I have a 5970 that I bought 6 months ago from newegg.

Then one day when I got home, the fans were at 100 percent and it wouldn't display any output. I restarted it and it came on just fine. When I try any miner, it just blanks the screen and the fans spin up. Only thing that will get it going again is a hard reset. I tried different drivers and different miners with the same result. I have replaced the 5970 with a 6950 and the system is hashing along fine now so it is not the system.
My question is, since it was an OEM from Newegg, is there no warranty other than Newegg's 30 days? I have emailed AMD's RMA department a couple times with no response. The card also looks exactly like this one from Diamond.

Any ideas on getting it to work or if I should just count my losses?
