Gamba Casino withheld €77,675.98 of legitimate dice winnings without valid cause

Complaint Body:
On October 31, 2025, user Amigo52, placed a €27 bet on the Dice game with a 3168x multiplier and hit 99.98. The expected payout was €87,675.98 in XRP. Gamba Casino credited only €10,000, claiming a “maximum payout limit” that was never disclosed before or during the bet.

No win cap appeared in the game interface, rules, or general Terms & Conditions. The site advertises multipliers over 3000x, leading players to reasonably expect full payout. Withholding the remainder violates fair play and transparency obligations under the Anjouan Gaming License.

This is not an isolated issue. There are multiple prior cases of Gamba withholding winnings or deleting game data, including:

( $54,942.90 The player from Thailand experienced issues withdrawing winnings from Gamba Casino, which were flagged for manual review due to alleged KYC violations. Despite being a permanent resident of Thailand, the casino claimed he was from a restricted jurisdiction and subsequently closed his account, leaving him unable to communicate with support. The Complaints Team mediated the situation, ultimately confirming that the player received a total of $6,500, which had been agreed upon by both parties as a partial payout. The case was marked as resolved, with the player advised to reach out for further assistance if needed.)

He had provided the requested verification documents but was uncertain why the account remained restricted. The issue was resolved when the casino unlocked his wallet, allowing him to withdraw his winnings.)

🧾 Part 1 — Ambiguity and Lack of Disclosure (≈1,950 chars)

The Gamba Casino Terms & Conditions are ambiguous and unfair because they do not clearly disclose a maximum payout limit applicable to games such as dice. The platform displays multipliers up to 3168x, which reasonably leads a player to expect the full payout when the target number is hit. However, after a legitimate €87,675.98 win, the casino limited payment to €10,000 citing a hidden “maximum win cap” not visible or referenced prior to the bet.

Under the principle of contra proferentem, ambiguity in consumer contracts is interpreted against the drafter. In this case, the absence of any disclosed win cap or visible game rule makes it impossible for the player to have consented knowingly to a limitation of winnings.

This omission also constitutes misrepresentation by omission, as the operator’s interface suggested a payout of 3168x while withholding a material fact — the existence of a hidden ceiling. Such conduct breaches international fair-play and transparency obligations recognized by regulators including the UKGC, Malta Gaming Authority, and Anjouan Gaming Commission, all of which require that payout limits be clearly displayed before gameplay begins.

Therefore, the €10,000 cap is unenforceable because the player relied on the multiplier representation when placing the bet. Any limitation not disclosed in advance violates the doctrine of informed consent, and enforcement of such a hidden clause is contrary to basic gaming fairness standards and consumer protection norms.

🧾 Part 2 — Unfair Discretion and Regulatory Non-Compliance (≈1,970 chars)

The casino’s Terms & Conditions further undermine fairness by granting the operator unlimited discretion to withhold, void, or limit winnings at any time without providing objective standards or evidence. Clauses stating that the operator may “adjust or refuse payouts” at its “sole discretion” create a one-sided relationship that violates EU Directive 93/13/EEC on Unfair Contract Terms and parallel consumer-protection principles under the Anjouan Gaming License Code of Conduct.

In addition, the T&C fail to specify a definite governing jurisdiction or dispute venue, instead vaguely referring to “the jurisdiction where Gamba operates.” This lack of precision prevents players from understanding their legal rights and makes the agreement void for uncertainty under general contract law.

The inclusion of a unilateral modification clause allowing Gamba to “amend these terms at any time with immediate effect” is also inherently unfair, as it removes the requirement of mutual consent. Such provisions are considered invalid in most gaming and consumer jurisdictions, since they allow retroactive rule changes affecting prior bets.

Combined, these clauses demonstrate a pattern of ambiguous, inconsistent, and discretionary enforcement contrary to fair-gaming obligations under the Anjouan license framework. Applying basic principles of contract interpretation, any unclear or unfair term must be read narrowly in favor of the player. Consequently, the hidden €10,000 limit cannot override the clear 3168x multiplier offer presented at the time of the bet, and the full payout of €87,675.98 remains due.

These incidents show a recurring pattern of selective nonpayment and poor transparency. There are reports the casino also removed affiliates and withheld funds spent by a partner of theirs, more than 100 active players with substantial vip status.
