This is just an arguement of kalshi putting sports bets like on their platform. Ohio saw that I want that particular bet on kalshi to pay tax on that. But it didn't say anything like they should now be called sports betting platforms instead of prediction market. Kalshi was just defending itself on the matter that they are covered by the federal already. But Ohio doesn't want to recognise that. As we know that the court ruled in favour of Ohio. I see nothing here implying that they are shifting small small to be considered as gambling platforms.

If you are betting the outcome of a sporting event, how could it not be considered sportsbetting? Kalshi made enough money from their platform, why wouldn't they just suck it up and get the license?

Because they want more money.
  That's greed of them, they should have just acquired the licence or better still stop providing sports betting since that was the two options that the commission gave to them but they decided to sue the state thinking that they are also going to win like they did at the Tennessee court.

lawsuits coming from New York, if I remember correctly, is asking for $36B for violating the state's gambling laws, though I doubt they are actually going to pay that $36B even if they lose the lawsuit.
This is what I am thinking that Ohio will also do but I am yet to see any further statement after the court made the verdict favouring Ohio, although their previous statement about that was since April 2026.

From what I can see from this whole matter is about control and who is right because, the  two parties involved are all claiming right. Karlshi is claiming that they are registered under the federal law, the state of Ohio too is saying that they are exposing their citizens to gambling and that, they should do that with the state laws. And I see reason with the state of Ohio having been registered under the federal law is good but within the law it's expected that they should get the right legal documents within the state or region that, they are operating. I believe that this judgement can still be appealed in the so whether the state of Ohio enforce the law or not, this will not be the last that we will be hearing from this case.

I certainly understand that Kalshi could have done without these types of bets, given that so many other bookmaker sites already offer sports betting. Yet, for some reason, they decided to enter this arena and claim a slice of the pie, even though it seemed to me they already had plenty of capital. They likely want to scale up rather than limit themselves to the geopolitical and other niche markets they’ve focused on so far. Platforms like Kalshi could have simply stayed put and owned that specific niche, but no they want more and since that’s the case, they are prepared to defend themselves against the authorities in Ohio.

I don’t think this is the end of the matter there will likely be further developments. For a long time, prediction markets have tried to position themselves as something distinct from forms of gambling like sports betting. While they may have technically exploited legal loopholes, to me as a bettor prediction markets look and function just like betting platforms, and consequently, they should be subject to similar taxes. If Ohio authorities fail to fully prove their case, it could encourage others to launch similar prediction markets in other states to take advantage of lower taxes and other benefits.

This is a big setback for Kalshi. Just because its contracts are federally regulated it doesn't mean they should be exempt from state gambling laws. If a product works like sports betting, it's reasonable for regulators to require the same licensing, tax,.etc, etc.
However, this ruling is quite a meh, because not all prediction markets are necessarily gambling. Businesses on the same market should take a look on this as well for future prevention of whatever they might encounter.
It’s just a matter of time; even the federal might reconsider their definition of what should be considered a prediction market and what should fall under gambling law, and I understand many states correctly as to why they attack and disagree with Kalshi and Polymarket, claiming not to be associated with gambling.

If they are offering sport-related events, then they are also liable to whatever rules govern sport betting; they should either ignore providing options for such events and focus on other future events that falls directly under prediction and save their self this stress they face with state regulators.

Here's a good question, if we are the United States, then why are the laws for each state different? What is united about that? Why is that relevant? How can kalshi or other prediction markets be legal in 1 state but illegal in another? How is a social casino illegal in 1 state but legal in another? How can a person smoke marijuana in state and 5 feet across an imaginary line go to prison for xxx amount of years for possessing the weed?

All of the states should have the same policy regarding these markets. Either they believe it is sportsbetting or it isn't. IMO if money changes hands on a sporting event, it is sportsbetting. The federal government needs to step up and make a decision and not leave it up to the states.

Kalshi always wanting to jump the government bill in disguise of being prediction market and not gambling platform but what they do is something similar to gambling but the name difference is what is deceiving them to think they are not like the gambling platforms.
Let them pay tax and other necessary dues they owe the government after all they make good profit from the citizens and should be able to recognise the government of the region they operate from.

Obviously, but this loophole is about how much money they can make during the transition era, when they aren't bound by same laws. Meanwhile they will milk it in everywhere they can, and they are making enough to fight it in courts as well. I don't think that laws yet technically even exist to prevent insiders manipulating prediction market results and betting on them. At least not in same level as in casino regulations.

It's still a golden (unregulated) era for them. Reminds me of devs who got rich with altcoinscene in 2013-14, when there was no rules or sanctions. Even though this is happening in spectacularly different scale.

Yeah to your point they will definitely keep milking this cow every which way that they can and they have to be making a killing. Gotta go getting when the getting is good! Eventually it will be so regulated it won’t be even fun for them anymore. We are definitely still in wild Wild West phase here.

Before prediction markets became so commercialized, you could argue that they were not true gambling platforms. There used to be strict limitations where you couldn’t create a market for sports outcomes and the maximum amount of funds you could place on an event was really low. Polymarket and Kalshi have since come along and blurred the lines between casinos and prediction markets.

