A man in the US sues DraftKings (a sportsbook) after claiming that the sportsbook led him to gamble away millions of dollars. According to the article, the attorney the guy hired claims that the sportsbook VIP hosts bombarded the guy with calls, emails and other forms of communication, which contributed to his growing addiction, which ultimately led him to gamble the money he saved for his wedding and took out loans to feed his gambling addiction.
If while gambling you're not ready to take full responsibility of your loses, then don't gamble to even start with. No matter how a casino pushes Thier platform to you, you have the final say as to decide whether to gamble or not. no casino has the ability to force you into gambling with them and it's believed generally that you've read Thier terms of service and agreed to it before use Which clearly states that you should gamble in a responsible manner. Anything outside of this doesn't hold any ground before no gambling platform will force you to gamble with the wedding funds.

It's the height of irresponsibility if you will even allow it cross your mind the thought of gambling with your weeding funds. Shame should not allow you push for such case to even start with.

Laughable that cold-calling possible customers is now going to be considered a crime if the courts actually takes the side of the gambler who lost control, and who might actually be a gambling addict.

Plus the title actually made me laugh. The fiancé should probably leave him because the man already showed a serious problematic side of him.

Well, some people are really susceptible to gambling addiction. I was also "bombarded" with emails and TV ads about sports betting in the past, but this didn't cause any rampant gambling addiction and it didn't made me wanna spend my life savings at the casino/sportsbook.
Is it really that difficult to unsubscribe from the Draftkings email newsletters and to block all phone calls coming from Draftkings? I don't think so. Unsubscribing from marketing email lists and phone calls is really easy, but that guy was out of control with his addiction. I have doubts that the judge would decide the case in favor of the gambling addict.

The casino calls and proposals part is not clear to me, a casino can influence by advertising but not by calling a customer.
The first time I hear something like this, and the first time he refused self-exclusion, it's really not a very clear story, and besides, why is the character in question suing the casino? What would be the reason if he himself rejected self-exclusion the first time?
It's sad to read these stories, but kids, making mistakes is human, but persevering is diabolical, so those who cause their own ills can't blame others. First, you have to protect yourself to be happy with others.
I don't condone or condemn any of this player's behavior, he just doesn't have to play.

I don't have my personal bookmarks right now but it was last year when there was a landmark case where a casino lost in court over something similar in the US.

This guy had an addiction. Actually stopped gambling but they kept pulling him back in AND actually he ended up losing so much money he was stealing from his family and job. The case was actually sensible. The casino even knew what his income was, and knew he was losing way more than his income, and still went for him for every penny.

I will try to remember to post again here about it. I hope all casinos will get punished for leading people down destruction.

Nice try for him to sue the sportbook. he own the consequence over his choice. So he has to blame himself why he decided to gamble with the money that would be used for his wedding.
Using draftking product when he knew it's addictive, then he sued them after he got addicted. This is beyond my imagination. He should accountable for himself even before he decided to gamble.

According to the article, the attorney the guy hired claims that the sportsbook VIP hosts bombarded the guy with calls, emails and other forms of communication...

What's your view on this?

We don't have to answer every time someone calls... In this case, if a VIP host calls, simply don't answer. We live in modern times, we can block calls & emails. It's easy to do it, or I just think it's easy...

All addiction stories are pretty much the same... first they gamble with money they have, then they start borrowing or stealing money to gamble, and when there's no money left, they start blaming everyone because they lost. That's the bottom, and somehow they weren't aware of their actions until they hit that bottom?

Quote
“He’s in recovery, and has been now for many months,” Flaherty said of Miller. “He’s working on his family, he has regained employment, but all of those things took time to repair. It’s an ongoing process.”

It's a process... when we make a mess, it's responsible to suck it up and make things right without blaming others.

This is completely the guy’s fault, I would say. A bookmaker’s job is to attract gamblers to its site, and they might do anything and everything to bring in more customers. So, suing the bookmaker isn’t the solution being suggested here.

The gambler himself lost control of his willpower. He let his addiction take over everything. He was the one who gambled everything in the hope of winning, and he was also the one who declined the self-exclusion option when it was offered. So why is the bookmaker being made the main culprit here?

I don’t support bookmakers, but in this case, the gambler isn’t entirely in the right either.

Both the man and the casino should be held accountable.

The man should not get his money back because it was his choice to gamble. But the casino should not get off scott free for molesting him with such excessive spamming. I mean, what kind of business calls their customers just to advertise to them? That is extremely excessive. At some point it should be illegal to advertise so agressively. And it probably is.

Although that does raise the question of why they had his number in the first place.

But even if here are excessive spamming, you can block it out if you have priorities in life, like in this case, it's his wedding and the money he said for that big event in his life. However, he succumb to the temptations.

So as much as we blame the casino, the man should have the responsibility to think right and not be falling for the trick of casinos. Because if it is, then by now we can hear all this cases against casino putting blame of every gamblers for ruining their lives.

