No it was not Double Spend issue with gas, i just skimmed the source code but I think the POS code was bad and the first few blocks were mined already a few days ago, so as POS kicked in, HIS (old) blocks had much higher weight than every other and that gave him (together with the wrong POS setup) these large blocks
