Let's say you invested 5btc with a company at the start of 2021 when the price of Bitcoin was $20,000. If you guys now have a dispute and you want your money back by 2024, when Bitcoin was $44,000, will you sue for the original amount you invested in the company, or would you sue for the amount your BTC would have been if held it all those year? Or will you sue for the original amount, but include damages? I'm just curious.

Are you investing in the company so the company holds your BTC for you or are you investing in the company so you earn returns according to your investment for example like buying shares in the company.
If the company gave investors the chance to invest with Bitcoin it should be the Fiat equivalent. You are entitled to the profit meant for your capital category and not the value of 5btc after those years, ok what if Bitcoin has gone down would you expect to have lower value.

Just like you said, “Invested 5btc” and bitcoin itself is a volatile currency, so you invested with the company that is the bitcoin will increase in price or decrease in price in the next coming four years of you guys agreement so the value of bitcoin in that next four years would be what they will give you that just the reality.
 
Therefore the company is meant to give you the actual 5bitcoin because that what you gave them and not either $10 or any amount but bitcoin initially. So even if the price drops to $100 per bitcoin then you will receive your $500 and in this case that the price has increased then you are meant to receive your actual 5 bitcoin it doesn’t matter the value of the bitcoin. So technically you are taking the $44,000 worth and that just the agreement.
 Hope this is crystal clear.

This is clear enough even though it is a hypothetical question.

I will respond directly.

So I will sue for the current price for 2024 because the btc had appreciated in three years in the hodling and custody of the company. I will also include damages (if any), then I will include transaction fees because it might be higher compared to 2021 which was the time of investment. That is, I will sue to receive the worth of my 5btc in 2024 complete excluding transaction charges.

There is another twist to this hypothetical question. I will ensure the company didn't use the coin for loan or stake and if they did, I will sue to also recover my own profit from the businesses that the coin was used for at the time it was in their custody. The reason is that in such kind of investment with the company, you might have signed a partnership deal to be a part of the asset and liability of the business investment of which bitcoin made profit from 2021 to 2024. So I should profit from the investment too as a "share holder".

Investing in a company means you're a part of that company, so you're affected by whatever profit or loss is incurred. For a company that accepts bitcoin as investment means, it would be plausible that their operation is fully functional on bitcoin because they cannot be operating on fiat and accepting bitcoin payment means because of its volatility. But in the case of a dispute, it is reasonable that you would get the same amount of bitcoin invested based on the agreement signed, at the current bitcoin rate, but this should also depend on the state of the company too.

You want to sue a company all because you couldn't be well convinced that you are more profitable with your investment on them, the court will first asked what are the terms and conditions to your investment with the company, then this is going to be the basis at which they are going to determine who is at fault.

Another reason to why we should always invest on our own without going through a third party investment platform or centralized exchange are these, we gain access to control our fund, we don't have to pay any maintenance or service charge fee in order for them to invest for us, we determine the extent at which we are going to be profitable as long as we are capable of holding for a longer period of time.

This doesn't make sense to me, and those third-party bitcoin investment that promises profits gains payment percentages are scams, you should not give up the ownership, control of your bitcoin to any third-party company no matter how much profits they promises.

Now let discuss your topic, your investment is in BTC which is the 4BTC mentioned, if you have contracts signed with the company to get collateral benefits for your locked bitcoin, then the interest will be calculated based on the percentage and time.

But if you want to liquidate you invested 5BTC you should get your 5 btc returned and not the dollar price, plus your accumulated interest for the locked period.

Everyone knows the answer to the question, I'm sure the reason behind that investment is to make profit so why would anyone only request for the original amount. Personally, I think looking at just the $100k value from 2021 would be difficult for me even if I gave the company 5 BTC. The simple truth is that by 2024 the value of the 5 BTC had increased significantly, you don't expect me to comfortably just request for the original amount I invested.

But at the end of the day I suppose the agreement between both parties would really count here, most especially if it was clearly stated whether it was an investment in BTC or a fixed dollar amount.

This type of scenario will strictly depend on the agreement made from the get go, investing a huge amount of money in a well organised company must have a well written and agreed MOU.

