In reality, this debate will persist until a definitive end is put to it through strict and clear laws; until then, I believe that the prediction market companies will not cease their efforts.
They make huge sums of money from prediction markets and sometimes interfere in the internal politics of some countries, and their influence is expanding, so these companies will always seek to exploit legal loopholes to prove that they are not a type of gambling.

I’m not exactly an expert on legal matters, but it might be more profitable for Kalshi to simply shut down its operations in that specific state paying off all taxes and fines and instead launch a new business in a lower-tax jurisdiction. They may have already hired consultants at great expense to resolve this issue while keeping the site running after all, they can’t afford to take the site offline even for a day to switch domains, as users would instantly flock to competitors like Polymarket.
Stopping operations in that state might be possible. But they will definitely consider their platform users from that state. Paying fines and resolving their issues should not be a problem, but perhaps they have a different business perspective by calculating the potential profits and losses they could gain from the case.

Remember that Kalshi sued Ohio and its state officials during October last year because Ohio's Casino Control Commission/regulators said that they are operating an unlicensed sports book and have to stop it or obtain a licence and have to also pay sports betting tax to Ohio before they can be allowed but as we already know, Kalshi refused because they believed that as they are regulated by the federal government that their contract is beyond state gambling laws.
According to the news I saw, the U.S. Sixth Circuit Court of Appeals has upheld Ohio’s authority to apply its sports betting rules to Kalshi’s sports event contracts. Finally, Mike DeWine got what he wants as he has always been against it.
I think we are well past the illusion that "prediction markets" are any different than sports betting. It was only a couple weeks ago that poly market started targeting that area and made a big announcement about it. Regulators are often reactive but in this case they are doing their job which is making sure companies are following the law and it was purely a stalling tactic to avoid collecting state taxes. With hundreds of millions at stake you could argue that the company had a duty to challenge it but it was not going to get far. It'll be interesting to see if there are additional punitive fines because they were some combative during the process. It's a dangerous game they play, but they are running a gambling company after all..

In the end prediction market owners will rename their service into something that has little connection to making prediction or gambling. They will try to turn whole situation upside down by replacing prediction with guessing, making it guessing market and by guessing they will say people participate in solving a riddle. On the documents and interpretation, prediction market will turn into riddle solving activity. Wordplay will be what made prediction market win in this battle.

More strict regulation will be implemented and possible fines would be asked on on them.
For sure they can't continuously avoid those things you have mentioned, since if you look at that action made by Ohio. It clearly show that more strict actions will get imposed to them by other more state or maybe countries to.
This reminds me of the evolution of cryptocurrencies and Bitcoin as financial assets; when they first emerged and for the initial five-plus years no government wanted to levy taxes on them because they didn't understand what Bitcoin was or how to classify it (whether as a commodity or something else). A similar situation has arisen with prediction markets, where it is unclear how they should be treated; however, I suspect that in many countries, they will quickly be classified as bookmakers, and certain types of bets such as those on geopolitics will likely even be banned.

i think prediction markets are going to face more of these legal fights as they get bigger. calling something a prediction market doesn't automatically mean it should be exempt from state gambling rules, especially when sports contracts look pretty similar to regular bets. it'll be interesting to see how other states handle it too.

This is a big setback for Kalshi. Just because its contracts are federally regulated it doesn't mean they should be exempt from state gambling laws. If a product works like sports betting, it's reasonable for regulators to require the same licensing, tax,.etc, etc. However, this ruling is quite a meh, because not all prediction markets are necessarily gambling. Businesses on the same market should take a look on this as well for future prevention of whatever they might encounter.
Prediction markets are definitely getting into a gray area here. If the contracts are basically functioning like sports bets, I can see why regulators would want similar rules and oversight.

Truly I see no reason why Kalshi will not adhered to the state law, I mean if they earn much profit from the platform why not pay and register. Operating an unlicensed platform because they claim to be different as gambling is still not a valid reason, for a platform that requires money to trade and sometimes people do lose money while trading can be referred as betting. The fact they’re controlled by federal agency tells a different story, gradually Kalshi and other prediction market will be viewed as gambling though the features are kind of different.

