Has anyone fought the seizure of their Mt gox rehabilitation bitcoin payment that was held on kraken? My coins were seized from kraken and I’m going to get an attorney to fight it. Does anyone know good attorneys for this case? They didn’t seize the cash rehabilitation payment I received in my bank account. Below is the email I received from HsiNyCyber

“ Hello,

 

The U.S. Government has seized funds from your Kraken account that were paid by the Mt Gox rehabilitation trustee and intends to seek forfeiture of these funds in the United States District Court for the Southern District of New York. Please respond to this email with your intentions regarding filing a claim for these funds.

 

Thank you,” September 19, 2025

Here is what kraken support said

“ Hello,

Thank you for reaching out to Kraken Support! My name is JR.
 
You will need to contact HSINYCyber, and you can contact them at hsinycyber@hsi.dhs.gov

Haven't you heard about the US crypto strategic reserves? All cryptocurrencies held in custodial storage can be seized at any time. Why didn't you use a non-custodial wallet - was that an option?

I honestly don't know why the seizure occurred, but it occurs to me that those funds were indeed problematic (tainted coins) or that your account itself is problematic, including all the funds in it. In any case, good luck if you go into legal battle.

It was required to have the bankruptcy settlement go into kraken. They seized the coins not long after I got them

What the absolute fuck.

Doesn't Trump's DOJ realize that they're only going to spread fear if they seize people's rightfully owned bitcoin from exchanges?

I'm distraught by how easily Kraken would be willing to just hand over these coins while not even being domiciled in the US... What's even the justification for seizing coins after a foreign court settled the proceedings of a bankruptcy?

I'm not one of those who had the misfortune to be part of that hack and the whole circus that followed, but if the condition was that the coins be paid out on CEXs, then it's the latest in a series of stupid things the Japanese have done in the more than 10 years it took them to solve the case.

I don't know what the amount is in your case, but if I assume you have reason to fight a legal battle. It's best to seek advice from a local lawyer to get started, and to be very careful when it comes to various online lawyers, there are a lot of scammers out there who are just looking for an opportunity to take your money and do nothing.

Kraken was only officially appointed to this rehabilitation agreement, so I don't think they can resist. It sounds incredibly stupid but that's the point, custody services are ideal for managing refunds without losing full control. Essentially, they simply hand over the restitution process to the user-based authorities, a full refund won't occur until authorities allow customers to withdraw to their personal wallets.

Agree here, people who offer unsolicited, should always be avoided  Undecided

Sorry if this is not excactly on topic but I got myself thinking,,, is there any lawyer at all that can be specifically helpful with crypto cases worldwide? US is quite common I believe but for the rest of us with issues like this I wonder how the process is, especially for normal people who cannot afford things like retainer fees.
