Remember that Kalshi sued Ohio and its state officials during October last year because Ohio's Casino Control Commission/regulators said that they are operating an unlicensed sports book and have to stop it or obtain a licence and have to also pay sports betting tax to Ohio before they can be allowed but as we already know, Kalshi refused because they believed that as they are regulated by the federal government that their contract is beyond state gambling laws.
But if we've to tell ourselves some true facts, you'll understand that it's a right for the lower level of government to also benefit or exercises its authority powers on any any firm that operates under the environment of the government. I think the Kalshi should take it easy on this legal rights they're fighting else, governments haven known to be politically biased including the judiciary won't be a trusted avenue where you can rely on. Looking at this circumstances of the Kalshi and the Ohio State government, don't you think the local wings was even ought to regulate the platform. Definitely there should be concerns about the State towards the people where the site is situated.

He used many words: "If it's a pig, it's a pig. If we call that pig a sheep, it's still not a sheep, it's a pig. You know, these guys are pigs". I guess he didn't hold back anything... This case is a bit ridiculous... It's not like they want to ban Kalshi, they want them to pay for the licences & taxes. But the Kalshi guys are like, " We don't need that", the federal law protects us. I guess they know that if they pay now, they will have to pay in all the other states... And they don't want to give up all that money so easily...

Brilliant thinking, once Trump lose the office sit many things will face bigger challenges, the reason why many nonsense things are running and roaming freely is because of Trump in the office.. I hope these people are fully prepared already, if Trump never won the election I doubt that prediction markets will survive or will be allowed to run, they might all be crucified or put on very heavy law. I think the only solution for now is imposing big law on prediction markets but one way or another I strongly believe that Trump family and people are benefiting from every single things that are allowed to run. Please, you all tell yourselves that without Trump regulation beatdown on prediction market will be high, wake up to reality, chances are that they will have even more room to operate, with even less laws against them. He might be a proud man and a lot of people might not agree with him but giving gambling a bigger space to thrive is something the other side will do if they come to power, in their bid to let people do whatever they want. You can argue that there is a certain level of interest from his part that might be making him appear complicit but that doesn't mean the other side will act any different.

Looking at this circumstances of the Kalshi and the Ohio State government, don't you think the local wings was even ought to regulate the platform. Definitely there should be concerns about the State towards the people where the site is situated.
That is very natural, and a large prediction market should consider how their business will run smoothly. I think Kalshi should consider addressing this issue and paying taxes to the Ohio authorities. We certainly do not think Kalshi lacks the funds to pay taxes and resolve this issue. But in reality, what are they thinking with their case?

Kalshi said it does not expect the decision to survive further legal review. "The ruling shows exactly why a state-by-state patchwork doesn't work," Kalshi spokesperson Dani Lever said. "Markets can't operate when the rules change at every state line, which is why Congress created a single federal regulator with nationwide rules." https://www.tennessean.com/story/news/courts/2026/10/07/kalshi-gambling-laws-court-ruling/92134459007/Circuit Judge Julia Smith Gibbons wrote for a unanimous three-judge panel that Kalshi did not show its sports event contracts were "swaps" that should be regulated exclusively by the CFTC. She also said the federal Commodity Exchange Act did not preempt Tennessee or Ohio's gambling laws. This is really confusing. Kalshi may have a point that a state-by-state patchwork doesn't work, but they will have to abide by the rules. Imagine if you are the owner of a prediction market and you have to have different rules and systems in every state. That will be a lot of work. Still, they cannot just ignore what every state wants. So, if they want to continue doing business with other states, they will have to create a program that will not show "gambling" related bets or whatever they call them, since they are not admitting they are a gambling platform. In each state, there will be a system that will either deny showing those lines or it will show them to the legal ones. Just thinking about it makes my head ache.

I’m not exactly an expert on legal matters, but it might be more profitable for Kalshi to simply shut down its operations in that specific state paying off all taxes and fines and instead launch a new business in a lower-tax jurisdiction. They may have already hired consultants at great expense to resolve this issue while keeping the site running after all, they can’t afford to take the site offline even for a day to switch domains, as users would instantly flock to competitors like Polymarket.

