Why would you pay transaction fees if miners are always compensated?

Why would miners care about including transactions if there are no fees?

Exactly.  It becomes a tragedy of commons.   

You could avoid it w/ a hardcoded transaction fee mechanism but I don't have to say that anticipating future transaction fee requirements prior to the genesis block would be "challenging" (impossible ? )
