I'm not sure if bitcoin gambling is in law terms gambling.

Not sure if this is the case.  So many gambling sites might be inflating the situation.

Because it can just as easily go unchecked..any business owner in the states or other country can just register the site to a different user living in a region where they don't have to pay tax and then run it. Tax evasion and many other things can arise from online gambling.