I think this decision could really become an important precedent for the entire prediction market industry in the US. But when it comes to things like who will win a game or what the final score will be, the difference between such a contract and a regular bet becomes less and less obvious to the user. At the same time, I wouldn’t say this completely puts all prediction markets and gambling in the same category. But sports prediction markets are probably the weakest part of this argument. So I also think the line between sports prediction markets and regular sports betting in the US will gradually become less convincing. And if Ohio’s position gets support from other courts as well, the main question for Kalshi will no longer be whether it is a CFTC-regulated platform, but whether that federal regulation actually exempts its sports products from the individual gambling laws of each state.

This kind of problem is the reason why it is complicated to distinguished between predictions market and sports betting.
Several states restricted it because its similarity to the gambling site. It's not complicated enough to distinguish Kalshi is a gambling site.  The fact that kalshi was treating there contract as financial products doesn't stop state regulator from seeing it as sports betting because people are still risking money here. I think, the important thing is to watch how this issue will be resolved at the end of the day , because this may affect other predictions Market that is operating in different states in the same country
Kalshi being treated as a financial product based on CTFC's regulation while states start to see it as similar to the gambling site. Some states put restrictions on Kalshi like Washington, Newyork and etc. It means we have a conflict interest here, but from my pov, i'd like to call any of prediction market as a gambling site because these platforms offering similar products as gambling sites did. Aside from that i'm not sure Kalshi will able to solve this because the more states are starting against them. So i think they have to give up, then declare themselves as a gambling site, then again comply with any regulations in the states they operated. They have to stop to fool people.

Ohio to finally enforce law against Kalshi sports market
This means that the states of Ohio and Tennessee have legal rules and laws to regulate the Kalshi sports prediction market, which is certain if these rules and laws are developed, the Kalshi sports prediction market will become a legal market, no longer illegal betting. Question, what about the Financial sanctions case against Kalshi prediction market accused of running illegal gambling activities and a fine of nearly $5 million whether Ohio continues or discontinues the charges against Kalshi, in fact when Ohio gets a legal victory of course they rule over everything. Whether Ohio will go further for Kalshi's sports betting in the previous case, it is really interesting for the continuation of the case between Ohio vs. Kalshi.

Can someone brief me on hell why the prediction market companies are vehement about it not been same as gambling. Assuming so not know why.
The US run a federalism system that makes the States autonomous before the federal level and that is the very reason to why every institutions inspite of having had a contract with the federal authority you must have to corporate with the state authority laws as well and not to go on a law suit tussle with them.
Kash on this one, it serves them right, cause what where they expecting.

I think Kalshi made a mix up here. They may be unaware of how the regulation or authority of government works. And for me it is fine. What they thought was as they have gotten approval from the federal, they need not the state permission, in essence, they can carry on whatever bet activities as normal. What they failed to ask was whether the the regulation supersides that of the state instead of assuming that federal overrides the state. Which in the first place made them refused. I think it is only in this scenario this is happening. Because even without finding out, federal power supersides that of the state. Could be that the law ends at gambling.

Can someone brief me on hell why the prediction market companies are vehement about it not been same as gambling. Assuming so not know why.
The US run a federalism system that makes the States autonomous before the federal level and that is the very reason to why every institutions inspite of having had a contract with the federal authority you must have to corporate with the state authority laws as well and not to go on a law suit tussle with them.
Kash on this one, it serves them right, cause what where they expecting.
I don’t know why Kalshi needs this, given the significant time and money involved perhaps they have a plan that isn't obvious to us, but they clearly understand the direction they’re taking. I don’t think the people there are foolish unlike the situation with FTX and Bankman-Fried though I suspect it might be a while before we see any results. It also makes me wonder: when the company was first set up, did the founders really fail to foresee potential staffing issues down the line? Maybe they should have done a better job of forecasting lol. Or maybe they should have just placed bets on it on their own platform, haha.

