Advice - Legality of selling crypto for fiat on a small scale (USA)

Hello all,

I am testing the viability of a small business model where I exchange paper wallets preloaded with a small sum (<$100) for fiat currency, largely to people less knowledgeable about bitcoin who would like a small investment as a novelty. There are other details about this product beyond being a simple piece of paper, but they are not relevant to the question. (I know paper wallets are outdated and often insecure, but a proper hardware cold wallet is cost prohibitive, and the small sums make the risk acceptable)

I would like to know the legal hurdles for such a business in order to be completely legitimate and regulated. I know the major exchanges require kyc verification to prevent money laundering etc, does that only apply to large sums being transferred? Is there a limit to how much you can buy per transaction without kyc? I believe kyc would be prohibitive for this business model.

To be clear, I dont mind using my identity to purchase the coins and pay the appropriate taxes, am I just asking about distributing it.

I am located in WV currently, but wouldn't mind registering in another state if there are issues with local laws.

It'd be a good idea to find someone else doing it imo or find someone in person that could advise on the money laundering standpoint. Depending on local laws there's probably a limit on his many times you can sell to someone without doing some sort of kyc/aml stuff.

We've got members from the US and wait until they come to this thread and give you what they think of it. But they might be from different states.

What I can advise is to find the groups or communities in your local a crypto community if that information by permitbystate is not enough. I think that there will be some or at least one of it. Find the closest one in your area, it will take some time but maybe you'll find it.

Or else it will end up consulting a lawyer or tax expert in West Virginia for better compliance. Just take time to scroll around in your state if you've got some errands to do.

We've already seen even more than 10 years ago people actually get charged in court for this, which is why even in P2P platforms before you would never see US people (of course unless they were doing it quietly on the side or through DEX p2p).

In US as long as you are exchanging that paper wallet for fiat cash, you need to have a license as a money transmitter. I don't know if this is for ALL states but pretty sure it covers everything. Some places like NY even require specific license (like the famous BitLicense).
