Casino ban after TOS violation: can they freeze your deposit too?

If you deposit in a casino and later they say you violated the TOS and ban your account, is it fair or even allowed for them to freeze your funds if most of it is just your deposit, not winnings? I get confiscating winnings in case of abuse, but keeping the original deposit as well feels questionable.

If it's just a deposit and you have not won at all or benefited from the casino, then they are not supposed to seize your fund; they should return it back to you and close your account forever depending on how strong the rules broken are.

Another thing again is having the person check the casino TOS and what their punishment for breaking it looks like, or they just pop up and decide to confiscate your deposit. If it's part of their rules, then it's a legal way of stealing, but if it's not and you are sure you have not benefited from the casino, then they are shady.

If the person won but the casino ban the person's account, the person also supposed to be given back the money that he deposited. If the casino takes the money, that is not appropriate. I have seen cases like this before that the casino gave back the person his money because he is gambling from a restricted country. I do not know much about if the person is using multiple accounts to cheat.

@Nwada001, I may be biased on what I posted because if the gambler violates the casino rules like cheating or the use of VPN, the gambling site have the right not to give the money back to the gambler.

I’m not really sure what the exact rules are, but I think they usually look at the overall profitability of the account. If the player is already profitable, there’s a chance the casino will take back the funds, including the winnings, since they might just treat it as offsetting profits.

For new accounts though, especially ones that aren’t profitable yet, I think the original deposit should be returned. But then again, that’s just my assumption. In the end, licensed casinos are supposed to follow what regulators allow, so if the rules say they can keep it, then legally they’re covered.

From previous cases I have seen, where the user hasn’t really gotten anything from the gambling site and then got banned by the site for suspicious behavior, after he took the matter to casinoguru they were able to get the site to agree to pay the user the deposit back.

While in another case a bit different from your question, this specific user played and won some good money but then got restricted by the casino for violating the ToS and what happened was that the site agreed to allow him withdraw his initial deposit while they took away all the money he won from it and that is how it’s supposed to be, if you haven’t won or withdrawn from the site before but in situations where you’re in the profit zone the site will most likely seized the fund and use it as a for of repayment for previous withdrawals since they already considered all of your activities in the site as a shady move.

Most of the casinos will take your money if you are found violating their TOS. The few cases I have seen where casinos ban users for TOS violation, they activate the ban when deposit have already been made and in some cases, the player have already won big and wanted to make withdrawals. I think the reason they do this in most cases, is to inflict a form of punishment to the player to serve as deterrent to others.

I have seen cases like the one you described above before. I have also seen cases where the casino freezes both the winning and deposited amounts of a player with their reason that the player has abused the system and benefited from it before, which has been withdrawn out, and the confiscated amount is being considered as a means of recovery from the loss they have suffered at the player's hand, which is what I was indirectly referring to when I talked about the user benefiting from the casino.

For cases as this your deposits should be safeguard and not tampered with cause it's nothing associated to a win but if the casino tends not to give it back like having problem refunding the funds after the violation, then there's must be a medium to act fast. But it's so wrong for the casino to hold back ones money after issuing a ban which is why the initial deposit must be intact while they undergo the process of a ban on the individual account.

Depositing any kind of black money into a casino can result in the casino freezing it due to anti-money laundering laws, but if the casino blocks your funds for no other reason, then there is a high chance that the casino is a scammer.

I think it varies from casino to casino. Most casinos will return the money to you, whether you played a game and won in the casino or you just deposited it. While some casinos will instantly freeze the account. A friend of mine had a similar situation in a random casino. After speaking with the casino customer support, they refused to allow his withrawal. The next day, the account was inaccessible. Before making use of any casino, make sure you check their terms and conditions, and make sure you don’t violate any of the casino terms and conditions. If you violate the terms and conditions, then the casino are going to take everything in the account, they don’t care if all is deposits, or you have been able to win before, so to avoid things like this, then don’t violate any rules when making use of a casino.

