I've been following the CLARITY Act a bit more lately and I think this is one of those things that could be important for crypto, but probably not for the reason people expect. A lot of the discussion is about whether Bitcoin will pump if the bill passes, but honestly I don't think that's the main point. The bigger problem in the US has been the uncertainty around who is actually responsible for crypto, the SEC or the CFTC. The two agencies have already started giving clearer guidance this year, but legislation would make the rules more permanent instead of relying only on regulators changing their approach. The interesting part is what happens to the companies building in the US. If the rules become easier to understand, I could see more startups, exchanges and investors being willing to stay in the US instead of looking for another country. The SEC itself has said that clearer rules could reduce costs and encourage more activity and innovation in the US. The next big test is the Senate vote expected on September 15. But this is important — it's not the final vote to make CLARITY law. It's a procedural vote that needs 60 votes to move the bill forward. Even if it passes that stage, there is still more work before anything becomes law. This is where I think things get interesting. If the vote goes through, I don't expect BTC to suddenly go +20% just because of the news. But it could be a positive signal for the whole US crypto industry. If it fails or gets pushed back again, Bitcoin will probably survive just fine, but companies might not want to keep waiting forever. Senator Lummis has even warned that if the bill doesn't pass in the current Congress, the next serious opportunity could be years away. That's obviously a political prediction, not something guaranteed, but it shows how much pressure there is around getting this done now. Personally, I'm more interested in the long-term effect than the short-term BTC price. Clear rules are boring, but boring might actually be exactly what crypto needs at this stage. Definitely those legislators will ever continue to wait because, bitcoin or crypto market isn't controlled by any entity so, wait is that uncertainty that it looks like they're watching it from a far hoping some day's they're going to unmask who's behind the crypto. Come on, this is so funny because the US are either not any form of official informal in the crypto. What're we even talking about here because even the so US had a holding in their custody so why the skeptics about the bodies knowing who's responsible for crypto. Perhaps their may be circumstances where policies may be strict in the business but that aside the unregulated market price.

My opinion is that the possible effect on Bitcoin is probably overstated. Even without the Clarity act the US bitcoin industry is thriving in many areas. And - do we need even more centralized industry "providers" if the aim is decentralization? I think in general we have a good, even perhaps too extended exchange/service provider ecosystem.
The bill will probably mostly affect altcoins, stablecoins and DeFi. These areas are clearly not very relevant for the "core" Bitcoin ecosystem. But of course a clearer altcoin/stablecoin regulation can indirectly affect Bitcoin, both in a positive and negative way. The positive way is that some altcoins may drive capital into Bitcoin which otherwise would have chosen another assets than crypto. For example there could also be perhaps more complex financial DeFi products with Bitcoin involvement. But as this doesn't affect the main Bitcoin use cases I think the relevancy is not that high.
But there is also a possible negative effect: coins like Ethereum could dispute Bitcoin's leadership of the sector again, leading to a more fragmented cryptocurrency landscape. We could go again down from 50-70% Bitcoin Dominance to 30-40%. This is however not granted, altcoins need also to justify its existence with real life benefits for their users, and they do generally quite poor (with the exception of being a replacement for speculative pennystocks).
An interesting and very positive point is the "protection" for open source developers, however these are probably also mostly affecting altcoin/DeFi projects. AFAIK it would never target something like Bitcoin Core or Electrum.

Bitcoin is a decentralized project, a decentralized blockchain and it has never scammed any people. If people can look at Bitcoin as simple as it is, and invest money in Bitcoin, they get very good profit. Any people who lost money for scams is because they did not invest money in Bitcoin, but did something else like with Ponzi scams on fake behalf of Bitcoin, trading and other things. The bill will probably mostly affect altcoins, stablecoins and DeFi. These areas are clearly not very relevant for the "core" Bitcoin ecosystem.
They are very scam and many of them tried to use the reputation of Bitcoin for scamming victims while Bitcoin is truly not responsible for such scams. DeFi, stablecoin, Wrapped Bitcoin tokens, staking, all of these things can make people losing their money, and if people believe in such things, spend money for such things, then lost money, it's their full responsibility for risky decisions. Stablecoins can be frozen, lost pegs. Defi and staking pools can scam and rug pool. Wrapped Bitcoin tokens can lose their pegs.

