Waiting of Governor's signature but just goes to show how liberty minded the NH state legislature is, partly because of the Free State Project.

Today, the New Hampshire House and Senate gave final approval to a bill that bans government officials from obtaining “information contained in a portable electronic device” without a warrant “signed by a judge and based on probable cause.” It now goes to the Governor Maggie Hassan’s desk for a signature.

The bill sets up a direct legal conflict with federal surveillance programs as well. It reads, in part:

“Government entity” means a federal, state, county, or local government agency, including but not limited to a law enforcement agency or any other investigative entity, agency, department, division, bureau, board, or commission, or an individual acting or purporting to act for, or on behalf of, a federal, state, county, or local government agency. “Government entity” shall not apply to a federal government agency to the extent that federal statute preempts state statute.

It would be impossible to enforce this law as Federal law trumps state law. Unfortunately this law will likely be found unconstitutional.

The USA patriot act should be amended to restrict surveillance on US citizens residing in the US.

It would be impossible to enforce this law as Federal law trumps state law. Unfortunately this law will likely be found unconstitutional.
The USA patriot act should be amended to restrict surveillance on US citizens residing in the US.

Exactly what I thought. There is only one way for New Hampshire to enforce the bill. That is to secede away from the US, and to declare that the NSA activities inside its territory are illegal. Right now, that seems very unlikely.

I am sure they realize this. Could be a nice test case for the Supreme Court.

The Patriot Act (just lol for a moment at the bill's name) should never have been written, should never have been voted on, and should never have been passed. It needs repealing.

It still is a nice show of disobedience to the Federal government
But I agree that the Federal law would outweigh the State law in this case.

And I agree the Patriot Act was an act that passed through the Congress based on fear and should be repealed.

There is nothing patriotic about the Patriot Act. The name itself is misleading, destined to silence the opposition by calling them unpatriotic. Dubya was an expert in such dirty tricks.  Grin

What America seems to need even more strongly right now is a provision against rampant data collection, period, including against foreign citizens and residents.
America's image abroad is being tarnished, and such a show won't hurt

I agree a sunset provision is important and for politicians to have more leeway from their parties on these type of votes