I feel when casinos notice that most of the money is just deposit, then they should allow the user withdraw their money, but they won’t allow that, they going to take advantage of the rules which you violated, and they going to freeze everything.

This is actually a very important discussion since it happens all the time here. I’ve seen a lot of scam accusations related to this, where a user gets caught violating some part of the TOS, whatever it is, the account gets closed and the funds are confiscated as well. Sometimes casinos start acting like they’re the government, but they shouldn’t, especially if the violation doesn’t logically warrant confiscation. Even if the person has not used the money to gamble, or the person have gambled but have not won money before but won and want to withdraw the money, the gambling site rightfully owns the money and legally do not need to give the money back to the person. What that is very important is that people not to violate the rules of the gambling site.

I have not had related violating of TOS before but I am to believe that no casino will refund such users over their own faults. Maybe you don't even know that the casino is a tax force place where gamblers and the Casinos are out to who would outshine each other.

You know when you aware that you did not violate the casino TOS maybe on your win or processing of withdrawal criterias but the casino tend to use some unwarranted means to penalize you for no cause of action and you can fight them legally to get back your funds, so you should not even expect a recovery or returns of your funds when you also also caught red handed violating the casino TOS.

Definitely you will have no legal backup to claim your right after breaking the rules which after banning your account automatically denies you access to your account if not (account is freezed)

Well, in that case we’re basically blind to what’s really happening. What if they’re just using their TOS as a shield and suddenly slap the gambler with a violation notice, account closed, funds confiscated, bye bye. That’s exactly the concern here. I think what we really need is transparency, not necessarily the full agreement between the casino and their license provider, but at least a clearer picture of where the funds will go. Someone should be able to explain that properly, the question is, who can really provide it?

The problem with fighting casinos legally is that it’s not always practical for gamblers. Hiring a lawyer is expensive, especially when the potential winnings are smaller than what you’d spend on legal fees. That’s why most gamblers who believe they were scammed, and who honestly think they didn’t violate any TOS, usually end up posting their case here in the scam accusations section. It’s often the most effective way to push casinos to do the right thing, especially if the evidence is clear and the issue could damage their reputation.

Personally, I only use casinos that have an ANN thread here, because at least I know there’s a community that can help if I ever run into issues.

Honestly, I heard some people were banned due to TOS, but they don't know exactly what the reason is because most of the casino that I heard of choose to be silent instead of giving the information about which of the TOS breaks.
For me to be fair, the casino should provide the reason or the cause why they banned and froze the amount they deposited. To be fair, it depends on which one that customer breaks from the TOS or rules. If the funds are tainted and these funds that the customer deposits are detected as stolen, then I might agree that this is not refundable until the owner provides documents and history that these funds are his/her own coins. It's just an example that customers' funds will be frozen forever until the customers provide evidence that s/he owns the funds. However, if this is not related to any of these and the cause of the ban is due to other things, like you ban because you have multiple accounts, it's not fair if they froze your account because there are times that the owner forgot that he already had an account from the casino. The fair approach here is that they should release the amount except the winning amount.

If you want to clarify on this matter, much better to ask their support about what they will do with your deposit funds. Because the action needed may already have laid out in their terms and you just need to read it. But if this is not very clear to you, better ask the site itself. So you won't conclude on your own.

Like I will always say, most casinos are always on the look out for opportunities to confiscate users funds, in a situation where a user hasn't won any thing from the casino but some how has to face a ban from the casino for the user breaking the casino's TOS, the normal and moral thing for the casino to do is return the user's deposit and close his or her account permanently if what he or she has done deserve such a punishment, but some casinos we have around today that don't care about morals will ban a user and still go ahead to confiscate their deposit, this is something or an act I refer to as stealing in broad day light..

So, when a casinos terms of service is broken, normally they will freeze the account including the funds in it, but after back and forth argument, if they can't unfreeze the account and going for a permanent ban, they don't have any justifiable reason to keep the users deposit as their own, else, they are nothing but thieves, scammers disguised as the management of the casino in question.