The bigger problem in the US has been the uncertainty around who is actually responsible for crypto, the SEC or the CFTC.
To me, importance of CLARITY Act is not limited to settling old debate between SEC and CFTC about who will have jurisdiction. One thing I have seen time and again with crypto, not only do rules change, but interpretation of those rule also change over time. SEC and CFTC issued several clarification on crypto asset in last March, and SEC again proposed Regulation Crypto Asset now. In other word, agency-level guidance is not yet fully settled. This is where I see practical value of CLARITY. When any business make any long term decision about new product, custody setup or infrastructure then it is not enough to just know today's rule. It is also necessary to take into account what will happen if interpretation of that rule changes tomorrow. So at least basic rule need to be as clear as possible in statute. If final language is clear enough then US-based exchange, custodian and builder can get relatively stable statutory baseline. But here's big if, in the end, what matter is what the language of bill stands for and how it is implemented.

I agree, the impact on Bitcoin per se is probably going to be limited, but I do believe that Bitcoin actually has more regulatory clarity than the broader market might suggest While that’s agency level, the SEC and CFTC’s march interpretation explicitly treats bitcoin as a digital commodity and NOT a security. So in my opinion, the most significant part of CLARITY is the layer around Bitcoin, the likes of exchanges, brokers and other intermediaries. It may become a more definitive form of regulation for business that provide access to bitcoin. That distinction is important, because regulatory clarity doesn't necessarily translate to fewer regulations. The more significant change could just be the uncertainty regarding the rules and which regulator is governing it, with rules that businesses can actually plan around.

Let's consider who the beneficiaries are at the receiving end of the Clarity Act's approval in the first place: is it the government or every individual Bitcoin investor?
Will this also spark a massive increase in the Bitcoin adoption rate, or will there be nothing different or significant observed regarding the approach given to Bitcoin by either the government or the people at large?

i've said this in a few similar threads before, but a lot of people didn't really buy it. the main purpose of the clarity act is to clearly define the regulatory roles of the SEC and CFTC and determine which token fall under securities or commodities. on the other hand, bitcoin has already been recognized as a commodity since 2015. i don't think its gonna have much direct impact on bitcoin. altcoins are the ones that stand to benefit more from it. the current sticking point with the bill is the ethics provisions and investment linked to Trump. if neither side is willing to compromise, there's a good chance the bill is gonna keep getting delayed. https://bitcoinmagazine.com/takes/what-the-clarity-act-actually-does-for-bitcoin

At the level of the already bound volumes on the law of Clarity it is still far from being ratified. Too many obstacles despite several times nudging Trump and his family about their crypto activities. I watched the interview US Senator Elizabeth Warren will do everything possible to thwart the Clarity Act. So on September 15th I'm still skeptical about that.

Well this bill has been waited for so long by institutional level firm and I honestly think that some bought due to this particular bill regarding bitcoin. For it will have a huge impact for bitcoin cause this will become a major indicator as well for market movement. But the thing is there will be max feeling about it such as: 1. Some buyers when this bill pass will expect a pump of bitcoin and they are ready to unload their potential profits. 2. Some Fomo from retail and other insitutions thus create a huge pump movement. 3. The exact implementation on crypto and bitcoin and more adoption. 4. If it not passed, I assume bearish scenario from whales and retailers.But nevertheless its a good thing to be ready if you are a holder of it.

Compared to what those companies get, what Bitcoin gets is actually limited. So if this bill gets passed, the companies that have wanted clarity about crypto in the US would finally get the regulatory certainty they've been looking for, and that would directly give them the confidence to expand their business and start offering the crypto services they've been wanting. Basically they're the ones benefiting the most. But indirectly, this could also affect Bitcoin's price although I don't think it's that significant --- and points like protecting personal self-custody rights and shielding non-custodial software developers are also quite important to take note of.

I have a question for you, but first, my expectations about this post were not this. I thought you would list the actual reasons, then say it would make rules clearer and easier for startups and investors. Brother, tell me how many startups are working on Bitcoin in the US that can pump the adoption of it.
Investors don't even need this act at all, because what they needed, ETFs, has already been approved. So why should this act have any impact on Bitcoin?
I read about some policies for balance sheet accounting for banks, and this will only benefit banks somehow. Not individual investors.

