The thing is, you could claim that it was a legit gift card, but possibility is that you could give me a bogus card with nothing on it. It's happened to me before

You could easily tell escrow that you have provided me with your end of the deal, and I have no way to prove that card was empty. and you could still easily have my bitcoins released to you so I'm hesitant to do that.

A good escrow won't do this...just spend the Visa Gift Card and after tell your escrow to release the funds...easy.
