I posted this because I know the tariff can affect the price of bitcoin but for short period of time as bitcoin showed us how good it is an asset after there was a pause on the tariff for 90 days.

The international court now as said Trump did not have the power to impose tariff on many countries, that he overstepped his authority.

A US federal court has ruled that President Donald Trump overstepped his authority by imposing global tariffs, in a major blow to a key part of his economic policies.

The Court of International Trade ruled that an emergency law invoked by the White House does not provide unilateral authority to impose tariffs on nearly every country.

The Manhattan-based court said the US Constitution gives Congress exclusive powers to regulate commerce with other nations and this is not superseded by the president's remit to safeguard the economy.

The news will be updated and we are going know more about what will happen. It will be good if Trump's power is reduced with this and not have power to impose tax on countries which could likely be an end to this tariff that wants to destabilize the global trade.

Although Trump helped but we do not like the way he is handling the Tariff as stocks fell so much in price and bitcoin was also part of what that fell in price at the time but bitcoin proved to be a good asset and got to all time high after the pause.

One thing with politicians is that, they know the law and can twist it to favor their policies at whatever extent that can fulfill their political needs, the Trump administration have being prompt in tax and tarrifs lately and at that we need to be clear with whatever exactions we bring in as discussion on this subject matter, since in recent time we have seen how politicians often act against the law, making the whole thing to look as if the law is made only for the citizens and not government exposed person's and their policies in office.

the section they invoked(wrongly) is this:
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur;

here is the thing though
the US president has the power to do the negotiations and trade deals and set policy/numbers, but whats most notable is these things are not codified laws of treaties. but temporary trade policy/transactions, thus dont need senate vote

when it comes to finalising trade deals into longeterm fixed law(treaties).. then the senators need to be involved

whereby the US SENATE* has to give advice and consent, meaning senators can have a say on whether things move forward via a vote (2/3rds to approve)

*some media say its congress that vote.. but its just senators, not congressmen/full congress

further insight
In the ruling, a three-judge panel said the International Emergency Economic Powers Act (IEEPA), a 1977 law that Trump cited to justify the tariffs, does not give him the power to impose the sweeping them.

The International Emergency Economic Powers Act (IEEPA) provides the President broad authority to regulate a variety of economic transactions following a declaration of national emergency. IEEPA, like the Trading with the Enemy Act (TWEA) from which it branched, sits at the center of the modern U.S. sanctions regime. Changes in the use of IEEPA powers since the act's enactment in 1977 have caused some to question whether the statute's oversight provisions are robust enough given the sweeping economic powers it confers upon the President during a declared emergency.

Over the course of the twentieth century, Congress delegated increasing amounts of emergency power to the President by statute. TWEA was one such statute. Congress passed TWEA in 1917 to regulate international transactions with enemy powers following the U.S. entry into the First World War. Congress expanded the act during the 1930s to allow the President to declare a national emergency in times of peace and assume sweeping powers over both domestic and international transactions. Between 1945 and the early 1970s, TWEA became the central means to impose sanctions as part of U.S. Cold War strategy. Presidents used TWEA to block international financial transactions, seize U.S.-based assets held by foreign nationals, restrict exports, modify regulations to deter the hoarding of gold, limit foreign direct investment in U.S. companies, and impose tariffs on all imports into the United States.

It's a good thing that the president doesn't have limitless power in times of peace, after all - America is a republic and does not bow to a king. The fact that Trump had to use emergency laws created in 1977 and barely used, shows that he is using manipulative work arounds and abusing his authority. Tariffs, aka taxes, on the American people should be scrutinized by the House and Senate so state representatives get to have their say on the topic. The changes he made had a massive impact on trade relationships and trust in the USA and these judges are simply laying down the law that should be obvious to senior politicians like Trump.

Trying to side step or short circuit all the laws that were put in place over decades is a dirty tactic. It's good to see some sort of normality be enforced by the judicial branch which helps every American citizen. In the US it is not rule by decree and executive orders should not be used for everything.

For those who do not support Trump's tariff war, this is great news because the US trade court has blocked Trump's aggressive actions. But as far as I know, the US trade court is only considered a lower federal court, which means they can block Trump's tariff order. But they won't have sole discretion on that issue, Trump could appeal to the US Supreme Court to overturn the decision. And he will certainly do so soon, so we should not rejoice until the Supreme Court makes its final decision.

That was really an overreaction of Trump as one of the subjects he stepped on at his immediate time of resuming office as the US president.
He was not don't with the deportation of immigrants while paying deaf ears to what they were contributing on the basis of revenues and the facilitations of job delivery.
Then he came with the tarrif plans which has affected the globe and even the decentralized markets where investors are encountered with economy downfalls. I hope the judiciary don't even give him a break because he acts as tyrant at the upmost short period he had been in the office.

The final decision on trade tariffs in the settlement is certainly what is awaited from the Supreme Court. Because Trump did not hear opinions or immediately raised trade tariffs without communicating with the US trade court first, and the court voiced objections to the tariffs because some of them could harm the US economy, but on the other hand Trump also has reasons that are no less important for the progress of the US in the future. However, for the next situation, we will see what will happen.

