What's the agreement first. Pretty sure agreement was made and signed upon. Huge money like that can't just be invested without safety net. I refuse to believe that. I do believe that even though you are not sure at that time whether Bitcoin will do well or not, you still have knowledge of how shares works. That same rules can still be applied here. Just imagine you didn't have a agreement 🤝 and you come one day to come and she them. The court might bounce you out thinking you are the one that wants to defraud the company.

Suing should come in respect as to what you have invested in the company and not equating the price to anything. Even though bitcoin is an investable asset, some may still want to equate the price to what is the current worth of bitcoin as compared to what they invested initially which is the best. Just because I invested in bitcoin while investing, it is best I collect my share back in bitcoin that I invested or the equivalent amount of the current price when equated to each other. Other legal proceedings will be followed to get your amount of money out but that is not suppose to affect your initial capital which you’re suing them for to collect back.

This is clear enough even though it is a hypothetical question.
I will respond directly.
So I will sue for the current price for 2024 because the btc had appreciated in three years in the hodling and custody of the company. I will also include damages (if any), then I will include transaction fees because it might be higher compared to 2021 which was the time of investment. That is, I will sue to receive the worth of my 5btc in 2024 complete excluding transaction charges.
There is another twist to this hypothetical question. I will ensure the company didn't use the coin for loan or stake and if they did, I will sue to also recover my own profit from the businesses that the coin was used for at the time it was in their custody. The reason is that in such kind of investment with the company, you might have signed a partnership deal to be a part of the asset and liability of the business investment of which bitcoin made profit from 2021 to 2024. So I should profit from the investment too as a "share holder".
Your guess is as good as mine on this issue because I won't want to lose out on the profit from using my investment for other profitable ventures and considering the fact that the amount 5 BTC was priced at back then in '21 and now in '24 is quite different, it makes sense to be paid the equivalent in current rate. The outcome though is also dependent on the contract agreed upon at the initial stage and if I didn't agree for it to be defined in USDT or the U.S dollar.

An agreement must be made first and if failure to keep up with the said agreement then implementing the law is the best decision. Without being said the company is suppose to pay with the current value of BTC, now this issue is so common especially when dealing with a volatile asset like bitcoin. The law might be partial depending on the case and the lawyers involved but, the right answer to this question is refunding back the money with an additional value. The company in question held the bitcoin right, the number of years they also benefited must be included except the person never invested, though the agreement written by both parties will determine whatever decision.

It's a simple matter, You all invested in the company and so whatever the value of the company currently holds, it's exactly the value that should be asking for and nothing less, if there is an agreement that bind you to any terms then probably it could override your potential of seeking for the full value of the company other than that then you are fully right in asking for the share of the current value of the company you invested in.

It is simple. You invested 5btc and you want your BTC back nothing much nothing less and they should be able to provide it for you. This is a good case because they must have made good profits from your investment and by so doing, your time and number of years should have accrued a good profit for you so you have good case at hand to sue for. So therefore, all the aforementioned as you have stated is valid for a case . However, your memorandum of understanding with the organisation would be properly evaluated before any proceedings.

Are you investing in the company so the company holds your BTC for you or are you investing in the company so you earn returns according to your investment for example like buying shares in the company. If the company gave investors the chance to invest with Bitcoin it should be the Fiat equivalent. You are entitled to the profit meant for your capital category and not the value of 5btc after those years, ok what if Bitcoin has gone down would you expect to have lower value. I was even wondering what would be the reason for suing another first place because knowing the reason would make it better and easier to determine the actual amount to sue for. I quoted because you said exactly what I needed to and if he invested the said amount to only receive profits over a period of time, maybe monthly, the investor in this case has no single business with the value of bitcoin except there is a proper MOU. And I believe every if such investments only come with documentations and agreement so all this can easily be determined by what was signed

The question is did you make agreement like constitution that if anything add up they will give it to you when it's time for you to collect it? If no, then I would say that you don't necessarily need to sue for the profit. That is why sometimes it is good to think properly before taking any decisions or if you know you can't think properly then you seek for help from different source so that you will be guarded on what to do, for me if I want to have any business with any company I would rather use fiat because I know there's no way that it will bring confusion between us even though there's confusion it can easily be resolved than that of bitcoin.

Am just going to sue them for the 5 bitcoin which I invested in the company. I no get energy for any long talk, make dem just give me back my bitcoin. I don't know the value of asking this question like this. You can sue for any value that you want, but that won't mean that you will get that value or that you will get anything at all. In the case of an exchange the courts would decide that you are legally able to recover, and that will depend on the claim, where this is happening so what the law is in the country and the terms of the exchange. In some cases it could be that you are owed 5 BTC, but in other cases it could be that you are owed the original deposit of $100,000. But the court can still determine that they owe you a different number using some different measurements. I would prefer to sue for the BTC back regardless of the current exchange value of this BTC, but in the end it is not up to me if I can get this amount.