Can we even sue the gambling platform for our own personal negligence to gambling, they are not forcing us to stake a bet, they don't even want to know the source to the fund we are using for betting, every Gambler is expected to be more responsible for himself as he gambles, self control and discipline will make it very much possible that we control our emotions in gambling and as well avoid diverting funds to gamble.

lol, I laugh whenever I see stories like this. Like what exactly does he mean by the betting company led him into gambling away millions of dollars, including money he’s saved up for his wedding? I’m still trying to wrap my head around how he was led into doing so, like was he pushed into making those bets? Or was he promised a win before he made those bets? Such lawsuits are literally just like punching the air because nothing is coming out from it, he should simply just accept the consequences of his foolishness and hopefully he’ll be able to learn from it.

There is no statement about how the case was settled in the content of the report, which I could have found very interesting to see how the judge handling the case ruled on it.

The guy might be the one making all the bets and spending the money, but we should not also undermine the role of some offers when it comes directly through phone calls on a regular basis.

Not everyone can be able to handle that, especially when the person is already on an addiction stage, so the sportsbook should take responsibility for some of his losses to some extent too.

The reason why gambling is for adult is that they should take responsibility for their actions. Getting calls, emails and other follow-up measures is not an excuse for his addiction. A single click of an ad link usually leads to follow-up by company representatives who want to ensure that you buy or subscribe to a service.

He would have had a good case if he had requested self-exclusion of DraftKings and it was not implemented. Until he proves that the gambling platform fraudulently influenced him to keep gambling, I don't think he would win the case.

Both the guy and the sportbook are wrong. The guy has the blame for thinking he can win millions from gambling and throw a big wedding party because that was why he gambled with money for his wedding. On the other hand, the casino also went far to lure him into feeding his gambling addiction by calling him to continue gambling which is wrong. It's clear they were after his money regardless of what happens to him.

players with those amounts know the risks of gambling. anyway a marriage in great style Smiley
unless I can see all arguments related the case I would find pretty opinable "have opinions".
Both parties for sure have done their issue. exploiting self exclusion can be seen irrationale but has been in some cases a deliberated option by players. Of course "vip host" must be regulated in a certain way... adopt a code of conduct.

I don’t dispute the fact that the gambler should be responsible for his action; as adults we should know right and wrong, and whatever decision we make should be on us, but let’s look at it this way: if I run a big fun house somewhere at the corner of the city and alcoholic drinks are adult play, my major business, you as my customer are already getting addicted to all of this, and it’s costing you money. You decided to take a break.

But when my company noticed they have not been seeing you around, with no payment record showing your name, etc., we dedicated a few team members to be checking up on you and given you offers like, 'As one of our regular customers, the company prepared a $1m cash prize for one of our lucky customers, a trip to a certain country,' etc. All of those tempting offers, and eventually the talk gets to you while you try not only to chase the fun and what you usually come there for, but now you are targeting something else which has been planted in your head. You eventually lose even more money than you have lost before. Do you think in such a situation my company is entirely innocent?

Quote
He would have had a good case if he had requested self-exclusion of DraftKings and it was not implemented. Until he proves that the gambling platform fraudulently influenced him to keep gambling, I don't think he would win the case.

From what I read and understood from the story, the case had already ended. How it was concluded was not added to the article; the guy recovered, later went back to drafting a play, and finally decided to self-exclude himself.

Addiction has always been the problem but some gamblers are not conscious to understand the damages they are doing to themselves.
They will continue to gamble even when people are advising them to stop gambling. The casino can be blamed on some certain aspects for not restricting the gambler from betting too frequently. They will have to refund part of the loses the gambler had incurred to make peace.

But the affected person is the one to be blame on the situation he's currently experiencing.

Since even if the casino or one of their representatives calls him and he refused to gamble despite of being offered of great bonuses then also rewards for sure there's nothing bad will happen to him.

If he's in right mind for sure that he won't use his wedding funds to gamble. But he choose to be an evil and tried to be greedy hoping that he can earn more bigger rewards. This is why shit happens and he got blow up badly. If I am his partner I will immediately broke up with him/her because that shows sign of irresponsibility.

If am not overthinking, the man should be an adult and has the mental capability of thinking and deciding for himself so why are we trying to make up a big deal out of it. He should go and rest because he should be blamed and not the other way round. Maybe he's only trying to show off instead of hiding in shame because I'm sure the platform in question will make him spend even the little he has and I'm also sure he will later regret his actions after he might have already run dry financially.

Personal responsibility is important factor, but extremely trap like design in company VIP hosting models is not something that can be overlooked, particularly because user actively rejected first steps of family interventions. Sportsbooks know exactly how to use big data and are using complex math based systems to locate and target confused and distressed, high volume players. When person is given luxury gifts after just cashing out his or her life savings, it is not just aggressive marketing, it is organized exploitation. Idea that these are just individual addictions to behaviour is to miss point completely, when these 'drugs' are clearly designed to abuse brain reward loops, to keep players addicted to their behaviour and to work out for company to get most player lifetime value.
