FinCEN Regulations, Mining Pools and Multipools

Ok, I'm hoping we can clarify things here once and for all - as the FinCEN regulations with regards to the actual pools themselves (and not the miners) seem to be at least to me, not very clear.

As I understand it, as Mining Pools aren't "mining for themself" and especially Multipools who not only have others mine, but also Convert and trade virtual currencies... they would need FinCEN compliance? Or barr US miners from their systems?