It all depends on what the agreement was before I invested into the company. Obviously there won't be any investment unless there's a signed documentation between us which then makes the sue even easy but lets say there was no agreement and there's a foul play that resulted to them getting sued then I'll be going with a pay that covers the amount of Bitcoin I invested with since that's going to give me more money and then additional compensations will be demanded because I haven't gotten any returns typically on my investment (just my initial deposit with the Bitcoin). But again I doubt I'll ever find myself in this kind of situation because everything will already be agreed upfront with my lawyer present before getting into any investment of this such.

OP, the situation you are having to draw an analogy towards is typical with having to buy Bitcoin ETF rather than buying Bitcoin itself.
It doesn’t matter if you invested 5BTC directly or as $20k worth of fiat cash, the purposes is clear and that is, for the money to be used in purchase of Bitcoin except for the fact that, it’s held by the company. Normally, when you engage in this kind of transaction, there is always an agreement between you and the company which would be binding in dispute situations.
Now, should Bitcoin dump or appreciate in price, same would apply to your investment with the company.
In any case that you have a dispute with the company, the policy applicable to the situation would always apply but, you wouldn’t be suing for anything less than the value of Bitcoin as at the time of that dispute. The value attached to your investment is what you sue for.

The question is how will the dispute arise even at the first place, in a company that you invested in. But if this type of situation actually happens in real life you are going to be sueing the company based on the current price of Bitcoin. The reason is that the Fiat equivalent of the Bitcoin that you have bought some two to three years back wound have generated profit if put into other business . So its only right to sue using the current price of Bitcoin in your legal Case.
Again you can also sue for bridge of contract for not keeping to the terms and conditions of the agreement which was entered by virtue of the investment that was made in the companies platform. But if this is a real life situation I will not advise anyone to invest their Bitcoin on companies platforms because there is high probability of you losing your money on Long run, always hold your Bitcoin by yourself in a secure wallet as that is more safer because your Bitcoin are in your custody.

When you invest BTC in a company, you become a partner in the company and you have to accept both the profits and losses of the company. However, if for some reason you have a problem and you separate, it is certainly reasonable to get all your investment back. But before investing BTC in the company, you must abide by all the agreements that have been made between you. If you go beyond the agreement and demand some extra money from the company and take legal help to not get them, you must understand that you will not get any extra money outside the agreement. If there is a specific time limit in the agreement and you want to get all the investment back quickly without exceeding that time, then this will definitely be unreasonable because you are demanding outside the agreement and this will never be acceptable. If I were you, I would first ask for the Bitcoin back according to the terms of the agreement we had, and if I didn't get it right, I would take legal action. But I would definitely take the Bitcoin back.

The question is not complete. Why all of a sudden you want your money back? Is there a problem with you and the company that you want to exit the partnership? Or you are making an assumption. In that case, if there is a formal agreement, then you are getting paid on the agreed amount and if it's verbal, then you are getting paid on the agreed amount. If you invested 5btc and there is no agreement on the amount to get your investment then you are getting your 5btc like you invested. It's going to be as simple as garbage in, garbage out. You get back Bitcoin you have the company without a single part of it missing.

I think the answer is already in the OP. If you gave 5btc for the company to keep for you, then irrespective of wether the price increase or decrease, you are entitled to the same 5btc that you gave to them. You didn't invest in terms of monetary value but in number of coin so your payment is still going to be in the number that you invested and not in monetary value
I think it depends on how agreements the person made with the company if he gave the 5btc to company as form investments then he should be expecting the profits or lose, because that’s the two thing that happens during investment. But if it happen that he only gave the company the 5btc just for them help him keep it in their company, and there’s agreement between them, so the company has nothing to tell the person if should be the case that something happened to his 5BTC. Because the company won’t just keep the 5btc without taking it into the investment in order for them to get the profits before the owner can get the money back. Irrespective of what ever happens to the market at that times moment doesn’t concern the person that gave them 5btc, because they use the money to invest without ownership consent.

It was just a hypothetical question. I understand that things will be different in reality. But that still doesn't mean it cannot happen. Even with lawyers and a series of signed documents, people still have disputes and take each other to court based on breach of contract and other things. I have seen cases where a person sues for the original value, other cases where they ask for damages and also cases where the plaintiff asks for the future value. Law cases can be tricky. Even the ones that have signed contracts get complicated.
