Author Topic: at wits end - illegal, unwelcome person living on property. how to remove?  (Read 1830 times)

so, i live with my fiance and her parents. we all get along just fine. their son lives on the property they own, in a trailer. he brought in someone i can best describe as his gf and she's been living there. in short, she's trash. drugs, actively involved in crime, threats of violence against us, etc. he's no peach either, but that's for later.

no lease agreement, verbal or written exists. no permission was given. she's been verbally told to get the fuck out multiple times, but refuses to do so.

my future in laws just went to a justice of the pease earlier today to try to file for eviction, but were shut down. something to do with the lack of lease. i don't know the details as they aren't home yet.

to put it lightly, my fiance is in tears, her mother - who's hand two heart attacks and survived cancer - is on the verge of physically puking she's so stressed and we're afraid she's gonna drop dead for all this.

anyone got any ideas? all i can think to do is to get her folks to declare me their agent, as they own the land but are both well into their 60's and aren't really able to handle this shit, and then deal with her myself, violently if i must. not that i want to hurt her or anything, but this shit's gone long enough. however i can't find anything on how to GET that declaration done and legally recognized. fiance is worried i'd get arrested for getting involved when it's not my property.

does anyone here have any idea where we can turn or how we can solve this before my mother in law has another heart attack?

Good luck with lawyers.
Its going to be hard to evict someone from the property. She's living with the son who has a place and has been allowed to reside there. It will be next to impossible to enforce who lives with him and who does not.

Of course, if she is abusing the family and making threats; then it would be a police matter. 

Drugs and criminal activities should also provoke interest from the authorities.

How tough are you? Can you make life miserable for her(them)? Turn off the water? Turn off the power?

If you have firearms and are rural you could always fire a shot over her head. Blame it on raccoons.       I'm kidding ... I'm kidding.

In my country, squatters move into city parks and public places. They have a very hard time getting rid of them.

this falls under the category of "house squatters" get a lawyer, and they will issue to get the legal right for them to get out of the place.

the judge will order something related to eviction, specific to house squatting since they wont leave. it moves faster, if a written agreement or lease thats been broken.

also when you hire a lawyer, ask their hourly rate or if they work on a flat rate, etc.

If they are paying the bills electricity water house taxes you have a very hard job getting them out could take up to two years doing it the legal way.Of course a burst from a AR51 in the house while there sleeping can often make them think twice about squatting

thanks guys. yea, the "next to impossible" is what we're finding, it seems.

and we ARE rural, actually... believe me, i'm tempted, but since it's not my property, i can't be the one doing it... sigh.

It is probably even more complicated than that, if she is living with the son in a separate building on the same land.
Depending on how much you care about getting the son in trouble, waiting until there are drugs or other illegal items in the trailer and then calling the police is one option.

yea, that's my fear. course he's run out his welcome too, at this stage. just one problem at a time seems to be the method here.

were it left in my hands, she'd be gone in a few hours. him too. scare the fucking shit out of them. i'd like to think it'd be easy. sigh.

I think you are hooped otherwise. The son is, well, related to the owners and has been living there. Therefore his position is "grandfathered".
If the owners are old and in poor health, fighting with the son and gf is NOT an option. They will not persevere.

Hopefully, you can find a way to distance yourselves from the trouble makers and, just, wait it out. This may be unlikely if the troublemakers are living on the property for free and getting free utilities.

Can you move them to the opposite side of the property?

You can't "wait them out". I'm no lawyer, but I did do some research on squatting a few years ago. If I remember correctly (here in Canada) squatters will legally own the right to live there after a certain amount of time passes. (7 years, i think.) Since there is no lease you can't "evict" them, but I'm guessing this would fall under trespassing and that should actually make it easier. No? Regardless, (again since there is no lease) I think you can legally turn off services like water and hydro. Also, calling the cops for any illegal activities is a no-brainer. (If you're bold enough and resourceful you could even try "planting evidence".)

Then again, you could always get some big dogs and let them run loose on the property, although I'm not entirely sure about the legal ramifications if someone were to get hurt. Hmm... I wonder what would happen if (one day while they were out) 'someone' stole their trailer. Wink

Well everyone got home and I looked over the paperwork. Doesn't make much sense. It's an eviction form and such. I don't see why they couldn't file it. Bleh.

buy a tank or some other armoured vehicle which you can drag stuff around really easily with, attach it to the trailer in the middle of the night when they aren't around and drag it out to some deserted wasteland out in the middle of nowhere, they'll get the message, seriously, that's what I'd do, they've invaded your home, the parents are clearly being taken advantage of because they wouldn't be able to fight back easily.

We hear about this kind of shit a lot in the UK and if isn't that we're dealing with it's obnoxious neighbours who just don't care about how loud they are.

Lol. She had a warrant out for violating her parole! Didn't know that... But the cops did! I called 911 and told them what was going on, mentioned I was worried she would get shot, they came and took her away in cuffs. Well, zip ties.
