funds. 2. They provided KYC information indicating they were a resident of Switzerland. 3. They proceeded to lose a considerable sum of money. 4. They responded to a bonus offer that required completing a new stage of KYC. 5. Upon review of Level 2 KYC materials, their account was suspended. 6. They are now seeking a recovery of 75% of their losses, or $30,000. Per Stake's Terms of Service: JURISDICTIONS
14.3 Persons located in or reside in Afghanistan, Austria, Australia, Belgium, Brazil, Colombia, Côte d'Ivoire, Cuba, Curaçao, Czech Republic, Cyprus, Democratic Republic of the Congo, Denmark, France, Germany, Greece, Iran, Iraq, Israel, Italy, Liberia, Libya, Lithuania, Malta, Netherlands, North Korea, Ontario, Peru, Poland, Portugal, Serbia, Slovakia, South Africa, South Sudan, Spain, Sudan, Syria, Sweden, Switzerland, United Kingdom, United States, Zimbabwe (the "Prohibited Jurisdictions") are not permitted make use of the Service. Even before an account could be created ( couldn't be created if no VPN was involved), Stake is letting users know they don't allow players from restricted jurisdictions. Also from the ToS, which pops up during the account registration process: b) Residing in jurisdictions from where it is illegal or gambling is not permitted. Stake is not able to verify the legality of the Service in each jurisdiction and it is the User's responsibility to ensure that their use of the Service is lawful and Jurisdiction
e) You are accessing stake.com from a jurisdiction in which it is legal to do so;
f) You will not use our services while located in any jurisdiction that prohibits the placing and/or accepting of bets online and/or playing casino and/or live games;
g) You accept and acknowledge that we reserve the right to detect and prevent the use of prohibited techniques, including but not limited to fraudulent transaction detection, automated registration and signup, gameplay and screen capture techniques. These steps may include, but are not limited to, examination of Players device properties, detection of geo-location and IP masking, transactions and blockchain analysis Additionally, OP admitted to using a VPN when registering with the site: 14.4 The attempt to manipulate your real location through the use of VPN, proxy, or similar services or through the provision of incorrect or misleading information about your place of residence, with the intent to circumvent geo-blocking or jurisdiction restrictions, constitutes a breach of Clause 5 of this Terms of Service. Seems to me they have covered themselves pretty well here. If you disagree - and as I've said before - you're gonna need to get a lawyer involved, and its weird to think we as forum members actually have any say in the matter. If you're looking for public sympathy, you'll not find it here. For the record, I don't even like Stake 🤷♂️ but when you created an account, you implicitly agreed to abide by their terms of service, and then failed to do so.

Wow, thanks for your actual informative reply based on my original post. Most of what you say might seem logical in terms of ToS, but like I said, the ToS doesn’t count here for the obvious reason that Stake can’t bind a legal contract with me. Based on that, there is no ToS they could legally refer to in this case. From a player’s standpoint, this might seem absurd, but keep in mind: had I won 100 grand or more, the casino would say the EXACT same thing, citing the law to avoid paying out winnings because there was never a valid contract in the first place. (Net losses, however, still count.) You’re really the only one suggesting that if I disagree with these points, I should consult a lawyer, which makes you seem like the only one approaching this case rather neutrally—and for that, I thank you. The lawyer part has already been taken care of; I’m just waiting on responses from the ESBK at this point.

Just a Heads up to a GDPR Request for Stake.com Obviously just to safe some time and make it a hassle. https://ibb.co/ccPfnSQ6So these sickheads false and misleading claim that the address for their fake "Data Protection Office" is at Korporaalweg 10 in Wilhelmstad on the cosy Island Curacao! In reality, Medium Rare N.V. is a shell company without office space and staff! Since over 3 months even not in possession of an online casino license!