It will make no sense of anyone to invest in a well built company without agreeing on the percentage, that will be giving to the person either monthly or annually. It what should be given as return when the decision of  such magnitude of withdrawal arises.

This kind of investment can sometimes be agreed either for the investor to be in full partnership, or for the person to invest and will be giving  a certain amounts as compensation.

If it happen that the person is in agreement of a full partnership, that means the return of the funds invested might be base on the present value of the invested funds.

And if it's a partial and temporal investment, I think the return will be the amount invested and not the present value of the invested funds.

But nevertheless, all this scenarios are being drafted in term of investment because of a future disputes like this.

I don't understand the concept of investing in Bitcoin in a company. You buy Bitcoin through your funds and keep the Bitcoin holding in your own wallet, it's your freedom. Explain clearly how you have signed an agreement with that company. Suppose you paid a company the market price of Bitcoin 5 years ago. If the contract with that company says that the funds will be paid after 5 years at the current market price, then you can take fair and legal action for it. If the terms of the contract mention the payment of Bitcoin at the current market price, they will be obliged to pay you.

Investing with a Bitcoin company is based on buying shares from them, so there should be an agreement to how much the capital invested with the company have accrued within the period the money has stayed with them. Sueing the company is based of the writing agreement with them and should not be calculated with the current price of Bitcoin because they would also have there own profits.
Before filling a suit against the company there is need to be sure that the complainant did not bridge  contract agreement he signed.

That's simple. The person will be talking about how to get back their 5btc they gave to the company.  No increase or decrease in the 5btc given. It's that same 5btc the owner of it will be expecting from the company, and that's what he or she will sue the company for.

Is it? As far as I'm concerned you invested the value of 5btc unless you actually have a company that takes BTC as what you invest with, bitcoin is too volatile an asset and won't work as a currency you invest in a company with, what you invest is the fiat value of that 5btc so even after the price of bitcoin has increased you can only sue for what you invested, whatever increase bitcoin has had won't matter.

First thing first, I will not be in a situation where my 5BTC will be in dispute, not even in the example. Assuming someone found himself in that situation, the right thing is to sue for 5BTC irrespective of whatever the price is because the price is immaterial.  He made the investment in bitcoin so he should be paid back in bitcoin and not dollar equivalent of what he invested as at then. This also depend on the type of investment, that is if it was priced in bitcoin or bitcoin was just a means of making the investment.

Are you talking about an investment or are you talking about a loan? If this is actually about an investment then it totally depends on what agreement you made with the company when you invested 5 Bitcoin.

If you had an agreement with them stating that you are giving them 5 Bitcoin for a specific period of time and the company will give back the 5 BTC and some of the companys profit then in that case you can definitely sue them. If you take action outside the agreement you will not be successful.

Before investing with a company using bitcoin, it is expected that both yourself and the company are quite aware that bitcoin is a volatile asset and that by reason of that, the price of bitcoin at the expiration of your investment ought to be factored into. there is always a clause to every form of agreement and if a variable as this is omitted while signing an agreement of that magnitude, then the law can still settle all parties involved with wisdom.

Wether you are investing or taking up a loan, it is not right to deal with a volatile asset as though it is a fixed asset. this is why before getting into anything, you should have a clear understand of all that is involved in that thing. my bitcoin is too precious for me to thread it for this kind of cause.

What was the agreement you reached with the company before you invested that 5 BTC? that amount was $100,000 since you said the price was $20,000 as at that time. You can't invest that kind of money with a company without some written agreement because if there were no written agreement they can even deny that you didn't invest any Bitcoins with them except if you have proofs to back it up.

That 5 BTC yielded a profit of x2 in 2024 which is a very huge amount of money but the only thing that can determine how the case will be handled will depend on the agreement.

 Since it involves sueing a company, i don't think my advice would matter much since this question needs a legal advice moreover I'm not a legal practitioner and can only give my opinion based on your statement. So i think you should sue them based on the agreement you had and if there was a breach on it.

 I think you'll be requesting for the amount the BTC you invested is worth in 2024 and not the initial amount you invested, some people might think you're only entitled to the amount you invested with but since they're a third party managing your investment they'll include the profits made from 2021 to 2024 and take their percentage. So you'll sue them for the profits your money have made over 4 years.