If CLARITY actually passes, the biggest winner isn't Bitcoin. Bitcoin doesn't care what people in Washington think.
The real winners are the US-based startups who can finally stop packing their bags for Dubai every time a regulator wakes up on the wrong side of the bed. And also crypto lawyers, who might actually have to read a clear rulebook now instead of guessing the SEC's daily mood.

Clarity act is for altcoins, stablecoins and possible scam projects. They want to have Clarity act existing for regulations on altcoin projects and companies with financial flows through altcoin blockchains especially stablecoins. Bitcoin like you said, does not care about Clarity Act. Bitcoin already has a public ledger, everyone can check from balance to transaction history of a Bitcoin address including government. Bitcoin more importantly does not scam any people, so clarity act does not change anything on Bitcoin fundamentals.

I agree, but that was just my point: we have already a quite good ecosystem of centralized entities dealing with Bitcoin, and in the US it is much better than in the world's average. The only problem US citizens have is that they are banned from several offshore services, and that could perhaps even change with CLARITY if it's easier for these entities to adapt to US regulations. So... where do people still see shortcomings in the service provider landscape? Layers like Lightning and Ark come to mind, but I don't know if they are affected - Ark providers at least could be considered custodial and thus an "intermediary" by some definitions, even if they aren't really in charge of custody if there is always an unilateral exit. Those who buy Bitcoin want to enjoy privacy, and this section of the Act offers that privilege. That clarification is a good point. However, I'm a bit in doubt if this isn't already granted by other laws. Would have to investigate. Bitcoin developers, really? Don't you refer to Tornado Cash / Samourai? In this case, the "developing" activity wasn't the main reason, but the fact that they were operating an informal business, with fees, infrastructure etc., even if it wasn't traditionally "custodial". Still the authorities' prosecution imo is an atrocity. But they weren't only "developers". Here I disagree with the Bitcoin Magazine article. For example see this article: Prosecutors argued that features such as Whirlpool and CoinJoin, privacy techniques mixing coins from multiple users, amounted to money transmission by obscuring fund origins. They pointed to Samourai’s fee structure, promotional materials, and darknet outreach as evidence of intent.
However, Bitcoin Mag actually agrees with me: CLARITY is bullish for crypto broadly, and only narrowly bullish for Bitcoin specifically. The vast majority of the bill exists to give altcoins a way out of securities law limbo, which is a problem that Bitcoin does not acutely possess.

I think the biggest impact of the CLARITY act would be on the companies that are around bitcoin, but not the bitcoin it self. Why I am thinking so is because bitcoin doesn’t depend on SEC or the CFTC to operate, and even if the bill is passed it wouldn’t change the bitcoin protocol rules. If the law gives clearer rules about which regulator is responsible, then exchange and custodians with other crypto businesses will definitely have more confidence to operate in the US. That could also help innovation overtime. But I am not expecting the senate vote alone to cause any huge BTC move, regulatory clarity can affect the environment around bitcoin but it doesn’t change bitcoin’s supply, consensus rules or its decentralized nature.

If the vote goes through, I don't expect BTC to suddenly go +20% just because of the news. I would not be surprised even if it goes -8%, just because "buy the rumor, sell the news". In September. But no, it will not go though in this September. Since the bullish part of the cycle is about to start, if the clarity act will pass in October or later it may be seen (correctly or not, hard to say) as a catalyst for one of the legs up of the bull run.

The Clarity Act favours companies and services in the crypto space. It doesn't directly affect Bitcoin and retail investors. What the bill does is provide certainty for businesses, investors and regulators in the US. In the long run, it would be good for Bitcoin because when there is certainty and clear regulations, more crypto services will be launched and more investors would come, but in the short run I don't see anything that would happen to the price. Maybe the usual FOMO might create demand, but it won't be much. The act is not like the ETF approval that directly creates demand.

More Wall Street players and small to no effect to Bitcoin. Bitcoin is already clearly a commodity and Clarity Act will clear nothing about Bitcoin because it's already clear.
This bill actually talks more about the company surrounding the cryptocurrency market and new projects, it talks very little about an established crypto.
Moreover, SEC has also bridged some part of the Clarity Act with their newest crypto Agency Rules.
Maybe one of the good thing that comes with Clarity Act is safe harbor for non custodial developer, but it has little to do with Bitcoin supposedly.
