What do you mean by "in what sense"?

It is a ponzi because it works exactly like a ponzi.
The money you deposited is used to pay the people joined early.
If there are enough people joined after you, you will get paid. If not, you will not. Wink

I think all ponzis are scams by their very nature/definition. If they're not a scam straight from the get-go someone will get scammed eventually as they can't keep going forever.

OK, it was offline yesterday. Online today. I know it has nothing to do with the scam, but it seemed a bit fishy!