The Trump administration has appealed that court ruling and as i read in the news, they are ready to to fight it, even Trump's deputy chief of staff referred to the verdict as a "Judicial Coup". We'll see how things pan out and if this ruling will stand, or if it will head over to the Supreme Court, where the final ruling will be delivered.

IIRC, Trump once said that he took this drastic decisions as it was a "National Emergency", is that him agreeing that congress has to be involved in tariff implementation? But he skipped that part because he wanted to act fast.

You are right about Trump having the freedom to approach the Supreme Court to repeal this judgement but until then let there be some calmness in the economy because these tariffs are beginning to lose their effect as most people no longer fear them instead they respond with counter tariff and turn the whole thing to a joke. slamming tariff on everyone in an undiplomatic way will only make things worse for the average American consumer no matter the long term benefit it holds. This judgement is an opportunity for Trump and his team to work out a strategy with which they can negotiate fair deals with other nations instead of thinking that unilateral tariff hikes is obtainable in this age and time.

For those who do not support Trump's tariff war, this is great news because the US trade court has blocked Trump's aggressive actions.

Trump's tariff wars has been unnecessary and so far hasn't been beneficial(at least to the general public) and I really don't see why anyone would actually support these policies. It's no wonder it has been rightly dubbed TACO trade.

I once thought Trump doesn't fully understand the consequences of what he spews out concerning tariffs and international trade, but after posting on his truth social about how it's a great time to buy before revising his tariffs, it's became clear that he does understand at the very least, how to manipulate the markets for the benefit of only a handful of people.

To see the benefits will take time, but what he is doing is right. Maybe he is not approaching the thing the best way, but that does not matter. Most people have no idea where to even look up tariff rates, they just repeat what their favorite media outlet tells them to repeat. If you take a good look at the trade deals of America, a lot of the deals are very unfair. USA has much lower tariff rates than their trade partners on the same class of goods. In this case I am not referring to some kind of goods that should probably be protected, but even in cases where the trade partner does not even produce much of the thing on which it put up high tariffs. In that case, expensive goods from the USA are not threatening the local industry. Still, they keep the tariffs high. Previous administrations have failed with these things.

The Court has given an explicit explanation of the authorities and the powers of the president and it doesn't include him giving such authority on the tariff except Congress makes such laws. The President has released a statement that he was going to appeal the judgement which i think is needles because he will still get the same results from those higher court, except he wants to buy more time for himself until it gets to the supreme court. Court rulings of this nature makes me remember the fact that the executive is not absolute with its powers, at least the court has the power to still check your excesses as executive.

His tariff of  liberation day is already cancelled I saw the news just today.  The court just save Trump from his own mess. And the tariff drama is over, maybe we are going to be seeing a bullish market after this.

Trump saying he is going  to appeal is just so he has something to say but I don't think he liked what happened to the market when he raise the tariff. It didn't go as planned.

Since this is a federal (local) court with local laws, I'm not sure how effective this is. But this is showing something interesting about the "establishment" in the US. It is deeply divided and is in direct contradiction with each part. The president says and does one thing, others do other things and it is turning into a worsening mess every day.

The colony is getting polarized more every day...

I'm wondering whether Trump will obey the court or just ignore it like what he did in the past. He knew very well how court has no enforcement power, and probably try to find another way to keep going on his way.

Also the price already skyrocketed so high, and i don't think this will reduce the price of goods to go back before the implementation of tariff by trump.

Pretty interesting to see how this is going on soon.

There are a lot of judges that are politicizes and abusing their power. Judges should be neutral and not biased towards a party, which is not the case in the USA. That is why so many things get overruled later in appeals.

Trump saying he is going  to appeal is just so he has something to say but I don't think he liked what happened to the market when he raise the tariff. It didn't go as planned.
Getting trade deals renegotiated didn't go as planned? Do you get your news from CNN?

As far as I know, power in the United States is divided into different branches and is called the separation of powers. Includes: legislative branch (Congress), executive branch (president) and judicial branch (courts, supreme court). This will cause deep internal divisions if people do not have the same vision and perspective. But it cannot be denied that it also has its advantages, just think what would happen if Trump had full power to decide everything and no one could stop him? With his impulsive personality, I even think we could enter a nuclear war under his tenure, not just a tariff war like now  Grin Grin Grin.

Snipped

The International Emergency Economic Powers Act (IEEPA) was mainly enacted as a Cold War strategy to protect the US from its enemies. However, Trump has not justified that the countries on which he had imposed these tariffs are enemies of the US. He has not proved that all of these nations pose a threat to the economy of the United States.

The court is saying that if Trump thinks that the trade deficit is a danger to the US economy, he should simply increase spending on industries and ensure that American products become competitive. If he thinks that fentanyl transported from China, Mexico, and Canada is a national emergency, combat it by protecting the borders and going after drug dealers. The court is saying that Trump is treating the right sickness with the wrong drugs. Businesses in the US are suffering because he is not fighting the war against drugs with the right approaches. Maybe the tariff on China can be justified since there is a Cold War between these nations. But how can we justify the tariffs on the EU which are strong allies of the US.

One thing is to have sweeping powers but the application of such powers can be challenged because the US is not an authoritarian nation like China.
