Well if it was proven that the person, obtained the bitcoins through criminal actions, not just bitcoins could be confiscated. {Any other asset, eg. Cars / House etc.}

So that is not unique in any way.

If the person do not give over the secret pass phrase or private key, you just send him to jail for a longer period, without a option for parole.

Crime do not pay.

Plausible deniability is easily applicable in this case, as any other layered crypto/security measure. It's all about numbers and strings.
