Pokemon can categorize a company as royalty-free fan art. I don't know about discopacks, even if they're offering spectacular raffle prizes worth hundreds of thousands of dollars. They might have to apply for a license if their business reaches millions of dollars and Pokemon considers them a profitable partner, not just a client.
But then you have this last clause, and in the case of Discopacks, it is surely commercial use.
In no uncertain terms, does Pokémon's use of Fan Art constitute a grant to Fan Art's creator to use the Pokémon intellectual property or Fan Art beyond a personal, noncommercial home use.
I'm not sure if we can classify this as a fan art though, since there is no fan art.

Although the retro neon purple and black theme may not seem new, DiscoPacks.com is a different platform all about the packs of TCG collection. We want to keep the experience enjoyable and fulfilling and we are considering the idea of providing literal card prizes at some time in the future. In the case of Pokemon-like packs, we adhere to the copyright laws and are considering appropriate licensing. Such feedback allows us to grow and develop in a responsible manner. So there are no actual cards ready to be claimed? this can cause a huge misunderstanding IMO. The team should just remove it. If there are no actual cards on-hand, why not just put money instead?