Fantasy sports sites such as DraftKings tried to also get around gambling restrictions by claiming to be something distinct to gambling. Eventually, they had to get gambling licenses and are currently restricted in many states.

Kalshi might not give up their fight just yet and will proceed to take this to the Supreme Court. It’s hard to say which way they would rule. The Republican majority would probably side with Kalshi, who has the backing of the federal government, is my guess.

All of the states should have the same policy regarding these markets. Either they believe it is sportsbetting or it isn't. IMO if money changes hands on a sporting event, it is sportsbetting. The federal government needs to step up and make a decision and not leave it up to the states.
This issues come down to the fact that Kalshi is CFTC registered Designated Contract Market, so I think that the only way things will change very fast against them is if CFTC withdraw the DCM registration of the company but it doesn't seem like they will do so, as they are even backing up the company. Seem Federal doesn't even care, else they would have settle this  as they saw that different states have started fighting this company for trying to circumvent their state gambling law.

Remember that Kalshi sued Ohio and its state officials during October last year because Ohio's Casino Control Commission/regulators said that they are operating an unlicensed sports book and have to stop it or obtain a licence and have to also pay sports betting tax to Ohio before they can be allowed but as we already know, Kalshi refused because they believed that as they are regulated by the federal government that their contract is beyond state gambling laws.

According to the news I saw, the U.S. Sixth Circuit Court of Appeals has upheld Ohio’s authority to apply its sports betting rules to Kalshi’s sports event contracts. Finally, Mike DeWine got what he wants as he has always been against it. Gradually, the idea that prediction market is not related to gambling will worn out, so I think.

If you want to operate under the pretext of a prediction market which is still literally gambling, you gotta abide by the rules and regulations of the land.
Prediction markets are just gambling sites , period.
Ohio has made the first move, it is likely that we would see other states do the same and may even extend it to Polymarket.

Obviously, but this loophole is about how much money they can make during the transition era, when they aren't bound by same laws.

If Kalshi were simply operating like sportsbook under guise of prediction market without any actual federal regulatory status then I would be much more inclined to agree with you.

However, Kalshi is actually CFTC registered Designated Contract Market. And that is precisely the point where core legal dispute arise.
Their argument isn't simply, We are running sportsbook and calling it prediction market.
Their argument is that federal commodities law shields them from state gambling regulation.
Of course, that doesn't necessarily mean Kalshi's argument is correct. but it certainly isn't unreasonable. Therefore this entire matter cannot be described as unregulated loophole.

This kind of problem is the reason why it is complicated to distinguished between predictions market and sports betting.
The fact that kalshi was treating there contract as financial products doesn't stop state regulator from seeing it as sports betting because people are still risking money here.
I think, the important thing is to watch how this issue will be resolved at the end of the day , because this may affect other predictions Market that is operating in different states in the same country

If you are betting the outcome of a sporting event, how could it not be considered sportsbetting? Kalshi made enough money from their platform, why wouldn't they just suck it up and get the license?
It's not that they don't have the money for the license, but what type of explanation will they give to other states and countries where they are operating with a prediction license and claim not to be offering a sporting event? They just have to accept and go with their definition worldwide, or they face attack from another government if they give in to one state, which is also another thing I consider them to be avoiding.

Your post and thread are good except this part. This conclusion does not follow from the presented case, and worse it is completely false. Prediction markets have many aspects that are not related to gambling and can not be regulated as purely gambling products. For contracts that relate to sport the situation is much more clear, and the growing view on that was that these would be ruled as gambling everywhere. The prediction markets knew the risk that they were taking by including those. Just having those does not mean that the whole thing is gambling, or that it will be regulated only like that. What can happen is that they are given a choice to restrict certain types of predictions and stay as a financial product, or they get a gambling license but then include predictions of everything that relates to overall gambling.

This is also false, people risking money does not make something gambling. If it did that then all investing and stocks would have to be regulated as gambling too.

In these case, Ohio which is the regulatory, and licensing body should be aware, and properly register, and document any gambling company that is operating within their state, and if Keshi feels because they have registered with the federal government, and neglecting the state regulatory body I think the federal government should be made known so that they can be able to rectify that matter with Ohio which is the State gambling regulatory body.

I don't understand gambling or prediction market companies that launch operations without addressing these issues beforehand, especially since hiring a competent person wouldn't be all that difficult. I don't know Kalshi's turnover, but they clearly make a lot of money, so it makes sense to play by state rules to avoid lawsuits or similar trouble otherwise, they could simply be banned and might have to look for a new location or a low-tax state though an online business like that could choose almost anywhere in the world that offers sufficient security.

I want feel bad about this for any reason, since it is a fight against what majority of gamblers me also wish not to support, they just to do with prediction market and not gambling precisely is also of interest to me, any form of illegal platform used by operators are part of what is constituting nuisance and giving negative impression about gambling to the world, anything that has to do with entertainment should not go beyond gambling and that is why taking necessary actions against prediction market is a good idea.