I don’t think that kind of wordplay is going to work. Regulators look at more than just what a service is called — they look at how it actually operates. If people are betting on real-world outcomes and risking money, simply rebranding it as solving riddles is unlikely to help. You can try to get around the rules that way, but that doesn’t mean regulators will buy it.

The prediction market operators are trying to avoid state sports-betting or transaction taxes through their claim that they are not gambling service providers. To me, I don't see anything different from gambling that is done in Kalshi or Polymarket. They wouldn't be involved in these lawsuits in different states in the US and some countries if they agreed to operate as gambling platforms. This Ohio judgment might have a ripple effect on other states. Courts in other states might end up referencing this judgment as a precedent to mandate Kalshi to abide by the gambling rules of these states,

The Sixth Circuit last week affirmed a Southern District of Ohio decision denying Kalshi a preliminary injunction, holding the company had not shown its sports contracts qualify as “swaps” under exclusive Commodity Futures Trading Commission jurisdiction and that, even if they did, federal law would not preempt Ohio’s gambling statutes. Parallel relief Kalshi won in Tennessee was vacated.
DeWine went further in blunt terms, saying the operators “don’t want to pay anything” and “just want to have a free ride,” and vowed that Ohio “will certainly enforce the law.” The commission previously pursued a proposed multimillion-dollar civil penalty against Kalshi for unlicensed sports gaming; the broader dispute continues in court. Kalshi needs to get over itself. The amount of ego to offer gambling services which are obviously and plainly 100% gambling and then to whine about which regulations are and are not for them. They really think they are above the law? I would stay away from Kalshi just because of this. The platforms that get taken down or turn into scams are very often those that act out of arrogance and greed.

So far, they've only bought time, and a bit of jargon is saving them. This should have been resolved years ago. Prediction markets aren't new; why were they ignored before? Oh, right, the current volume doesn't justify letting it go now that it's become enormous, and that's the point. I'm not defending Kalshi in this case, but it's something legislators should have addressed a long time ago.

So far there are at least 10 states are fighting prediction market and more to come because the coalition pressuring the Supreme Court to let states regulate prediction market by themselves is getting bigger. Recently, NFL is also urging Supreme Court to also give states allowance to put regulation on prediction market. I think we will have more states to demand the same thing, then prediction market can't avoid to be regulated. I hope Supreme Court is doing his job asap because prediction market needs to be controlled. I'm getting upset to see how prediction market is also hiding behind CTFC who most probably get ordered by Trump's people to defend it.

For me they are actually gambling, since there's money involved which been placed by people. But prediction markets find a good situation to bypass the law and call use trading to avoid regulation. Now that Ohio regulators made counter action against Kalshi. Well maybe for now they are confused with possible right action to do. But maybe in future, they might draft a law that will identify Kalshi and other prediction market on where it belongs.

It is becoming increasingly difficult for them to operate in certain locations. Even for them, it is difficult to define themselves in a way that an authority can regulate them, and, since there is no middle ground, when in doubt, it is better to prohibit or limit. In reality, this debate will persist until a definitive end is put to it through strict and clear laws; until then, I believe that the prediction market companies will not cease their efforts.
They make huge sums of money from prediction markets and sometimes interfere in the internal politics of some countries, and their influence is expanding, so these companies will always seek to exploit legal loopholes to prove that they are not a type of gambling.
I think each State has their own local laws and if we look at it from other aspect, Kalshi needs to respect their local laws irrespective of paying taxes to the federal government. If Kalshi only operates online without having a physical office in Ohio, they can assume that paying taxes to the Ohio government can look irrelevant but it they have offices and live locations in that state, paying smaller taxes must be done irrespective of getting licensed from the federal. The state can decide to stop the operation of Kalshi in their state and nothing will happen.