Remember that Kalshi sued Ohio and its state officials during October last year because Ohio's Casino Control Commission/regulators said that they are operating an unlicensed sports book and have to stop it or obtain a licence and have to also pay sports betting tax to Ohio before they can be allowed but as we already know, Kalshi refused because they believed that as they are regulated by the federal government that their contract is beyond state gambling laws.
But if we've to tell ourselves some true facts, you'll understand that it's a right for the lower level of government to also benefit or exercises its authority powers on any any firm that operates under the environment of the government. I think the Kalshi should take it easy on this legal rights they're fighting else, governments haven known to be politically biased including the judiciary won't be a trusted avenue where you can rely on. Looking at this circumstances of the Kalshi and the Ohio State government, don't you think the local wings was even ought to regulate the platform. Definitely there should be concerns about the State towards the people where the site is situated. I believe that these prediction sites will keep suing and fighting their legalities in different jurisdictions because when Ohio, fully wins the case against kalshi, it would encourage other states in the US to do the same and gradually they will become worn-out and accept the inevitable that they are gambling sites. The average gamblers knows that when you're staking your money for an event to occur whether it is sports bet or something else it is still gambling, either informally with friends or formally on a platform it doesn't change what it is. Aside from not wanting to be regulated and be paying tax to states I wonder what other reasons why a prediction site wouldn't want to be identified as a gambling site?

That is not how the law works, so please don't make up things for no reason here. If Ohio wins that does not mean anything for the real battle about the prediction markets. The real battle depends on the final ruling of the Supreme Court. A state court ruling against Kalshi is significant for a single dispute, but it does not automatically establish federal precedent or as you say it Kalshi will be gradually worn out. The whole legal battle is very complicated and there is no way to simplify it to make false simple statement about it. There are competing arguments if these contracts are more federal and derivatives or if they are more gambling, or if only some contracts fall into one category and some others fall into the other. This conflict has to be resolved at the proper federal level, and until that is done you can not make assumptions or claims that a state's victory means that this will lead to a defeat on the main battle. It is very possible that courts in states rule in favor of the states, but that Kalshi wins at the federal level and ultimately wins the whole war.

That is very natural, and a large prediction market should consider how their business will run smoothly. I think Kalshi should consider addressing this issue and paying taxes to the Ohio authorities. We certainly do not think Kalshi lacks the funds to pay taxes and resolve this issue. But in reality, what are they thinking with their case?
I’m not exactly an expert on legal matters, but it might be more profitable for Kalshi to simply shut down its operations in that specific state paying off all taxes and fines and instead launch a new business in a lower-tax jurisdiction. They may have already hired consultants at great expense to resolve this issue while keeping the site running after all, they can’t afford to take the site offline even for a day to switch domains, as users would instantly flock to competitors like Polymarket. I don't think it's just taxes or fines, but whether or not Kalshi's business model works in different interpretations of prediction markets at the state level. Moving from one state to another could ease the immediate issue, but could not necessarily eliminate the regulatory uncertainty in the other state. There are also costs involved with changing jurisdictions. And a disruption to the competition could be of some benefit to those who move. Though changing jurisdictions is not as straightforward as changing a domain. It would be determined by licensing, number of users. Contract provisions and whether the new regulatory environment would be more stable.

According to the news I saw, the U.S. Sixth Circuit Court of Appeals has upheld Ohio’s authority to apply its sports betting rules to Kalshi’s sports event contracts. Finally, Mike DeWine got what he wants as he has always been against it. Gradually, the idea that prediction market is not related to gambling will worn out, so I think.

It's an obvious excuse for them and try to make us believed that they are not gambling per definition. But we all know that is not the case, as when you play and involved money and bet on a future event or the unknown result, it's obvious that is gambling. So as much as they try to hide their so called prediction market, many states in the US, specially when their state attorney and casino control commission will go after them and if they don't get a license, then they know the consequences of it.

I'm surprised to see any governments pushing back on gambling during a time of high rates and slowing revenues... You would think they would welcome every tax dollar they could get their hands on. Maybe this is a ploy to score some sort of deal or something. The way gambling is growing, I can't imagine that states are going to win the fight to keep them out. There's just too much money and too many people who want to gamble.
